BE IT ENACTED B Y THE GENERAL ASSEMBLY OF MARYLAND, 10 That the Laws of Maryland read as follows: 11 Article – Education 12 3–105. 13 (a) Subsections (b), (c), and (d) of this section do not apply to a county if the 14 number of members of the county board is regulated by other provisions of this title. 15 (b) If a county school system has an enrollment of less than 50,000 students, the 16 county board shall have five members, except that: 17 (1) The Worcester County Board shall have the number of members 18 provided in subsection (e) of this section; and 19 (2) Any county board that had more than five members on July 1, 1969, 20 shall retain that number of members. 21 (c) If a county school system has an enrollment of 50,000 students or more but 22 less than 100,000 students, the county board shall have seven members. 23 (d) If a county school system has an enrollment of 100,000 students or more, the 24 county board shall have nine members except as provided in § 3–901 of this title for 25 Montgomery County and § 3–1002 of this title for Prince George’s County. 26 (e) The Worcester County Board consists of seven voting members and one 27 [nonvoting] student member from each public high school in the county. 28 (F) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , IF A COUNTY 29 BOARD OF EDUCATION WITHOUT A STUDENT MEMBER ADD S A STUDENT MEMBER T O 30 THE BOARD ON OR AFTER JULY 1, 2024, THE STUDENT MEMBER MAY VOTE ON ANY 31 MATTER BEFORE THE COUNTY BOARD EXCEPT A MATTER THAT RELATES TO: 32 SENATE BILL 386 3 (I) THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 1 INVOLVING PERSONNEL ; 2 (II) HEARINGS HELD UNDER § 6–202 OF THIS ARTICLE; OR 3 (III) APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF THIS 4 ARTICLE. 5 (2) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE NONSTUDENT 6 MEMBERS, A COUNTY BOARD MAY E XPAND THE MATTERS ON WHICH A STUDENT 7 MEMBER MAY VOTE. 8 (3) IF A COUNTY BOARD ADDS A STUDENT MEMBE R, THE STUDENT 9 MEMBER MAY ATTEND OR PARTICIPATE IN AN EX ECUTIVE OR SPECIAL S ESSION OF 10 THE COUNTY BOARD ON A MATTER FOR WHICH T HE STUDENT MEMBER MA Y VOTE. 11 3–108.1. 12 (c) There is a Baltimore City Board of School Commissioners of the Baltimore 13 City Public School System. 14 (d) (1) The board consists of: 15 (i) Except as provided in paragraph (2) of this subsection, nine 16 voting members appointed by the Mayor from a list of qualified individuals submitted to 17 the Mayor by the panel; 18 (ii) Two elected voting members; and 19 (iii) One voting student member elected as provided in subsection (m) 20 of this section. 21 (2) If the Mayor elects not to appoint a member from a list submitted by 22 the panel under paragraph (1)(i) of this subsection, the Mayor shall reconvene the panel to 23 submit additional names of qualified candidates. 24 (m) (1) The student member shall be a student regularly enrolled in the 25 student’s junior or senior year of high school in the Baltimore City Public School System 26 who shall be elected by the high school students of the Baltimore City Public School System, 27 in accordance with procedures established by the board in collaboration with the Associated 28 Student Congress of Baltimore City. 29 (2) The term of a student member is 1 year. 30 (3) A student member may not serve more than two consecutive full terms. 31 4 SENATE BILL 386 (4) [The] SUBJECT TO PARAGRAPH S (5) AND (6) OF THIS SUBSECTION , 1 THE student member may vote on [matters] ANY MATTER before the board, including 2 [those relating] A MATTER THAT RELATE S to: 3 (i) Capital and operating budgets; 11 (II) HEARINGS HELD UNDER § 6–202 OF THIS ARTICLE; OR 12 (III) APPEALS TO THE BOARD UNDER § 4–205 OF THIS ARTICLE . 13 (6) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE NONS TUDENT 14 MEMBERS, THE BOARD MAY EXPAND THE MATTERS ON WHICH THE STUDENT 15 MEMBER MAY VOTE . 16 [(6)] (7) The student member may attend or participate in an executive 17 or special session of the board ON A MATTER FOR WHIC H THE STUDENT MEMBER MAY 18 VOTE. 19 3–201. 20 (a) (1) In this subtitle, “elected member” means a voting member elected under 21 subsection (d) or (e) of this section or a member appointed to an elected position on the 22 county board under subsection (e)(3) of this section. 23 (2) “Elected member” does not include the [nonvoting] student member 24 selected under subsection (f) of this section. 25 (b) The Allegany County Board consists of: 26 (1) Five elected members; and 27 (2) One [nonvoting] student member, who is to advise the other members 28 of the county board on the viewpoint of students who attend Allegany County public schools. 29 SENATE BILL 386 5 (f) (1) The [nonvoting] student member of the county board shall be: 1 (i) A twelfth grade student, in good standing, and regularly enrolled 2 in an Allegany County public school; 3 (ii) A resident of Allegany County for at least 2 years; and 4 (iii) Of good character. 5 (2) The [nonvoting] student member shall be nominated and elected for a 6 1–year term during the school year prior to the school year that the member is to serve on 7 the county board in accordance with procedures adopted by the Allegany County 8 Association of Student Councils. 9 (3) If a vacancy occurs in the student member’s position before the end of 10 the term, a qualified student shall be selected for the remainder of the term in accordance 11 with procedures of the Allegany County Association of Student Councils. 12 (4) (I) SUBJECT TO SUBPARAGRAPH (II) OF THIS PARAGRAPH , THE 13 STUDENT MEMBER MAY VOTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 14 A MATTER THAT RELATE S TO: 15 1. 18 (2) Four appointed members; and 19 (3) One student member. 20 3–2B–05. 21 (a) The student member shall: 22 (1) Be an 11th or a 12th grade student in the Baltimore County public 23 school system elected by the middle school and high school students of the county in 24 accordance with procedures established by the Baltimore County student councils; 25 (2) Serve for 1 year; and 26 (3) Advise the county board on the thoughts and feelings of students. 