AN ACT concerning 1 
 
State Building Code – Electric Vehicles 2 
 
FOR the purpose of repealing provisions regarding requirements of builders of certain 3 
residential dwelling units to offer buyers certain options for the installation of 4 
electric vehicle charging stations; requiring the Department of Labor to adopt by 5 
regulation a State building code that requires the installation of certain percentages 6 
of EV–capable, EV–ready, and EVCS–installed parking spaces for certain newly 7 
constructed buildings and buildings undergoing certain renovations; and generally 8 
relating to the adoption of a State building code relating to the installation of electric 9 
vehicle chargers and associated electrical facilities.  10

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 21 
That the Laws of Maryland read as follows: 22 
 
Article – Public Safety 23

 (a) (1) In this section the following words have the meanings indicated. 1 
 
 (2) “Electric vehicle” means a vehicle that uses electricity for propulsion. 2 
 
 (3) “Electric vehicle charging station” means a connected point in an 3 
electrical wiring installation at which current is taken to charge a battery or any other 4 
energy storage device in an electric vehicle. 5 
 
 (4) “Level 2 charging” means that the charging capability of the electric 6 
vehicle charging station: 7 
 
 (i) includes the ability to charge a battery or any other energy 8 
storage device in an electric vehicle through means of an alternating current electrical 9 
service with a minimum of 208 volts; and 10 
 
 (ii) meets applicable industry safety standards. 11 
 
 (5) “Vehicle” has the meaning stated in § 11–176 of the Transportation 12 
Article. 13 
 
 (b) This section applies only to the construction of new housing units, including: 14 
 
 (1) single–family detached homes; and 15 
 
 (2) town houses. 16 
 
 (c) If the construction of one or more new housing units will include at least one 17 
garage, carport, or driveway for each housing unit, the builder or the builder’s agent shall 18 
provide each buyer or prospective buyer with the option to include in or on the garage, 19 
carport, or driveway: 20 
 
 (1) an electric vehicle charging station capable of providing at least Level 21 
2 charging; or 22 
 
 (2) a dedicated electric line of sufficient voltage to support the later 23 
addition of an electric vehicle charging station capable of providing at least Level 2 24 
charging. 25 
 
 (d) The builder or builder’s agent shall give to each buyer or prospective buyer: 26 
 
 (1) notice of the options listed in subsection (c) of this section; and 27 
 
 (2) specific information about any available rebate programs related to the 28 
purchase or installation of electric vehicle charging stations.] 29

 (A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 1

 (2) “DEPARTMENT ” MEANS THE DEPARTMENT OF LABOR. 3 
 
 (3) “DIRECT CURRENT FAST C HARGER” OR “DCFC” MEANS A DIRECT 4 
CURRENT CHARGER THAT CAN PRO VIDE A MINIMUM OF 50 KW OF POWER TO AN 5 
ELECTRIC VEHICLE .  6 
 
 (4) “ELECTRIC VEHICLE CHAR GING STATION” MEANS A DEVICE OR 7 
FACILITY FOR DELIVER ING ELECTRICITY FOR MOTOR VEHICLES THAT USE 8 
ELECTRICITY FOR PROP ULSION. 9 
 
 (5) “EV–CAPABLE PARKING SPACE” MEANS A DEDICATED PARKING 10 
SPACE PROVIDED WITH ELECTRICAL PANEL CAP ACITY AND INSTALLED CONDUIT 11 
THAT HAS THE ABILITY TO SUPPORT FUTURE IMPLE MENTATION OF EV CHARGING 12 
WITH A MINIMUM 40 AMPERE, 208/240 VOLT CIRCUIT.  13 
 
 (6) “EV–READY PARKING SPACE ” MEANS A DEDICATED PARKING 14 
SPACE THAT HA S A FULL CIRCUIT INSTALL ATION OF A MINIMUM 40 AMPERE, 15 
208/240 VOLT CIRCUIT PANEL CAPACITY , RACEWAY WIRING , RECEPTACLE AND 16 
CIRCUIT OVERPROTECTI ON DEVICES.  17 
 
 (7) “EVCS–INSTALLED PARKING SPACE ” MEANS A DEDICATED 18 
PARKING SPACE WITH AN ELECTRIC VEHICLE CHA RGING STATION WITH AT LEAST 19 
LEVEL 2 CHARGING CAPABILITY THAT IS FULLY INSTAL LED FROM THE ELECTRI CAL 20 
PANEL TO THE PARKING SPACE. 21 
 
 (8) “LEVEL 2 CHARGING” MEANS THAT THE CHARG ING CAPABILITY 22 
OF THE ELECTRIC VEHI CLE CHARGING STATION : 23 
 
 (I) INCLUDES THE ABILITY TO CHARGE A BATTERY OR ANY 24 
OTHER ENERGY STORAGE DEVICE IN AN ELECTRI C VEHICLE THROUGH ME ANS OF AN 25 
ALTERNATING CURRENT ELECTRICAL SERVICE W ITH A MINIMUM OF 208 VOLTS; AND 26 
 
 (II) MEETS APPLICABLE IND USTRY SAFETY STANDARDS . 27 
 
 (9) “VEHICLE” HAS THE MEANING STAT ED IN § 11–176 OF THE 28 
TRANSPORTATION ARTICLE. 29 
 
 (B) (1) ON OR BEFORE JULY 1, 2023, THE DEPARTMENT SHALL ADOP T BY 30 
REGULATION A STATE BUILDING CODE TO REQUIRE NEWLY CON STRUCTED 31 
BUILDINGS AND BUILDI NGS UNDERGOING SIGNI FICANT RENOVATION TH AT 32  4 	SENATE BILL 627  
 
