The principal shall be discharged within 15 years after the date of issue 21 of the bonds. 22 (5) (a) Prior to the payment of any matching grant funds under the provisions 23 of Section 1(3) Items ZA00 through ZB02 of this Act, grantees shall provide and expend 24 matching funds as specified. No part of a grantee’s matching fund may be provided, either 25 directly or indirectly, from funds of the State, whether appropriated or unappropriated. 26 Except as otherwise provided, no part of the fund may consist of real property, in kind 27 contributions, or funds expended prior to the effective date of this Act. In case of any dispute 28 as to what money or assets may qualify as matching funds, the Board of Public Works shall 29 determine the matter, and the Board’s decision is final. Grantees have until June 1, 2025, 30 to present evidence satisfactory to the Board of Public Works that the matching fund will 31 be provided. If any funds 29 authorized by this Act remain unexpended or unencumbered after June 1, 2030, the amount 30 of the unexpended or unencumbered authorization shall be canceled and be of no further 31 force and effect. If bonds have been issued for the loan, the amount of unexpended or 32 unencumbered bond proceeds shall be disposed of as provided in § 8–129 of the State 33 Finance and Procurement Article. 34 (8) Multiple grants provided to the same organization in this Section are in 35 addition to one another. Unless otherwise provided, any matching fund requirements apply 36 to each individual grant. 37 SENATE BILL 182 29 (9) (a) Subject to subparagraphs (b) and (c) of this paragraph, the Board of 1 Public Works may approve an appropriation in Section 1(3) Items ZA00 through ZB02 of 2 this Act, notwithstanding technical differences in: 3 (i) The name of the grantee or the description of the project, provided 4 that the proposed use of funds is consistent with the public purpose of the original 5 appropriation; or 6 (ii) The location of the project. 7 (b) The Department of Budget and Management shall notify the Office of 8 Policy Analysis within the Department of Legislative Services in writing of: 9 (i) The technical differences between an appropriation in Section 10 1(3) Items ZA00 through ZB02 of this Act and the proposed use of the funds; and 11 (ii) The justification that the proposed use of the funds is consistent 12 with the public purpose of the appropriation. 13 (c) (i) The Office of Policy Analysis shall have 45 days to review and 14 comment on the proposed use of the funds. 15 (ii) If the Office of Policy Analysis does not submit written objections 16 within 45 days, the Department of Budget and Management shall provide certification in 17 writing to the Board of Public Works that the proposed use of funds may be approved 18 notwithstanding technical differences in the appropriation in Section 1(3) Items ZA00 19 through ZB02 of this Act. 20 (10) Notwithstanding §§ 8–125(e) and 8–132 of the State Finance and Procurement 21 Article, the State Treasurer shall determine the amount of premium from the sale of bonds 22 in fiscal years 2022, 2023, and 2024 to be transferred to the Annuity Bond Fund. Upon each 23 issuance of State bonds in fiscal years 2022, 2023, and 2024, the Treasurer shall notify the 24 Comptroller of the Treasurer’s determination and the Comptroller shall credit the premium 25 accordingly. Premium from the sale of bonds in fiscal years 2022, 2023, and 2024 that is not 26 transferred to the Annuity Bond Fund may, upon approval of the Board of Public Works, be 27 expended by the Comptroller for any of the public purposes set forth in Section 1(3) of this 28 Act, including any applicable architects’ and engineers’ fees. 29 (11) Notwithstanding § 8–122.1 of the State Finance and Procurement Article, the 30 principal amount of any loan authorized under this Act shall be reduced by the cash 31 proceeds, excluding any accrued interest, received for the State bonds and allocated by the 32 Comptroller to the loan. 33 SECTION 2. AND BE IT FURTHER ENACTED, That, with the approval of the 16 Department of Budget and Management, any appropriation under the provisions of this 17 Act that is in excess of the amount needed for a project may be credited to the Construction 18 Contingency Fund under § 3–609 of the State Finance and Procurement Article. 19 Notwithstanding the fund balance restriction set forth in § 3–609(c) of the State Finance 20 and Procurement Article, any funds credited to the Fund may cause the total balance in 21 the Fund to exceed 1.25% of the capital debt affordability limit as determined under Title 22 8 of the State Finance and Procurement Article, in fiscal year 2024. 23 SECTION 8. AND BE IT FURTHER ENACTED, That, if federal funds are available 24 to help accomplish any project identified in this Act, the State agency or institution 25 responsible for the project shall make efforts through proper administrative procedures to 26 obtain these federal funds. Before spending any funds appropriated by this Act, the agency 27 or institution shall certify its efforts to the Board of Public Works and state the reason for 28 any failure to obtain federal funds. If federal funds are obtained, they shall be used to defray 29 the costs of the project described in this Act and not to expand its scope. 30 SECTION 9. AND BE IT FURTHER ENAC TED, That: 31 (1) for any appropriation for the planning of a State–owned project provided in 32 this Act, if a program required by § 3–602(d) of the State Finance and Procurement Article 33 has not been submitted, the State agency or institution responsible for the project shall 34 submit a program to the Department of Budget and Management for approval before funds 35 may be expended from the appropriation; and 36 (2) for any appropriation for the construction of a State–owned project provided 37 in this Act, if preliminary plans and outline specifications required by § 3–602(f)(2)(i) of the 38 SENATE BILL 182 43 State Finance and Procurement Article have not been prepared, the State agency or 1 institution responsible for the project shall submit preliminary plans and outline 2 specifications to the Department of Budget and Management for approval before funds may 3 be expended from the appropriation. 4 SECTION 10. AND BE IT FURTHER ENACTED, That no portion of the proceeds of 5 a loan or any of the matching funds provided for a project funded under this Act may be 6 used for the furtherance of an essentially religious endeavor. Upon the request of the Board 7 of Public Works, a recipient of the proceeds of a loan under this Act shall submit evidence 8 satisfactory to the Board that none of the proceeds of the loan or any matching funds has 9 been or is being used for a purpose prohibited by this Act. 10 SECTION 11. AND BE IT FURTHER ENACTED, That the Comptroller may 11 advance funds to any loan funds account established pursuant to a general obligation bond 12 loan enabling Act for any expenditure authorized by that Act, provided that if general 13 obligation bonds have not been issued under the authority of that Act, the next ensuing 14 sale of general obligation bonds shall include the issuance of bonds under the authority of 15 that Act in an amount at least equivalent to the amount of the funds so advanced. 16 SECTION 12.
