Youth Services Bureaus – Criminal History Records Checks – Employees, 2 
Volunteers, and Interns 3 
 
FOR the purpose of authorizing youth services bureaus to request a criminal history 4 
records check from the Criminal Justice Information System Central Repository for 5 
employees, volunteers, and interns; and generally relating to criminal history 6 
records checks by a youth services bureau. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2 
That Section(s) 9–233(d) and (e) of Article – Human Services of the Annotated Code of 3 
Maryland be renumbered to be Section(s) 9–233(e) and (f), respectively. 4 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 5 
as follows: 6

9–233. 8 
 
 (a) (1) In this section[, “youth] THE FOLLOWING WORDS HAVE THE 9 
MEANINGS INDICATED . 10 
 
 (2) “CRIMINAL REPOSITORY” MEANS THE CRIMINAL JUSTICE 11 
INFORMATION SYSTEM CENTRAL REPOSITORY OF THE DEPARTMENT OF PUBLIC 12 
SAFETY AND CORRECTIONAL SERVICES. 13 
 
 (3) “YOUTH services bureau” means a community–based entity that is 14 
operated: 15 
 
 [(1)] (I) to provide community–oriented delinquency prevention, youth 16 
suicide prevention, drug and alcohol abuse prevention, and youth development; 17 
 
 [(2)] (II) to ameliorate conditions that contribute to delinquency, youth 18 
suicide, drug and alcohol abuse, and family disruption; and 19 
 
 [(3)] (III) to function as an advocate of youth needs. 20 
 
 (D) (1) A YOUTH SERVICES BUREA U MAY APPLY TO THE CENTRAL 21 
REPOSITORY FOR A STATE AND NATIONAL CRIMINAL HISTORY REC ORDS CHECK 22 
FOR AN EMPLOYEE , A VOLUNTEER , OR AN INTERN OF THE BUREAU . 23 
 
 (2) AS PART OF THE APPLICATION FOR A CR IMINAL HISTORY 24 
RECORDS CHECK , THE BUREAU SHALL SUB MIT TO THE CENTRAL REPOSITORY: 25 
 
 (I) A COMPLETE SET OF LEGIBLE FINGERPRINTS TAKEN IN A 26 
FORMAT APPROVED BY T HE DIRECTOR OF THE FEDERAL BUREAU OF 27 
INVESTIGATION ; 28 
 
 (II) THE MANDATORY PROCES SING FEE REQUIRED BY THE 29 
FEDERAL BUREAU OF INVESTIGATION FOR A F EDERAL CRIMINAL HIST ORY 30 
RECORDS CHECK ; AND 31   	HOUSE BILL 1429 	3 
 
 
 
 (III) THE FEE AUTHORIZED U NDER § 10–221(B)(7) OF THE 1 
CRIMINAL PROCEDURE ARTICLE FOR ACCESS TO MARYLAND CRIMINAL HIS TORY 2 
RECORDS. 3 
 
 (3) IN ACCORDANCE WITH §§ 10–201 THROUGH 10–229 OF THE 4 
CRIMINAL PROCEDURE ARTICLE, THE CENTRAL REPOSITORY SHALL FORW ARD TO 5 
THE BUREAU AND THE INDIVIDUAL T HE INDIVIDUAL’S CRIMINAL HISTORY R ECORD 6 
INFORMATION . 7 
 
 (4) INFORMATION OBTAINED FROM THE CENTRAL REPOSITORY 8 
UNDER THIS SECTION : 9 
 
 (I) IS CONFIDENTIAL ; 10 
 
 (II) MAY NOT BE REDISSEMI NATED; AND 11 
 
 (III) SHALL BE USED O NLY FOR THE EMPLOYMENT AND 12 
VOLUNTEERING PURPOSES AUTHORIZED BY THIS S ECTION. 13 
 
 (5) THE SUBJECT OF A CRIM INAL HISTORY RECORDS CHECK UNDER 14 
THIS SECTION MAY CON TEST THE CONTENTS OF THE CRIMINAL HISTORY RECORD 15 
INFORMATION ISSUED B Y THE CENTRAL REPOSITORY AS PR OVIDED IN § 10–223 OF 16 
THE CRIMINAL PROCEDURE ARTICLE. 17 
 
 (6) IF CRIMINAL HISTORY R ECORD INFORMATION IS REPORTED TO 18 
THE CENTRAL REPOSITORY AFTER THE DATE OF THE INITIAL CRIMINAL HISTORY 19 
RECORDS CHECK , THE CENTRAL REPOSITORY SHALL PROV IDE TO THE BUREAU AN D 20 
THE INDIVIDUAL REVISED CRIMINAL HIS TORY RECORD INFORMAT ION. 21 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 22 
October 1, 2025. 23