27 SENATE BILL 386 7 (b) Unless invited to attend by an affirmative vote of a majority of the county 1 board, the student member may not attend an executive session that relates to [: 2 (1) Hearings on appeals of special education placements; 3 (2) Hearings held under § 6–202(a) of this article; or 4 (3) Collective bargaining] A MATTER ON WHICH TH E STUDENT MEMBER 5 MAY NOT VOTE . 6 (c) Subject to subsection (d) of this section, the student member may vote on all 7 matters except [those relating] A MATTER THAT RELATE S to: 8 (1) [§ 6–202(a) of this article] THE DISMISSAL OF OR O THER 9 DISCIPLINARY ACTION INVOLVING PERSONNEL ; 10 (2) [Collective bargaining] HEARINGS HELD UNDER § 6–202 OF THIS 11 ARTICLE; and 12 (3) [School closings, reopenings, and boundaries] APPEALS TO THE 13 COUNTY BOARD UNDER § 4–205 OF THIS ARTICLE . 14 (d) On a majority vote of the nonstudent members, the county board may 15 [determine]: 16 (1) DETERMINE, on a case–by–case basis, whether a matter under 17 consideration is covered by the exclusionary provisions listed in subsection (c) of this 18 section; AND 19 (2) EXPAND THE MATTERS ON WHICH THE STUDENT MEMBER MAY 20 VOTE. 21 (e) (1) On or before December 31, 2023, a workgroup composed of several 22 members of the county board and the executive leadership of the Baltimore County public 23 school system shall develop a draft curriculum for budget training for student members of 24 the county board and submit the draft curriculum to the county board for review. 25 (2) The training for student members shall: 26 (i) Focus on the operating and capital budget process of the county 27 board; and 28 (ii) Be facilitated by representatives of the Baltimore County public 29 school system’s Division of Business Services. 30 8 SENATE BILL 386 [(3) Each student member shall be required to complete the budget 1 training: 2 (i) Within 2 months of the student member’s election to the county 3 board; and 4 (ii) In order to be eligible to vote on budgetary matters.] 5 3–301. 6 (a) The Calvert County Board consists of five [voting] ELECTED members and 7 one [nonvoting] student member. 8 (b) The five [voting] ELECTED members of the Calvert County Board shall be 9 elected at a general election as required by subsections (d) and (f) of this section. 10 (d) Of the five [voting] ELECTED members of the county board: 11 (1) One shall be elected from each of the three county commissioner 12 districts; and 13 (2) Two shall be elected from the county at large. 14 (h) (1) The student member shall: 15 (i) Be an eleventh or twelfth grade student in the Calvert County 16 public school system elected by the high school students of the county in accordance with 17 procedures established by the school system; 18 (ii) Serve for 1 year beginning on June 1; 19 (iii) [Be] SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , BE 20 a [nonvoting] VOTING member; and 21 (iv) Advise the board on the thoughts and feelings of the students. 22 (2) Unless invited to attend by an affirmative vote of a majority of the 23 ELECTED MEMBERS OF THE county board, the student may not attend an executive 24 session RELATING TO A MATTER ON WHICH THE STUDENT MEMBER MAY NOT VOTE . 25 (3) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 26 STUDENT MEMBER MAY V OTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 27 A MATTER THAT RELATE S TO: 28 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 2 THIS ARTICLE. 3 (II) ON AN AFFIRMATIVE VOTE O F THE MAJORITY OF THE 4 ELECTED MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH 5 THE STUDENT MEMBER MAY V OTE. 6 3–303. 7 (a) At its first meeting at the beginning of each calendar year, the county board 8 shall elect a president and a vice president from among its ELECTED members. 9 (b) (1) The president of the county board is entitled to receive $6,500 annually 10 as compensation and the other members are entitled to receive $5,500 each annually as 11 compensation. 12 (2) An elected member is entitled to health insurance benefits regularly 13 provided to employees of the board of education under the same terms and conditions 14 extended to other employees of the board of education. 15 3–3A–01. 16 (d) (2) “Elected member” does not include the [nonvoting] student members 17 selected under § 3–3A–02(f) of this subtitle. 18 3–3A–02. 19 (a) The Caroline County Board of Education consists of: 20 (1) Three elected members; 21 (2) Two appointed members; and 22 (3) Two [nonvoting] student members. 23 (f) (1) A student member of the county board shall: 24 (i) Be a regularly enrolled eleventh or twelfth grade student of good 25 character and in good standing in a Caroline County public high school during the student’s 26 term in office; 27 (ii) Be selected in the student’s tenth or eleventh grade in accordance 28 with paragraph (3) of this subsection; and 29 10 SENATE BILL 386 (iii) 1. Serve for a term of 1 year; and 1 2. If the student is in the twelfth grade, continue to serve 2 after graduation and until a successor is selected and qualifies. 3 (2) Each high school in the county shall be represented by a student 4 member of the county board. 5 (3) (i) For nomination to the county board, the student body shall 6 submit to the principal of the high school a list of nominees that contains the names of 7 eligible students. 8 (ii) The principal of the high school shall select the student member 9 from the list of nominees submitted to the principal under subparagraph (i) of this 10 paragraph. 11 (4) If a vacancy in the position of student member occurs during the term 12 of a student member, the principal of the high school represented on the county board shall 13 select another student member using the method set forth under paragraph (3) of this 14 subsection. 15 (5) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , A 16 STUDENT MEMBER MAY V OTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 17 A MATTER THAT RELATE S TO: 18 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 22 THIS ARTICLE. 