A BILL ENTITLED 
 
AN ACT concerning 1 
 
Maryland Building Performance Standards – Apartment Building Height 2 
Allowances – Study and Alterations 3 
 
FOR the purpose of requiring the Maryland Department of Labor to establish a workgroup 4 
to study and make recommendations relating to maximum height restrictions for 5 
apartment buildings with a single–exit stairway; requiring the Department to adopt 6 
certain regulations by a certain date; and generally relating to maximum height 7 
restrictions for apartment buildings with single–exit stairways.  8 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 9 
That: 10 
 
 (a) The Maryland Department of Labor shall establish a workgroup to study the 11 
maximum height restriction in each state for apartment buildings with a single–exit 12 
stairway. 13 
 
 (b) The study shall: 14 
 
 (1) analyze the maximum height restrictions in each state for an 15 
apartment building with a single–exit stairway; and 16 
 
 (2) on or before July 1, 2026, make recommendations to increase the 17 
maximum height restriction for an apartment building with a single–exit stairway in the 18 
State. 19 
 
 (c) On or before June 1, 2027, the Maryland Department of Labor shall adopt 20 
regulations to modify the maximum height restriction for an apartment building with a 21 
single–exit stairway in the Maryland Building Performance Standards based on the 22 
recommendations of the workgroup. 23

 SECTION 2. AND BE IT FURTHER ENACTED, That this Ac t shall take effect July 1 
1, 2024. It shall remain effective for a period of 3 years and, at the end of June 30, 2027, 2 
this Act, with no further action required by the General Assembly, shall be abrogated and 3 
of no further force and effect. 4
