11 HOUSE BILL NO. 5586 A bill to amend 1978 PA 472, entitled "An act to regulate political activity; to regulate lobbyists, lobbyist agents, and lobbying activities; to require registration of lobbyists and lobbyist agents; to require the filing of reports; to prescribe the powers and duties of the department of state; to prescribe penalties; and to repeal certain acts and parts of acts," by amending section 6a (MCL 4.416a), as added by 1994 PA 383, and by adding section 6b. the people of the state of michigan enact: Sec. 6a. (1) A member of the Michigan senate or house of representatives who resigns from office shall not make expenditures for, or receive compensation for, or receive reimbursement for of actual expenses for lobbying for the remainder of the term of office from which the person individual resigned. (2) Except as otherwise provided under subsection (3), for 1 year after the date the term of office ends, a former member of the Michigan senate or house of representatives shall not make expenditures for, receive compensation for, or receive reimbursement of actual expenses for lobbying that equal or exceed the limit established to require registration as a lobbyist agent. (3) Subsection (2) does not apply if the individual described under that subsection makes expenditures for, receives compensation for, or receives reimbursement for actual expenses for lobbying on behalf of this state or for the office of an individual described under section 6b(1) within the time period described under subsection (2). (4) (2) A person An individual who violates this section is guilty of a misdemeanor punishable by a fine of not more than $1,000.00 or by imprisonment for not more than 90 days or a fine of not more than $10,000.00, or both. Sec. 6b. (1) Except as otherwise provided in subsection (2), for 1 year after the date the term of office ends, an individual who was, at any time, any of the following in this state shall not make expenditures for, receive compensation for, or receive reimbursement of actual expenses for lobbying that equal or exceed the limit established to require registration as a lobbyist agent: (a) The governor. (b) The lieutenant governor. (c) The attorney general. (d) The secretary of state. (2) Subsection (1) does not apply if the individual described under that subsection makes expenditures for, receives compensation for, or receives reimbursement for actual expenses for lobbying on behalf of this state or for the office of an individual described under subsection (1) within the time period described under subsection (1). (3) An individual who violates subsection (1) is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $10,000.00, or both.
