Natural Resources – Wildland Areas – Overhead Transmission Lines 2 
 
FOR the purpose of exempting certain areas in the Big Savage Mountain Wildland, Bear 3 
Pen Wildland, and Dan’s Mountain Wildland from being designated as a wildland 4 
area, subject to a certificate of public convenience and necessity being obtained for a 5 
certain transmission line; requiring the Public Service Commission to require an 6 
applicant for a certificate of public convenience and necessity for the construction of 7 
a certain overhead transmission line to provide wildland impact mitigation 8 
guarantees; and generally relating to wildland areas in the State. 9

Preamble 3 
 
 WHEREAS, As a result of an open, transparent, and comprehensive planning 4 
process, NextEra Energy Transmission MidAtlantic, Inc., through certain affiliates, has 5 
been designated by PJM Interconnection, LLC, the regional electric transmission 6 
organization for Maryland, to construct an overhead transmission line to address and 7 
resolve certain reliability issues impacting the electric transmission system serving the 8 
State’s and surrounding region’s electric customers; and 9 
 
 WHEREAS, Before beginning construction of an overhead transmission line, 10 
NextEra Energy Transmission MidAtlantic, Inc., must first obtain a certificate of public 11 
convenience and necessity, in accordance with the requirements in § 7–207 of the Public 12 
Utilities Article, to demonstrate that the transmission line is consistent with the public 13 
interest and public need and subject the proposed transmission line to a comprehensive 14 
review and input process involving the public, relevant local governments, and each 15 
appropriate State unit; and 16 
 
 WHEREAS, Before approving an application for a certificate of public convenience 17 
and necessity, the Public Service Commission must provide an opportunity for public 18 
comment and hold a public hearing on the application in each county and municipal 19 
corporation in which any portion of the construction of an overhead transmission line is 20 
proposed to be located; and 21 
 
 WHEREAS, The Public Service Commission may take final action on an application 22 
for a certificate of public convenience and necessity only after due consideration of, among 23 
other things:  24 
 
 (1) the recommendation of the governing body of each county or municipal 25 
corporation in which any portion of the construction of the overhead transmission line is 26 
proposed to be located; and 27 
 
 (2) the effect of the overhead transmission line on:  28 
 
 (i) the stability and reliability of the electric system;  29 
 
 (ii) economics;  30 
 
 (iii) aesthetics;  31 
 
 (iv) historic sites;  32 
 
 (v) aviation safety as determined by the Maryland Aviation 33 
Administration and the administrator of the Federal Aviation Administration; and  34

 (vi) when applicable, air quality and water pollution; now, therefore, 1 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL A SSEMBLY OF MARYLAND, 2 
That the Laws of Maryland read as follows: 3

 (a) (1) In order to assure that an increasing population, accompanied by 6 
expanding settlement and growing mechanization, does not occupy and modify all areas 7 
within the State, leaving no lands designated for preservation and protection in their 8 
natural condition, it is the policy of the General Assembly to secure for the people of present 9 
and future generations the benefits of an enduring resource of State wildlands. 10 
 
 (2) For this purpose there is established a State wildlands preservation 11 
system composed of areas in the State designated by the General Assembly as “wildland 12 
areas”. 13 
 
 (3) The wildland areas shall be administered for the use and enjoyment of 14 
the people of Maryland in a manner that will leave them unimpaired for the future use and 15 
enjoyment as wildlands, to provide for their protection, preservation of their wildland 16 
character, and for gathering and dissemination of information regarding their use and 17 
enjoyment as wildlands. 18 
 
 (4) A State land may not be designated as a wildland area except as 19 
provided for in this section or by a subsequent act. 20 
 
 (b) (1) [Pursuant to] IN ACCORDANCE WITH the provisions of subsection (a) 21 
of this section [that] AND EXCEPT AS PROVID ED IN PARAGRAPH (2) OF THIS 22 
SUBSECTION, THE property in Garrett County containing approximately 2,879 acres and 23 
described as follows is a Type 1 State wildland and shall be named the “Big Savage 24 
Mountain Wildland”: 25 
 
 Beginning at a point, said point being the intersection of the south side of High Rock 26 
Tower Road and a point located 200 feet west of the Big Savage Mountain Hiking Trail and 27 
running then in a generally southwest direction, 200 feet west of the Big Savage Mountain 28 
Hiking Trail to a point located at the waters of the Savage River Reservoir, then running 29 
generally in a northerly direction with the waters of the Savage River Reservoir, the Savage 30 
River and the existing Savage River State Forest boundary to a point of intersection of the 31 
Savage River and the southern margin of the right of way of Savage River Road and 32 
running then with the southern and eastern right of way of the Savage River Road to the 33 
Savage River State Forest boundary, then running along said boundary in an easterly 34 
direction to corner 533, then leaving the said Savage River State Forest boundary and 35 
running due east to a point on the eastern right of way of Westernport Road, then running 36 
along said right of way in an easterly and southern direction to a point of intersection with 37

line that lies 1,500 feet more or less north of Warnick Point and runs in a southeasterly 26 
direction to intersect the Savage River State Forest boundary; OR 27 
 
