[Brackets] indicate matter deleted from existing law. *hb0796* HOUSE BILL 796 L5, L6 3lr0548 By: Montgomery County Delegation and Prince George’s County Delegation Introduced and read first time: February 8, 2023 Assigned to: Environment and Transportation A BILL ENTITLED AN ACT concerning 1 Montgomery County – Maryland–National Capital Park and Planning 2 Commission Restructuring Task Force – Establishment 3 MC/PG 104–23 4 FOR the purpose of establishing the Maryland–National Capital Park and Planning 5 Commission Restructuring Task Force to study the feasibility of transferring 6 Montgomery County–specific duties of the Maryland–National Capital Park and 7 Planning Commission to the Montgomery County government ; and generally 8 relating to the Maryland–National Capital Park and Planning Commission 9 Restructuring Task Force. 10 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 That: 12 (a) There is a Maryland–National Capital Park and Planning Commission 13 Restructuring Task Force. 14 (b) (1) The Task Force consists of the following members: 15 (i) one member of the Senate of Maryland, appointed by the 16 President of the Senate; 17 (ii) one member of the House of Delegates, appointed by the Speaker 18 of the House; 19 (iii) the Chair of the Montgomery County Planning Board, or the 20 Chair’s designee; 21 (iv) the County Executive of Montgomery County, or the County 22 Executive’s designee; 23 2 HOUSE BILL 796 (v) the President of the Montgomery County Council , or the 1 President’s designee; 2 (vi) the Director of the Montgomery County Department of 3 Permitting Services, or the Director’s designee; 4 (vii) the Director of the Montgomery County Parks Department, 5 Maryland–National Capital Park and Planning Commission, or the Director’s designee; 6 (viii) the Director of the Montgomery County Planning Department, 7 or the Director’s designee; 8 (ix) the Director of Montgomery County Recreation, or the Director’s 9 designee; 10 (x) the Director of the Montgomery County Office of Management 11 and Budget, or the Director’s designee; 12 (xi) the President of UFCW Local 1994 MCGEO, or the President’s 13 designee; 14 (xii) the following members, appointed by the County Executive of 15 Montgomery County: 16 1. two members of the public; and 17 2. one attorney who practices land use law primarily in 18 Montgomery County; 19 (xiii) two members of the public, appointed by the President of the 20 Montgomery County Council; 21 (xiv) one representative of the Maryland Building Industry 22 Association, designated by the Association; and 23 (xv) one representative of the Apartment and Office Building 24 Association of Metropolitan Washington, designated by the Association. 25 (2) The Office of the County Executive of Montgomery County may appoint 26 representatives from additional county executive branch agencies to serve as advisory 27 members of the Task Force. 28 (c) The members appointed by the President of the Senate and the Speaker of the 29 House shall serve jointly as cochairs of the Task Force. 30 (d) The Office of the County Executive of Montgomery County shall designate 31 HOUSE BILL 796 3 staff for the Task Force. 1 (e) A member of the Task Force: 2 (1) may not receive compensation as a member of the Task Force; but 3 (2) is entitled to reimbursement for expenses under the Standard State 4 Travel Regulations, as provided in the State budget. 5 (f) (1) The Task Force shall: 6 (i) study the feasibility of transferring duties of the Montgomery 7 County Planning Board, the Planning Department, and the Parks Department of the 8 Maryland–National Capital Park and Planning Commission to the Montgomery County 9 government; and 10 (ii) make recommendations on restructuring the 11 Maryland–National Capital Park and Planning Commission to no longer include 12 Montgomery County. 13 (2) The Task Force may hire a consultant to assist the Task Force in 14 performing the requirements of paragraph (1) of this subsection. 15 (g) (1) The Task Force shall hold at least two public hearings before 16 submitting the report required under subsection (h) of this section. 17 (2) The time and location of the public hearings required under this 18 subsection shall be at the discretion of the cochairs of the Task Force. 19 (h) On or before December 1, 2024, the Task Force shall submit a report of its 20 findings and recommendations to the County Executive of Montgomery County, the County 21 Council of Montgomery County, and, in accordance with § 2–1257 of the State Government 22 Article, the members of the Montgomery County Delegation to the General Assembly. 23 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 24 1, 2023. It shall remain effective for a period of 2 years and, at the end of June 30, 2025, 25 this Act, with no further action required by the General Assembly, shall be abrogated and 26 of no further force and effect. 27