23 (II) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE 24 NONSTUDENT MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON 25 WHICH A STUDENT MEMBER MAY VOTE. 26 (6) THE STUDENT MEMBER MAY N OT ATTEND EXECUTIVE SESSIONS 27 OF THE COUNTY BOARD RELATING TO MATTERS ON WHICH THE STUDENT MEMBER 28 MAY NOT VOTE . 29 (h) (1) In the event of a vacancy of an elected member on the county board due 30 to death, resignation, disqualification, or removal, the remaining [voting] NONSTUDENT 31 SENATE BILL 386 11 members shall select a qualified individual to fill the vacancy for the remainder of the term 1 of the vacating member and until a successor is elected and qualifies. 2 (2) An individual appointed to fill a vacancy for an elected member shall be 3 a resident of the same board of education district as that of the vacating member. 4 (3) Before filling a vacancy for an elected member, the remaining [voting] 5 NONSTUDENT members of the county board shall conduct an interview of each applicant 6 at an open meeting. 7 (4) (i) The county board shall publish a list of the names of the 8 applicants for a vacancy on the county board at least 2 weeks before the interview of the 9 first applicant is scheduled to occur. 10 (ii) The county board shall cause public notice of the date, time, and 11 location of the interview for each applicant to be published: 12 1. At least 2 weeks before the interview is scheduled to occur; 13 and 14 2. In the same manner as public notice of a regular meeting 15 of the county board is published. 16 (5) The county board is not required to conduct discussions of the 17 applicants or make the final selection of the elected member to fill the vacancy at an open 18 meeting. 19 3–3A–04. 20 (a) At its first meeting in December of each year, the [voting] NONSTUDENT 21 members of the county board shall elect a president and vice president from among its 22 members. 23 (b) In the event of a vacancy in the office of president or vice president of the 24 county board, the [voting] NONSTUDENT members of the county board shall elect a new 25 officer to fill the vacancy within 30 days after the vacancy occurs. 26 3–3A–05. 27 (a) The president of the county board is entitled to receive $4,000 annually as 28 compensation, and the other [voting] NONSTUDENT members are entitled to receive 29 $3,500 each annually as compensation. 30 (b) As provided in the Caroline County budget, each [voting] NONSTUDENT 31 member is entitled to an allowance for travel and other expenses. 32 12 SENATE BILL 386 (c) A [voting] NONSTUDENT member is not eligible for any fringe benefit 1 provided by the Caroline County Public School System, the Caroline County Board of 2 Education, or the County Commissioners of Caroline County, including: 3 (1) Health insurance; 4 (2) Life insurance; and 5 (3) A pension. 6 3–401. 7 (a) The Carroll County Board consists of: 8 (1) Five voting members; 9 (2) Subject to subsection (f) of this section, one [nonvoting] VOTING 10 student [representative] MEMBER; and 11 (3) The County Commissioners, who are nonvoting ex officio members. 12 (f) (1) The student [representative] MEMBER shall: 13 (i) Be an eleventh or twelfth grade student in the Carroll County 14 public school system elected by the high school students of the county in accordance with 15 procedures established by the school system; 16 (ii) Be a student government association representative at the 17 student’s high school; 18 (iii) Serve for 1 year beginning on July 1 after the election of the 19 student [representative; and] MEMBER; 20 (iv) Advise the county board on the thoughts and feelings of students 21 in Carroll County public schools; AND 22 (V) SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , VOTE 23 ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT A MATTE R THAT RELATES TO : 24 1. School closings, openings, and boundaries]. 1 (5) Unless invited to attend by an affirmative vote of a majority of the 2 county board, the student member may not attend an executive session that relates to any 3 matter for which the student member may not vote. 4 (6) On a majority vote of the elected members, the county board may 5 determine, on a case–by–case basis, whether a matter under consideration is covered by 6 the exclusionary provisions listed in paragraph (4) of this subsection. 7 (7) The State Board may remove the student member from the county 8 board in the same manner as an elected member. 9 (8) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE ELECTED 10 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 11 STUDENT MEMBER MAY V OTE. 12 3–5A–01. 13 (a) The Dorchester County Board consists of: 14 (1) Five voting members, elected in accordance with subsection (b) of this 15 section; and 16 (2) One [nonvoting] VOTING student member from each public high school 17 in the county. 18 (g) (1) Each student member shall: 19 (i) Be a twelfth grade student in the Dorchester County public 20 school system elected by the high school students of the public school that the student 21 attends, in accordance with procedures established by the school system; 22 (ii) Serve for 1 year beginning on July 1 after the election of the 23 member; 24 (iii) [Be] SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , BE 25 a [nonvoting] VOTING member; and 26 (iv) Advise the board on the interests of students. 27 (2) Unless invited to attend by an affirmative vote of a majority of the 28 county board, the student members may not attend an executive session RELATING TO A 29 MATTER ON WHICH THE STUDENT MEMBER S MAY NOT VOTE . 30 16 SENATE BILL 386 (3) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 1 STUDENT MEMBER S MAY VOTE ON ANY MATT ER BEFORE THE COUNTY BOARD 2 EXCEPT A MATTER THAT RELATES TO: 3 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 4 THIS ARTICLE. 5 (II) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE ELECTED 6 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 7 STUDENT MEMBER MAY V OTE. 8 3–601. 9 (a) (1) In this subtitle, “elected member” means a member of the county board 10 elected under subsection (b)(1) or (2) of this section or appointed to fill a vacancy under 11 subsection (e)(3) of this section. 12 (2) “Elected member” does not include the student member selected under 13 subsection (f) of this section. 