AN ACT concerning 1 
 
Civil Actions – Damages – Use of Race, Ethnicity, and Gender Data 2 
 
FOR the purpose of prohibiting a calculation of damages for loss of earnings resulting from 3 
personal injury or wrongful death from being reduced based on race, ethnicity, or 4 
gender; and generally relating to civil actions and damages for loss of earnings. 5

 Annotated Code of Maryland 9 
 (2020 Replacement Volume and 2021 Supplement) 10 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 
That the Laws of Maryland read as follows: 12 
 
Article – Courts and Judicial Proceedings 13 
 
11–109.1. 14

 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 18  2 	SENATE BILL 313  
 
 
apply only prospectively and may not be applied or interpreted to have any effect on or 1 
application to any cause of action arising before the effective date of this Act. 2 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 3 
October 1, 2022. 4