 (II) ANY NEXTERA ENERGY TRANSMISSION MIDATLANTIC, 28 
INC., TRANSMISSIO N LINE IF THE TRANSM ISSION LINE RUNS PAR ALLEL TO THE 29 
POTOMAC EDISON TRANSMISSION L INE AND A CERTIFICAT E OF PUBLIC 30 
CONVENIENCE AND NECE SSITY IS OBTAINED IN ACCORDANCE WITH § 7–207 OF THE 31

which by deed dated October 14, 1977, and recorded in Liber 382, Folio 467 of the land 38 
records of Garrett County, was conveyed by Robert and Marjorie Rogers to the State of 39 
Maryland, for the use of the Department of Natural Resources, and then running with the 40

described in a deed dated November 4, 1960, and recorded among the land records of 26 
Allegany County in Liber 329, Folio, 281 which was conveyed by Eva Cox et al. to the State 27 
of Maryland, to the use of the Game and Inland Fish Commission, said point also being on 28 
the southwesternmost right of way of Dan’s Rock Road and running then with said right of 29 
way in a southeasterly direction to a point of intersection with the aforementioned Dan’s 30 
Mountain Wildlife Management Area boundary, and then running with said boundary two 31 
courses on a southeasterly direction to a point, said point being located on said boundary 32 
and 282.00 feet more or less from the beginning of the sixty third line of the parcel of the 33

POTOMAC EDISON TRANSMISSION L INE TO INTERSECT WIT H THE DAN’S MOUNTAIN 30 
WILDLIFE MANAGEMENT AREA BOUNDARY AS IT E XISTED IN 2024 AT A POINT 500 31 
FEET MORE OR LESS SO UTH OF MIDDLE RIDGE ROAD, AND A CERTIFICATE OF 32 
PUBLIC CONVENIENCE A ND NECESSITY IS OBTA INED IN ACCORDANCE W ITH § 7–207 33 
OF THE PUBLIC UTILITIES ARTICLE. 34 
 
 (2) Notwithstanding any other provision of this subtitle, in the Dan’s 35 
Mountain Wildland area the Department may: 36 
 
 (i) Establish and maintain roads and trails to provide access for 37 
wildlife–dependent recreation; 38 
 
 (ii) Improve and manage habitat for early–succession wildlife; and 39

 (iii) Take all other actions necessary to manage the area in a way that 1 
fulfills the purposes of the 1966 Federal Aid in Fish and Wildlife Restoration Act grant from 2 
the Department of the Interior that partially funded acquisition of the area. 3

 (f) For the construction of an overhead transmission line, in addition to the 6 
considerations listed in subsection (e) of this section, the Commission shall: 7 
 
 (1) take final action on an application for a certificate of public convenience 8 
and necessity only after due consideration of: 9 
 
 (i) the need to meet existing and future demand for electric service; 10 
and 11 
 
 (ii) for construction related to a new overhead transmission line, the 12 
alternative routes that the applicant considered, including the estimated capital and 13 
operating costs of each alternative route and a statement of the reason why the alternative 14 
route was rejected; 15 
 
 (2) require as an ongoing condition of the certificate of public convenience 16 
and necessity that an applicant comply with: 17 
 
 (i) all relevant agreements with PJM Interconnection, L.L.C., or its 18 
successors, related to the ongoing operation and maintenance of the overhead transmission 19 
line; and 20 
 
 (ii) all obligations imposed by the North America Electric Reliability 21 
Council and the Federal Energy Regulatory Commission related to the ongoing operation 22 
and maintenance of the overhead transmission line; [and] 23 
 
 (3) require the applicant to identify whether the overhead transmission 24 
line is proposed to be constructed on: 25 
 
 (i) an existing brownfields site; 26 
 
 (ii) property that is subject to an existing easement; or 27 
 
 (iii) a site where a tower structure or components of a tower structure 28 
used to support an overhead transmission line exist; AND 29 
 
 (4) FOR THE CONSTRUCTION OF AN OVERHEAD TRANS MISSION LINE 30 
IN AN AREA SPECIFIED IN § 5–1203(B)(2)(II), (Y)(2), OR (KK)(1)(II) OF THE NATURAL 31 
RESOURCES ARTICLE, REQUIRE THAT AN APPL ICANT PROVIDE WILDLA ND IMPACT 32   	HOUSE BILL 1270 	11 
 
 
MITIGATION GUARANTEE S, INCLUDING WORKING WI TH THE DEPARTMENT OF 1 
NATURAL RESOURCES TO ADD ADDI TIONAL WILDLAND ACRE AGE.  2 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the General 3 
Assembly that nothing in this Act shall be construed as a recommendation that a proposed 4 
NextEra Energy Transmission MidAtlantic, Inc., transmission line be issued a certificate 5 
of public convenience and necessity from the Public Service Commission. 6 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That: 7 
 
 (a) This Act shall be abrogated and of no further force and effect if the Public 8 
Service Commission: 9 
 
 (1) approves a certificate of public convenience and necessity, in accordance 10 
with § 7–207 of the Public Utilities Article, for an alternative NextEra Energy 11 
Transmission MidAtlantic, Inc., transmission line that is part of the Mid–Atlantic 12 
Resiliency Link project that does not pass through the Big Savage Mountain Wildland, the 13 
Bear Pen Wildland, or the Dan’s Mountain Wildland; or 14 
 
 (2) denies a certificate of public convenience and necessity for a NextEra 15 
Energy Transmission MidAtlantic, Inc., transmission line that is part of the Mid–Atlantic 16 
Resiliency Link project. 17 
 
 (b) The Commission shall notify the Department of Legislative Services within 5 18 
days after a determination under subsection (a) of this section has been made.  19 
 
 SECTION 3. 4. AND BE IT FURTHER ENACTED, That this Act shall take effect 20 
October 1, 2025. 21