14 (b) The Garrett County Board consists of: 15 (1) One elected member from each county commissioner district; 16 (2) Two elected members from the county at large; and 17 (3) One [nonvoting] student member. 18 (f) (1) Each May, the elected members of the county board shall select a 19 student member, and an alternate to serve in the event of a vacancy in the student 20 member’s position, from among candidates recommended by the Garrett County 21 Association of Student Councils. 22 (2) The term of the student member is 1 year and begins on July 1. 23 (3) To be considered for the position of student member, or as the alternate 24 for the student member’s position, a student shall: 25 (i) Be a sophomore or junior in high school at the time of applying; 26 (ii) Have attended Garrett County public schools for at least 2 years; 27 (iii) Be in good academic standing and have maintained a grade 28 average of at least 80% during the previous 2 academic years; and 29 18 SENATE BILL 386 (iv) Not have experienced significant attendance or disciplinary 1 problems during the student’s high school career. 2 (4) (i) The Garrett County Association of Student Councils shall 3 propose procedures governing the selection of candidates for the student member’s position. 4 (ii) The procedures proposed under this paragraph are subject to the 5 approval of the elected members of the board. 6 (iii) The procedures adopted under this paragraph shall provide for 7 the selection of up to four candidates, selected by the Garrett County Association of Student 8 Councils by secret ballot, for the position of student member. The names of the candidates 9 shall be forwarded to the elected members of the county board for final selection of the 10 student member and of an alternate. 11 (5) The student member: 12 (i) Shall attend all regular meetings of the county board; 13 (ii) May attend special public meetings of the county board; 14 (iii) Shall attend all meetings of the Garrett County Association of 15 Student Councils; and 16 (iv) Shall continue to meet all the requirements for selection to the 17 student member position. 18 (6) The student member may not attend executive sessions of the county 19 board RELATING TO A MATTER ON WHICH THE STUDENT MEMBER MAY NOT VOTE . 20 (7) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 21 STUDENT MEMBER MAY V OTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 22 A MATTER THAT RELATE S TO: 23 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 27 THIS ARTICLE. 28 (II) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE ELECTED 29 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 30 STUDENT MEMBER MA Y VOTE. 31 SENATE BILL 386 19 3–6A–01. 1 (a) (1) In this subtitle, “elected member” means a voting member elected under 2 subsection (d) or (e) of this section or a member appointed to an elected position on the 3 Harford County Board of Education under subsection (f)(1) of this section. 4 (2) “Elected member” does not include a: 5 (i) County superintendent of schools serving as an ex officio member 6 of the county board; or 7 (ii) Student member selected under subsection (g) of this section. 8 (b) The county board consists of: 9 (1) Six elected members; 10 (2) Three appointed members; 11 (3) The county superintendent of schools, who is an ex officio nonvoting 12 member; and 13 (4) One student member. 14 (g) (1) The student member of the county board shall be elected by the high 15 school students of the county in accordance with procedures established by the Harford 16 County public school system. 17 (2) The student member shall: 18 (i) Be an eleventh or twelfth grade student, in good standing, and 19 regularly enrolled in the Harford County public school system; 20 (ii) Be a student government association representative at the 21 student’s high school; 22 (iii) Serve for 1 year beginning on July 1 after the election of the 23 member; 24 (iv) Except as otherwise provided in paragraph (3) of this subsection, 25 be a voting member; and 26 (v) Advise the county board on the thoughts and feelings of students 27 in the Harford County public schools. 28 20 SENATE BILL 386 (3) (i) Except as otherwise provided in subparagraph (iii) of this 1 paragraph, the student member of the county board has the same rights and privileges as 2 a member appointed or elected under subsection (d) of this section. 3 (ii) Unless invited to attend by an affirmative vote of a majority of 4 the county board, the student member may not attend an executive session of the county 5 board addressing a matter on which a student member is prohibited from voting on under 6 subparagraph (iii) of this paragraph. 7 (iii) [The] SUBJECT TO SUBPARAGRA PH (IV) OF THIS 8 PARAGRAPH , THE student member shall vote on and participate in [all matters except 9 those relating] ANY MATTER BEFORE TH E COUNTY BOARD EXCEPT A MATTER THAT 10 RELATES to: 11 [1. Appointment and salary of a county superintendent under 21 §§ 4–201 and 4–202 of this article; 22 8. Employee discipline and other appeals under § 4–205(c) of 23 this article; 24 9. Budgetary matters under Title 5 of this article; 25 10. Appointment and promotion of staff under § 6–201 of this 26 article; 27 11. Discipline of certificated staff under § 6–202 of this article; 28 12. Collective bargaining for certificated employees under 29 Title 6, Subtitle 4 of this article; 30 13. Collective bargaining for noncertificated employees under 31 Title 6, Subtitle 5 of this article; 32 SENATE BILL 386 21 14. Student suspension and expulsion under § 7–305 of this 1 article; and 2 15. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 7 THIS ARTICLE. 8 (IV) ON AN AFFIRMATIVE VOTE O F A MAJORITY THE 9 NONSTUDENT MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON 10 WHICH THE STUDENT MEMBER MAY V OTE. 11 3–701. 12 (a) (1) The Howard County Board consists of: 13 (i) Seven elected members; and 14 (ii) One student member. 15 (f) (1) The student member shall be a bona fide resident of Howard County 16 and a regularly enrolled junior or senior year student from a Howard County public high 17 school. 