CHAPTER ______ AN ACT concerning 1 Community Development Administration – Live Near Your School Program – 2 Funding and Extension 3 FOR the purpose of requiring authorizing the Governor, for certain fiscal years, to include 4 in the annual budget bill an appropriation for the Live Near Your School program in 5 the Community Development Administration; extending the termination date for the 6 program Live Near Your School program and a related homebuyer program; and 7 generally relating to the Live Near Your School program. 8 BY repealing and reenacting, without amendments, 9 Article – Housing and Community Development 10 Section 4–101(a) and (b) and 4–217(a) and (b) 11 Annotated Code of Maryland 12 (2019 Replacement Volume and 2023 Supplement) 13 2 SENATE BILL 90 BY repealing and reenacting, with amendments, 1 Article – Housing and Community Development 2 Section 4–217(e) 3 Annotated Code of Maryland 4 (2019 Replacement Volume and 2023 Supplement) 5 BY repealing and reenacting, with amendments, 6 Chapter 247 of the Acts of the General Assembly of 2021 7 Section 2 8 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 9 That the Laws of Maryland read as follows: 10 Article – Housing and Community Development 11 4–101. 12 (a) In this title the following words have the meanings indicated. 13 (b) “Administration” means the Community Development Administration. 14 4–217. 15 (a) A project, undertaking, or a part of a project or undertaking, including the 16 real, personal, and mixed property involved, qualifies as a community development project 17 if it is planned, acquired, owned, developed, constructed, reconstructed, rehabilitated, 18 repaired, renovated, or improved to promote sound community development. 19 (b) A community development project shall provide for: 20 (1) new or existing housing: 21 (i) that is or will be occupied in substantial part by families of 22 limited income; or 23 (ii) at least 20% of which is or will be occupied by families of limited 24 income, if the project is financed with bonds, notes, or other evidences of indebtedness 25 issued by the Administration, the income from which being includable in the holder’s gross 26 income under the Internal Revenue Code as determined by the Administration at the time 27 of issue; 28 (2) any improvements, such as streets, roads, sewer lines, and water lines 29 that are needed to support the housing; and 30 (3) the public or private commercial, educational, cultural, recreational, 31 community, or civic facilities that are needed to support the housing. 32 SENATE BILL 90 3 (e) (1) (i) In this subsection the following words have the meanings 1 indicated. 2 (ii) “Current student” means an individual who: 3 1. attends a public institution of higher education in the 4 State; and 5 2. is a degree–seeking, full–time equivalent student in an 6 undergraduate level, graduate level, or professional degree program. 7 (iii) “Public institution of higher education” has the meaning stated 8 in § 10–101 of the Education Article. 9 (iv) “Recent graduate” means an individual who, within 5 years 10 before applying for assistance under this section, graduated from a public institution of 11 higher education in the State with at least: 12 1. 120 credits in an undergraduate level program; or 13 2. 30 credits in a graduate level or professional degree 14 program. 15 (2) The Administration may administer community development projects 16 that: 17 (i) are in sustainable communities approved under § 6–305 of this 18 article; and 19 (ii) provide current students and recent graduates with financial 20 assistance in the form of grants to buy homes near the school of the student or graduate. 21 (3) A community development project administered under this subsection 22 is not subject to the provisions of subsection (b)(1) of this section that require part of the 23 housing to be occupied by families of limited income. 24 (4) The community development projects administered under this 25 subsection shall be known as the Live Near Your School program. 26 (5) The Administration shall adopt regulations to implement the Live Near 27 Your School program established under this subsection. 28 (6) FOR FISCAL YEARS 2026 THROUGH 2030, EACH YEAR THE 29 GOVERNOR SHALL MAY INCLUDE IN THE ANNUA L BUDGET BILL AN APPROPRIAT ION 30 OF $200,000 FOR THE LIVE NEAR YOUR SCHOOL PROGRAM ESTABL ISHED UNDER 31 THIS SUBSECTION . 32 4 SENATE BILL 90 Chapter 247 of the Acts of 2021 1 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 2 October 1, 2021. It shall remain effective for a period of [3] 9 years and, at the end of 3 September 30, [2024] 2030, this Act, with no further action required by the General 4 Assembly, shall be abrogated and of no further force and effect. 5 SECTION 2.
