BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 24 That Section(s) 9–233(d) and (e) of Article – Human Services of the Annotated Code of 25 Maryland be renumbered to be Section(s) 9–233(e) and (f), respectively. 26 2 HOUSE BILL 1429 SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 1 as follows: 2 Article – Human Services 3 9–233. 4 (a) (1) In this section[, “youth] THE FOLLOWING WORDS HAVE THE 5 MEANINGS INDICATED . 6 (2) “CRIMINAL REPOSITORY” MEANS THE CRIMINAL JUSTICE 7 INFORMATION SYSTEM CENTRAL REPOSITORY OF THE DEPARTMENT OF PUBLIC 8 SAFETY AND CORRECTIONAL SERVICES. 9 (3) “YOUTH services bureau” means a community–based entity that is 10 operated: 11 [(1)] (I) to provide community–oriented delinquency prevention, youth 12 suicide prevention, drug and alcohol abuse prevention, and youth development; 13 [(2)] (II) to ameliorate conditions that contribute to delinquency, youth 14 suicide, drug and alcohol abuse, and family disruption; and 15 [(3)] (III) to function as an advocate of youth needs. 16 (D) (1) A YOUTH SERVICES BUREA U MAY APPLY TO THE CENTRAL 17 REPOSITORY FOR A STATE AND NATIONAL CRIMINAL HISTORY REC ORDS CHECK 18 FOR AN EMPLOYEE , A VOLUNTEER , OR AN INTERN OF THE BUREAU . 19 (2) AS PART OF THE APPLICATION FOR A CR IMINAL HISTORY 20 RECORDS CHECK , THE BUREAU SHALL SUB MIT TO THE CENTRAL REPOSITORY: 21 (I) A COMPLETE SET OF LEGIBLE FINGERPRINTS TAKEN IN A 22 FORMAT APPROVED BY T HE DIRECTOR OF THE FEDERAL BUREAU OF 23 INVESTIGATION ; 24 (II) THE MANDATORY PROCES SING FEE REQUIRED BY THE 25 FEDERAL BUREAU OF INVESTIGATION FOR A F EDERAL CRIMINAL HIST ORY 26 RECORDS CHECK ; AND 27 (III) THE FEE AUTHORIZED UNDER § 10–221(B)(7) OF THE 28 CRIMINAL PROCEDURE ARTICLE FOR ACCESS TO MARYLAND CRIMINAL HIS TORY 29 RECORDS. 30 HOUSE BILL 1429 3 (3) IN ACCORDANCE WITH §§ 10–201 THROUGH 10–229 OF THE 1 CRIMINAL PROCEDURE ARTICLE, THE CENTRAL REPOSITORY SHALL FORW ARD TO 2 THE BUREAU AND THE INDIVIDUAL TH E INDIVIDUAL’S CRIMINAL HISTORY R ECORD 3 INFORMATION . 4 (4) INFORMATION OBTAINED FROM THE CENTRAL REPOSITORY 5 UNDER THIS SECTION : 6 (I) IS CONFIDENTIAL ; 7 (II) MAY NOT BE REDISSEMI NATED; AND 8 (III) SHALL BE USED O NLY FOR THE EMPLOYMENT AND 9 VOLUNTEERING PURPOSES AUTHORIZED BY THIS S ECTION. 10 (5) THE SUBJECT OF A CRIM INAL HISTORY RECORDS CHECK UNDER 11 THIS SECTION MAY CON TEST THE CONTENTS OF THE CRIMINAL HISTORY RECORD 12 INFORMATION ISSUED B Y THE CENTRAL REPOSITORY AS PROVIDE D IN § 10–223 OF 13 THE CRIMINAL PROCEDURE ARTICLE. 14 (6) IF CRIMINAL HISTORY R ECORD INFORMATION IS REPORTED TO 15 THE CENTRAL REPOSITORY AFTER THE DATE OF THE INITIAL CRIMINAL HISTORY 16 RECORDS CHECK , THE CENTRAL REPOSITORY SHALL PROV IDE TO THE BUREAU AN D 17 THE INDIVIDUAL REVISED CRIMINAL HIS TORY RECORD INFORMAT ION. 18 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 19 October 1, 2025. 20