18 (2) The student member shall serve for a term of 1 year beginning on July 19 1 after the member’s election, subject to confirmation of the election results by the county 20 board. 21 (3) The nomination and election process for the student member: 22 (i) Shall be approved by the Howard County Board of Education; 23 (ii) Shall include a provision that provides for the replacement of one 24 or both of the final candidates if one or both of them are unable, ineligible, or disqualified 25 to proceed in the election; and 26 (iii) Shall allow for any student in grades 6 through 11 enrolled in a 27 Howard County public school to vote directly for one of the two student member candidates. 28 22 SENATE BILL 386 (4) The student member candidate who receives the second highest 1 number of votes in the direct election: 2 (i) Shall become the alternate student member; and 3 (ii) Shall serve if the student member who is elected is unable, 4 ineligible, or disqualified to complete the student member’s term of office. 5 (5) Except as provided in paragraphs (6) [and], (7), AND (8) of this 6 subsection, the student member has the same rights and privileges as an elected member. 7 (6) Unless invited to attend by the affirmative vote of a majority of the 8 county board, the student member may not attend a closed session addressing a matter on 9 which a student member is prohibited from voting under paragraph (7) of this subsection. 10 (7) [The] SUBJECT TO PARAGRAPH (8) OF THIS SUBSECTION , THE 11 student member shall vote on [all matters except those relating] ANY MATTER BEFORE 12 THE COUNTY BOARD EXCEPT A MATTE R THAT RELATES to: 13 [(i) Geographical attendance areas under § 4–109 of this article; 14 (ii) Acquisition and disposition of real property and matters 15 pertaining to school construction under § 4–115 of this article; 16 (iii) Employment of architects under § 4–117 of this article; 17 (iv) Donations under § 4–118 of this article; 18 (v) Condemnation under § 4–119 of this article; 19 (vi) Consolidation of schools and transportation of students under § 20 4–120 of this article; 21 (vii) Appointment and salary of a county superintendent under §§ 22 4–201 and 4–202 of this article; 23 (viii) Employee discipline and other appeals under § 4–205(c) of this 24 article; 25 (ix) Budgetary matters under Title 5 of this article; 26 (x) Appointment and promotion of staff under § 6–201 of this article; 27 (xi) Discipline of certificated staff under § 6–202 of this article; 28 (xii) Collective bargaining for certificated employees under Title 6, 29 Subtitle 4 of this article; 30 SENATE BILL 386 23 (xiii) Collective bargaining for noncertificated employees under Title 1 6, Subtitle 5 of this article; and 2 (xiv) Student suspension and expulsion under § 7–305 of this article] 3 (I) THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 4 INVOLVING PERSONNEL ; 5 (II) HEARINGS HELD UN DER § 6–202 OF THIS ARTICLE; OR 6 (III) APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF THIS 7 ARTICLE. 8 (8) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE ELECTED 9 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 10 STUDENT MEMBER MAY V OTE. 11 (9) The student member may not receive compensation but, after 12 submitting expense vouchers, shall be reimbursed for out–of–pocket expenses incurred in 13 connection with official duties, in accordance with the procedures and regulations 14 established by the county board. 15 3–801. 16 (a) The Kent County Board consists of: 17 (1) Five voting members; and 18 (2) One [nonvoting] student member. 19 (d) (1) The student member shall: 20 (i) Be a bona fide resident of Kent County; 21 (ii) Be a regularly enrolled junior or senior at the Kent County public 22 high school elected by the high school students of the county in accordance with paragraph 23 (2) of this subsection; 24 (iii) Be a member of student government; 25 (iv) Serve for 1 year beginning on July 1 after the election of the 26 student member; [and] 27 (v) Advise the county board on the thoughts and feelings of students 28 in the Kent County public schools; AND 29 24 SENATE BILL 386 (VI) VOTE ON ALL MATTERS E XCEPT FOR A MATTER P ROHIBITED 1 UNDER PARAGRAPH (6) OF THIS SUBSECTION . 2 (2) (i) The process for applying and electing a student as a student 3 member shall be as set forth in this paragraph. 4 (ii) 1. An eligible student shall submit an application to the 5 county board on a form provided by the county board beginning on January 1 of each year. 6 2. Each applicant shall deliver a speech to the student body 7 of Kent County High School. 8 (iii) 1. Any high school student in the county may vote directly 9 for the student member candidates in an election held before May 1 each year. 10 2. The student member candidate that receives the highest 11 number of votes shall become the student member. 12 (iv) Notice of the results of the election for student member shall be 13 reported to the County Superintendent on or before May 1 each year. 14 (3) If the student member is unable, ineligible, or disqualified to complete 15 the student member’s term of the office, the county board shall appoint a qualified student 16 to serve for the remainder of the term. 17 (4) The student member shall attend: 18 (i) The Maryland Association of Boards of Education new student 19 board member orientation; and 20 (ii) All regular meetings of the county board. 21 (5) The student member may not attend an executive session of the county 22 board THAT RELATES TO A MA TTER ON WHICH THE STUDENT MEMBER MAY N OT 23 VOTE. 24 (6) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 25 STUDENT MEMBER MAY V OTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 26 A MATTER THAT RELATE S TO: 27 1. THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 28 INVOLVING PERSO NNEL; 29 2. HEARINGS HELD UNDER § 6–202 OF THIS ARTICLE; OR 30 SENATE BILL 386 25 3. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 1 THIS ARTICLE. 2 (II) ON AN AFFIRMATIVE VOTE O F A MAJORITY OF THE ELECTED 3 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 4 STUDENT MEMBER MAY VOTE . 