23	23	FOR the purpose of establishing the Maryland–National Capital Park and Planning 5
24	24	Commission Restructuring Task Force to study the feasibility of transferring 6
25	25	Montgomery County–specific duties of the Maryland–National Capital Park and 7
26	26	Planning Commission to the Montgomery County government ; and generally 8
27	27	relating to the Maryland–National Capital Park and Planning Commission 9

30	30	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11

33	33	(a) There is a Maryland–National Capital Park and Planning Commission 13
34	34	Restructuring Task Force. 14

36	36	(b) (1) The Task Force consists of the following members: 15

38	38	(i) one member of the Senate of Maryland, appointed by the 16
39	39	President of the Senate; 17

41	41	(ii) one member of the House of Delegates, appointed by the Speaker 18
42	42	of the House; 19

44	44	(iii) the Chair of the Montgomery County Planning Board, or the 20
45	45	Chair’s designee; 21

47	47	(iv) the County Executive of Montgomery County, or the County 22

88	88	Association of Metropolitan Washington, designated by the Association. 25

90	90	(2) The Office of the County Executive of Montgomery County may appoint 26
91	91	representatives from additional county executive branch agencies to serve as advisory 27
92	92	members of the Task Force. 28

94	94	(c) The members appointed by the President of the Senate and the Speaker of the 29
95	95	House shall serve jointly as cochairs of the Task Force. 30

97	97	(d) The Office of the County Executive of Montgomery County shall designate 31 HOUSE BILL 796 3

100	100	staff for the Task Force. 1

102	102	(e) A member of the Task Force: 2

104	104	(1) may not receive compensation as a member of the Task Force; but 3

106	106	(2) is entitled to reimbursement for expenses under the Standard State 4
107	107	Travel Regulations, as provided in the State budget. 5

109	109	(f) (1) The Task Force shall: 6

111	111	(i) study the feasibility of transferring duties of the Montgomery 7
112	112	County Planning Board, the Planning Department, and the Parks Department of the 8
113	113	Maryland–National Capital Park and Planning Commission to the Montgomery County 9
114	114	government; and 10

116	116	(ii) make recommendations on restructuring the 11
117	117	Maryland–National Capital Park and Planning Commission to no longer include 12
118	118	Montgomery County. 13

120	120	(2) The Task Force may hire a consultant to assist the Task Force in 14
121	121	performing the requirements of paragraph (1) of this subsection. 15

123	123	(g) (1) The Task Force shall hold at least two public hearings before 16
124	124	submitting the report required under subsection (h) of this section. 17

126	126	(2) The time and location of the public hearings required under this 18
127	127	subsection shall be at the discretion of the cochairs of the Task Force. 19

129	129	(h) On or before December 1, 2024, the Task Force shall submit a report of its 20
130	130	findings and recommendations to the County Executive of Montgomery County, the County 21
131	131	Council of Montgomery County, and, in accordance with § 2–1257 of the State Government 22
132	132	Article, the members of the Montgomery County Delegation to the General Assembly. 23

134	134	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 24
135	135	1, 2023. It shall remain effective for a period of 2 years and, at the end of June 30, 2025, 25
136	136	this Act, with no further action required by the General Assembly, shall be abrogated and 26
137	137	of no further force and effect. 27