 
INCLUDES ELECTRIC PA NEL OR PARKING UPGRA DES TO INCLUDE PROVI SIONS FOR 1 
ELECTRICAL SERVICE C APACITY FOR CHARGING ELECTRIC VEHICLES .  2 
 
 (2) THE CODE:  3 
 
 (I) SHALL APPLY ONLY TO: 4 
 
 1. PRIVATELY OWNED COMM ERCIAL BUILDINGS ; 5 
 
 2. MULTIFAMILY RESIDENT IAL BUILDINGS;  6 
 
 3. MIXED–USE BUILDINGS CONSIS TING OF PRIVATELY 7 
OWNED COMMERCIAL SPA CE AND FIVE OR MORE RESIDENTIAL DWELLING UNITS; 8 
AND 9 
 
 4. SINGLE–FAMILY RESIDENTIAL UNITS AN	D 10 
TOWNHOUSES ; 11 
 
 (II) SHALL REQUIRE THAT EACH BUILDING I NCLUDE AT LEAST A 12 
MINIMUM PERCENTAGE O F EV–CAPABLE, EV–READY, AND EVCS–INSTALLED 13 
PARKING SPACES IN THE GARAGE OR PAR KING AREA OF THAT BU ILDING;  14 
 
 (III) SHALL PROVIDE THAT A PARKING SPACE DESIGN ATED AS: 15 
 
 1. EV–CAPABLE MAY BE REPLAC ED BY EITHER AN 16 
EV–READY OR EVCS–INSTALLED PARKING SPACE ; AND  17 
 
 2. EV–READY MAY BE REPLACED BY AN 18 
EVCS–INSTALLED PARKING SPA CE; AND 19 
 
 (IV) MAY PROVIDE THAT , FOR COMMERCIAL BUILD INGS, 20 
PARKING SPACES SERVE D BY DIRECT CURRENT FAST CHARGERS MAY CO UNT 21 
TOWARD THE COMPLIANC E WITH THE MINIMUM P ERCENTAGE REQUIREMEN TS FOR 22 
EV–READY OR EVCS–INSTALLED PARKING SP ACES AT A RATIO OF 1 TO 5, WITH ONE 23 
DCFC PARKING SPACE COUNTE D AS THE EQUIVALENT TO FIVE EV–READY OR 24 
EVCS–INSTALLED PARKING SP ACES. 25 
 
 (C) THE MINIMUM PERCENTAG E REQUIREMENTS FOR EV–CAPABLE,  26 
EV–READY, AND EVCS–INSTALLED PARKING SPA CES SHALL BE AS FOLLOWS: 27 
 
 (1) FOR A PRIVATELY OWNE D COMMERCIAL BUILDIN G, OF THE TOTAL 28 
NUMBER OF PARKING SP ACES DEDICATED TO TH AT BUILDING: 29

 (I) 10% SHALL BE EVCS–INSTALLED PARKING SPACES ; AND 1 
 
 (II) 15% SHALL BE EV–READY PARKING SPACES ; 2 
 
 (2) FOR A MULTIFAMILY RESIDENT IAL BUILDING, OF THE TOTAL 3 
NUMBER OF PARKING SP ACES DEDICATED TO TH AT BUILDING: 4 
 
 (I) 20% SHALL BE EVCS–INSTALLED PARKING SPACES ;  5 
 
 (II) 50% SHALL BE EV–READY PARKING SPACES ; AND 6 
 
 (III) 30% SHALL BE EV–CAPABLE PARKING SPACES ; 7 
 
  (3) FOR A MIXED–USE BUILDING CONSIST ING OF PRIVATELY OWN ED 8 
COMMERCIAL SPACE AND FIVE OR MORE RESIDEN TIAL DWELL ING UNITS, OF THE 9 
TOTAL NUMBER OF PARK ING SPACES DEDICATED TO THAT BUILDING : 10 
 
 (I) FOR COMMERCIAL PARKING SPACES , THE REQUIRED 11 
PERCENTAGE S IN ITEM (1) OF THIS SUBSECTION S HALL APPLY; AND 12 
 
 (II) FOR RESIDENTIAL PARK ING SPACES , THE REQUIRED 13 
PERCENTAGES IN ITEM (2) OF THIS SUBSECTION S HALL APPLY; AND 14 
 
 (4) 100% OF THE PARKING SPACE S DEDICATED TO A TOW NHOUSE OR 15 
SINGLE–FAMILY RESIDENTIAL U NIT SHALL BE EV–READY PARKING SPACES , 16 
UNLESS A SINGLE RESI DENTIAL UNIT IS ASSI GNED TWO ADJOINING P ARKING 17 
SPACES, IN WHICH CASE BOTH SPACES MAY BE SERVED BY A S INGLE EV–READY 18 
CONNECTION . 19 
 
 (D) A SINGLE MINIMUM 40 AMPERE, 208/240 VOLT CIRCUIT MAY BE USED 20 
TO SUPPORT CHARGING IN TWO ADJACENT EV–CAPABLE OR EV–READY PARKING 21 
SPACES.  22 
 
 (E) THIS SECTION MAY NOT BE CONSTRUED TO PROHIBIT A COUNTY OR 23 
MUNICIPAL CORPORATIO N FROM ADOPTING AND ENFO RCING REQUIREMENTS AND 24 
REGULATIONS THAT ARE MORE STRINGENT THAN THOSE SET FORTH IN T HIS 25 
SECTION. 26 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 27 
apply only prospectively and may not be applied or interpreted to have any effect on or 28 
application to any building construction or renovation for which the building permit is 29 
issued before July 1, 2023. 30 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 31  6 	SENATE BILL 627