5 3–901. 6 (a) (1) In this subtitle the following words have the meanings indicated. 7 (2) “Board of education district” means a geographic area of Montgomery 8 County in which an elected member of the Montgomery County Board of Education must 9 be a legal resident. The geographic area of each district is described in subsection (f) of this 10 section. Each district shall be substantially equal in population, and the districts shall be 11 reapportioned on the basis of each decennial census of the United States. 12 (3) “Elected member” means 1 of the 7 elected and voting members of the 13 Montgomery County Board or a member appointed to fill a vacancy of 1 of these 7 members. 14 (b) The Montgomery County Board consists of: 15 (1) 5 elected members, each of whom resides in a different board of 16 education district; 17 (2) 2 elected members who may reside anywhere in the county; and 18 (3) 1 student member. 19 (e) (1) The student member shall be a bona fide resident of Montgomery 20 County and a regularly enrolled junior or senior year student from a Montgomery County 21 public high school. 22 (2) The nomination and election process shall be as agreed on by the county 23 board and the Montgomery County region of the Maryland Association of Student Councils. 24 This agreement shall include a process by which to replace one or both of the final 25 candidates if they are unable to proceed in the election. Any student enrolled in a middle 26 or high school in the Montgomery County public schools may: 27 (i) Nominate a student member candidate; 28 (ii) Vote for delegates from the student’s school, who in turn vote in 29 a nominating convention to reduce to 2 the number of candidates for student member if 30 there are 3 or more candidates; and 31 26 SENATE BILL 386 (iii) Vote directly for 1 of the 2 remaining student member 1 candidates. 2 (3) The candidate receiving the second highest number of votes in the 3 direct election shall become the alternate student member. The alternate shall serve if the 4 student member is unable to complete his elected term. 5 (4) Except as provided in paragraphs (5), (6), and (7) of this subsection, the 6 student member has the same rights and privileges of an elected member. 7 (5) Unless invited to attend by the affirmative vote of a majority of the 8 county board, the student member may not attend an executive session that relates to 9 [hearings held under § 6–202(a) of this article] A MATTER ON WHICH TH E STUDENT 10 MEMBER MAY NOT VOTE . 11 (6) [As] EXCEPT AS provided in paragraph (7) of this subsection, the 12 student member shall vote on [all matters except those relating] ANY MATTER BEFORE 13 THE COUNTY BOARD EXC EPT A MATTER THAT RE LATES to [§ 6–202(a)]: 14 (I) THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 15 INVOLVING PERSONNEL ; 16 (II) HEARINGS HELD UNDER § 6–202 of this article; OR 17 (III) APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF THIS 18 ARTICLE. 19 (7) (I) On a majority vote of the elected members, the county board may 20 determine, on a case by case basis, whether a matter under consideration is covered by the 21 exclusionary provision in paragraph (6) of this subsection. 22 (II) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE 23 COUNTY BOARD MAY EXP AND THE MATTERS ON WHICH THE STUDENT MEMBER MAY 24 VOTE. 25 3–10A–01. 26 (a) The Queen Anne’s County Board consists of: 27 (1) Five [voting,] nonpartisan, elected members; and 28 (2) One [nonvoting] student [representative] MEMBER from each public 29 high school in the county. 30 SENATE BILL 386 27 (b) The five [voting,] nonpartisan, elected members shall be elected by the voters 1 of the entire county at a general election in accordance with subsection (c) of this section. 2 (c) (1) (i) One [voting] ELECTED member shall reside in and be elected 3 from each of the four county commissioner districts; and 4 (ii) One ELECTED member shall reside in the county and be elected 5 from the county at large. 6 (2) (i) [A] AN ELECTED member from a county commissioner district 7 who no longer resides in the district may not continue as a member of the county board. 8 (ii) [A] AN ELECTED member at large who no longer resides in the 9 county may not continue as a member of the county board. 10 (3) A candidate elected to the county board shall be a registered voter and 11 resident of Queen Anne’s County for at least 3 years. 12 (d) (1) Subject to paragraph (2) of this subsection, each elected [voting] 13 member serves for a term of 4 years beginning on the first Monday in December after the 14 member’s election and until a successor is elected and qualifies. 15 (2) The initial terms of the elected [voting] members are staggered as 16 follows: 17 (i) The three members elected to the county board at the general 18 election in November 2008 who receive the highest number of votes cast from among the 19 successful candidates at that election shall serve for a term of 6 years; and 20 (ii) The two members elected to the county board at the general 21 election in November 2008 who receive the least number of votes cast from among the 22 successful candidates at that election shall serve for a term of 4 years. 23 (3) (i) In case of a vacancy on the county board, the Governor shall 24 appoint a qualified person to serve on the county board until a successor is elected and 25 qualifies. 26 (ii) If the vacancy occurs before the filing deadline for candidates for 27 the primary election that is held in the second year of the term, the individual appointed 28 under subparagraph (i) of this paragraph shall serve until a successor is elected at the next 29 general election and qualifies. 30 (iii) If the vacancy occurs after the filing deadline for candidates for 31 the primary election that is held in the second year of the term, the individual appointed 32 under subparagraph (i) of this paragraph shall serve for the remainder of the term of the 33 vacating member and until a successor is elected at the next general election and qualifies. 34 28 SENATE BILL 386 (e) (1) The [nonvoting] student members of the county board shall be elected 1 from each of the public high schools in the county by their respective student bodies. 2 (2) Each student member shall: 3 (i) Be an eleventh or twelfth grade student in good standing in the 4 Queen Anne’s County public school system; 5 (ii) Be a student government association representative at the 6 student’s high school; 7 (iii) Serve for 1 year beginning on July 1 after the election of the 8 member; 9 (iv) [Be nonvoting] VOTE ON ANY MATTER BEFORE THE COUNTY 10 BOARD EXCEPT FOR A MATTER THAT RELATE S TO: 11 1. THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 12 INVOLVING PERSONNEL ; 13 2. HEARINGS HELD UNDER § 6–202 OF THIS ARTICLE; OR 14 3. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 15 THIS ARTICLE; and 16 (v) Advise the county board on the thoughts and feelings of students 17 in the Queen Anne’s County public schools. 18 (3) Unless invited to attend by an affirmative vote of a majority of the 19 county board, the student [member] MEMBERS may not attend an executive session of the 20 county board THAT RELATES TO A MA TTER ON WHICH THE STUDENT MEMBERS MAY 21 NOT VOTE. 22 (4) ON AN AFFIRMATIVE VOT E OF A MAJORITY OF T HE ELECTED 23 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 24 STUDENT MEMBERS MAY VOTE. 25 3–10A–04. 26 (a) The president of the county board is entitled to receive $4,000 annually as 27 compensation and the other [voting] ELECTED members each are entitled to receive $3,500 28 annually as compensation. 29 SENATE BILL 386 29 (b) The president of the county board and other ELECTED members each are 1 entitled to reimbursement not to exceed $1,000 a year for travel and other expenses. 2 (c) The Queen Anne’s County Commissioners may increase the annual salary of 3 the county board. 4 3–1101. 5 (a) The St. Mary’s Board consists of: 6 (1) Five [voting] ELECTED members; and 7 (2) One student member. 8 (b) The student member shall: 9 (1) Be an 11th or 12th grade student in the St. Mary’s County Public School 10 System; 11 (2) Serve for 1 year; 12 (3) [Be a nonvoting member] VOTE ON ANY MATTER BEFORE THE 13 COUNTY BOARD , EXCEPT FOR A MATTER PROHIBITED UNDER SUBSECTION (C)(2) OF 14 THIS SECTION; and 15 (4) Advise the county board on the thoughts and feelings of the students. 16 (c) (1) Unless invited to attend by an affirmative vote of a majority of the 17 county board, the student member may not attend an executive session of the county board 18 THAT RELATES TO A MA TTER ON WHICH THE ST UDENT MEMBER MAY NOT VOTE. 19 (2) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 20 STUDENT MEMBER MAY V OTE ON ANY MATTER BEFORE THE COUNTY BOARD EXCEPT 21 A MATTER THAT RELATES TO: 22 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 26 THIS ARTICLE. 27 30 SENATE BILL 386 (II) ON AN AFFIRMATIVE VOT E OF A MAJORITY OF T HE ELECTED 1 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 2 STUDENT MEMBER MAY V OTE. 3 (d) (1) (i) 1. A candidate elected to the county board shall be a resident 4 and registered voter of St. Mary’s County. 5 2. A member who is no longer a resident and a registered 6 voter of St. Mary’s County may not continue as a member of the county board. 7 (ii) A candidate who files to represent one of the commissioner 8 election districts must be a resident of that election district. 9 (iii) Candidates filing for office to represent the county at large may 10 reside anywhere in the county. 11 (2) An individual subject to the authority of the county board at the time 12 of filing is ineligible to be a candidate. 13 (e) (1) The St. Mary’s County Board consists of five [voting] members who 14 shall be elected as follows: 15 (i) One member shall be elected from the county at large; and 16 (ii) One member shall be elected from each of the four commissioner 17 districts. 18 (2) [Voting] ELECTED members of the county board shall be elected: 19 (i) At a general election as required by this section; and 20 (ii) On a general countywide ticket. 21 (3) Members of the county board elected in the 1996 general election from 22 Commissioner Districts One and Three shall serve for an initial term of 2 years. An election 23 shall be conducted in 1998 and every 4 years thereafter. 24 (4) Members of the county board elected in the 1996 general election from 25 Commissioner Election Districts Two and Four and from the county at large shall serve for 26 an initial term of 4 years. An election shall be conducted in 2000 and every 4 years 27 thereafter. 28 (5) Except as specified in this section, elections shall be conducted in 29 accordance with Title 8, Subtitle 8 of the Election Law Article. 30 SENATE BILL 386 31 (f) (1) The student member of the county board shall be elected by qualified 1 students of the St. Mary’s County Public School System. The student member shall not be 2 subject to approval by the county board. 3 (2) The [voting] ELECTED members of the county board shall: 4 (i) Determine which students in the St. Mary’s County Public 5 School System may elect the student member of the county board; and 6 (ii) Develop nomination and election procedures governing the 7 election of the student member. 8 3–12A–01. 9 (a) The Talbot County Board consists of: 10 (1) Seven [voting] ELECTED members, one member elected from each of 11 the seven election districts for the county board established in accordance with this subtitle; 12 and 13 (2) Two [nonvoting] student members from the public high schools in the 14 county. 15 (e) (1) Each [voting] ELECTED member serves for a term of 4 years beginning 16 on December 1 after the member’s election and until a successor is elected and qualifies. 17 (2) [A voting] AN ELECTED member may not serve for more than three 18 consecutive terms. 19 (f) The terms of the [voting] ELECTED members are staggered as follows: 20 (1) One member elected from each of districts 1, 3, 4, and 7 at the 2006 21 general election, and every 4 years thereafter; and 22 (2) One member elected from each of districts 2, 5, and 6 at the 2008 23 general election, and every 4 years thereafter. 24 3–12A–04. 25 (a) Subject to subsection (b) of this section, the [voting] ELECTED members shall 26 receive compensation as set by the County Council. 27 (b) (1) The salary of each [voting] ELECTED member of the county board shall 28 be at least $3,200. 29 (2) The salary of the president of the county board shall be at least $3,600. 30 32 SENATE BILL 386 3–12A–06. 1 (a) (1) There shall be two [nonvoting] student members on the Talbot County 2 Board of Education. 3 (2) The student members shall advise the other members of the county 4 board on the viewpoint of students who attend Talbot County public schools. 5 (b) (1) Each of the [nonvoting] student members of the county board shall be: 6 (i) A regularly enrolled 11th or 12th grade student in good standing 7 at a Talbot County public school; 8 (ii) Qualified according to eligibility requirements established by the 9 county board; and 10 (iii) Of good character. 11 (2) Each student member shall be appointed for a 1–year term during the 12 school year prior to the school year that the member is to serve on the county board. 13 (3) One student member shall be a student from St. Michaels High School 14 and one student member shall be a student from Easton High School. 15 (4) The county board shall adopt procedures for the appointment of the 16 student members. 17 (5) If a vacancy in the position of student member occurs during the term 18 of a student member, the county board shall appoint another student member to fill the 19 vacancy in accordance with its procedures. 20 (6) Unless invited to attend by an affirmative vote of a majority of the 21 county board, the student members may not attend an executive session of the county board 22 RELATING TO A MATTER ON WHICH THE STUDENT MEMBER S MAY NOT VOTE . 23 (7) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 24 STUDENT MEMBER S MAY VOTE ON ANY MATTER BEFORE THE COUNTY BOARD 25 EXCEPT A MATTER THAT RELATES TO: 26 1. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 1 THIS ARTICLE. 2 (II) ON AN AFFIRMATIVE VOT E OF A MAJORITY OF T HE ELECTED 3 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS ON WHICH THE 4 STUDENT MEMBER S MAY VOTE. 5 3–1401. 6 (a) The Worcester County Board consists of seven [voting] ELECTED members 7 and one [nonvoting] student member from each public high school in the county. 8 (b) (1) The seven [voting] ELECTED members of the Worcester County Board 9 shall be elected at a general election. 10 (2) Members of the Worcester County Board shall be elected in accordance 11 with Title 8, Subtitle 8 of the Election Law Article. 12 (d) Of the seven [voting] ELECTED members of the county board, one shall be 13 elected from each of the seven county commissioner districts. 14 (h) (1) Each student member shall: 15 (i) Be a 12th grade student in the Worcester County public school 16 system elected by the high school students of the public school which the student attends, 17 in accordance with procedures established by the school system; 18 (ii) Serve for 1 year beginning on July 1 after the election of the 19 member; 20 (iii) [Be] SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , BE 21 a [nonvoting] VOTING member; and 22 (iv) Advise the board on the interests of students. 23 (2) Unless invited to attend by an affirmative vote of a majority of the 24 county board, the student members may not attend an executive session RELATING TO A 25 MATTER ON WHICH THE STUDENT MEMBERS MAY NOT VOTE. 26 (3) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 27 STUDENT MEMBER S MAY VOTE ON ANY MATTER BEFORE THE COUNTY BOARD 28 EXCEPT A MATTER THAT RELATES TO: 29 1. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 7 as follows: 8 Article – Education 9 3–1002. 10 (a) In this subtitle, “elected member” means a member of the Prince George’s 11 County Board elected from one of the nine school board districts described in § 3–1001 of 12 this subtitle. 13 (b) The Prince George’s County Board consists of 10 members as follows: 14 (1) Nine elected members, each of whom resides in a different school board 15 district; and 16 (2) One student member selected under subsection (f)(2) of this section. 17 (f) (1) The student member shall be an eleventh or twelfth grade student in 18 the Prince George’s County public school system during the student’s term in office. 19 (3) (I) [The] SUBJECT TO SUBPARAGRA PH (II) OF THIS 20 PARAGRAPH , THE student member may vote on [all matters] ANY MATTER before the 21 COUNTY board except [those relating] A MATTER THAT RELATE S to: 22 [(i) Collective bargaining decisions; 23 (ii) Teacher and administrator disciplinary matters as provided 24 under § 6–202(a) of this article; and 25 (iii) Other personnel matters] 26 1. THE DISMISSAL OF OR O THER DISCIPLINARY AC TION 27 INVOLVING PERSONNEL ; 28 SENATE BILL 386 35 2. HEARINGS HELD UNDER § 6–202 OF THIS ARTICLE; OR 1 3. APPEALS TO THE COUNTY BOARD UNDER § 4–205 OF 2 THIS ARTICLE. 3 (II) ON AN AFFIRMATIVE VOT E OF A MAJORITY OF T HE ELECTED 4 MEMBERS, THE COUNTY BOARD MAY EXPAND THE MATTERS O N WHICH THE 5 STUDENT MEMBER MAY VOTE. 6 (4) On an affirmative vote of a majority of the elected members of the 7 county board, the board may determine if a matter before the board relates to a subject that 8 the student member may not vote on under paragraph (3) of this subsection. 9 (5) The student member may attend an executive session of the board 10 unless the executive session relates to[: 11 (i) Hearings on appeals of special education placements, hearings 12 held under § 6–202(a) of this article, or collective bargaining; or 13 (ii) A personnel matter for which the student may not vote under 14 paragraph (3) of this subsection] A MATTER ON WHICH TH E STUDENT MEMBER MAY NOT 15 VOTE. 16 SECTION 3. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall take 17 effect July 1, 2024, the effective date of Chapter 217 of the Acts of the General Assembly of 18 2022. If the effective date of Chapter 217 is amended, Section 2 of this Act shall take effect 19 on the taking effect of Chapter 217. 20 SECTION 4. AND BE IT FURTHER ENACTED, That, except as provide d in Section 21 3 of this Act, this Act shall take effect July 1, 2024. 22
