1.19Section 1. CAPITAL IMPROVEMENT APPROPRIATIONS.​
1.20 (a) The sums shown in the column under "Appropriations" are appropriated from the​
1.21bond proceeds fund, or another named fund, to the state agencies or officials indicated, to​
1.22be spent for public purposes. Appropriations of bond proceeds must be spent as authorized​
1.23by the Minnesota Constitution, article XI, section 5, clause (a), to acquire and better public​
1.24land and buildings and other public improvements of a capital nature, or as authorized by​
1.25the Minnesota Constitution, article XI, section 5, clauses (b) to (j), or article XIV. Unless​

6.15Subd. 16.Debt Service​
6.16(a) Except as provided in paragraph (b), the​
6.17Board of Trustees shall pay the debt service​
6.18on one-third of the principal amount of state​
6.19bonds sold to finance projects authorized by​
6.20this section. After each sale of general​
6.21obligation bonds, the commissioner of​
6.22management and budget shall notify the board​
6.23of the amounts assessed for each year for the​
6.24life of the bonds.​
6.25(b) The board need not pay debt service on​
6.26bonds sold to finance HEAPR. Where a​
6.27nonstate match is required, the debt service is​
6.28due on a principal amount equal to one-third​
6.29of the total project cost, less the match​
6.30committed before the bonds are sold.​
6.31(c) The commissioner of management and​
6.32budget shall reduce the board's assessment​
6.33each year by one-third of the net income from​
6.34investment of general obligation bond​
6​Article 1 Sec. 3.​

7.2principal and interest otherwise required to be​
7.3paid by the board. The board shall pay its​
7.4resulting net assessment to the commissioner​
7.5of management and budget by December 1​
7.6each year. If the board fails to make a payment​
7.7when due, the commissioner of management​
7.8and budget shall reduce allotments for​
7.9appropriations from the general fund otherwise​
7.10available to the board and apply the amount​
7.11of the reduction to cover the missed debt​
7.12service payment. The commissioner of​
7.13management and budget shall credit the​
7.14payments received from the board to the bond​
7.15debt service account in the state bond fund​
7.16each December 1 before money is transferred​
7.17from the general fund under Minnesota​
7.18Statutes, section 16A.641, subdivision 10.​
7.19Subd. 17.Unspent Appropriations​
7.20(a) Upon substantial completion of a project​
7.21authorized in this section and after written​

11.27construct, and equip flood mitigation​
11.28infrastructure. This appropriation includes​
11.29money for Phase 2 of the North Moorhead​
11.30levee project, the relocation of sanitary lift​
11.31station #2, and a levee project along First​
11.32Avenue North.​
11.33(e) To the extent practicable and consistent​
11.34with the project, recipients of appropriations​
11​Article 1 Sec. 7.​

37.2 The amounts of the general obligation bond proceeds appropriations listed in the​
37.3cancellation report submitted to the legislature in January 2023, pursuant to Minnesota​
37.4Statutes, section 16A.642, are canceled on the effective date of this section, with the exception​
37.5of appropriations and related bond sale authorizations that are extended in article 2. The​
37.6corresponding bond sale authorizations are reduced by the same amounts.​
37.7 Sec. 29. BOND SALE SCHEDULE.​
37.8 The commissioner of management and budget shall schedule the sale of state general​
37.9obligation bonds so that, during the biennium ending June 30, 2025, no more than​
37.10$1,188,684,000 will need to be transferred from the general fund to the state bond fund to​
37.11pay principal and interest due and to become due on outstanding state general obligation​
37.12bonds. During the biennium, before each sale of state general obligation bonds, the​
37.13commissioner of management and budget shall calculate the amount of debt service payments​
37.14needed on bonds previously issued and shall estimate the amount of debt service payments​
37.15that will be needed on the bonds scheduled to be sold. The commissioner shall adjust the​
37.16amount of bonds scheduled to be sold so as to remain within the limit set by this section.​
37.17The amount needed to make the debt service payments is appropriated from the general​
37.18fund as provided in Minnesota Statutes, section 16A.641.​
37.19Sec. 30. EFFECTIVE DATE.​
37.20 This article is effective the day following final enactment.​

37.22	MISCELLANEOUS​
37.23Section 1. Minnesota Statutes 2022, section 16A.966, subdivision 2, is amended to read:​
37.24 Subd. 2.Authorization to issue appropriation bonds.(a) Subject to the limitations of​
37.25this subdivision, the commissioner may sell and issue appropriation bonds of the state under​
37.26this section for public purposes as provided by law, including for the purposes of financing​
37.27the cost of implementing removal or remedial actions permitted under section 115B.17 and​
37.28further subject to the conditions in chapter 115B to address risks to human health and the​
37.29environment at contaminated sites. Appropriation bonds may be sold and issued in amounts​
37.30that, in the opinion of the commissioner, are necessary to provide sufficient money to the​
37.31commissioner of the Pollution Control Agency under subdivision 7, not to exceed​
37.32$30,400,000 net of costs of issuance, for the purposes as provided under this subdivision,​
37​Article 2 Section 1.​

38.2enhancement, or make payments under other agreements entered into under paragraph (d).​
38.3Notwithstanding section 115B.17, subdivision 6 or 16, any money recovered in a civil action​
38.4or any money received from the disposition of property acquired for a response action and​
38.5financed with bonds under this section shall be transferred to the commissioner and applied​
38.6toward principal and interest on outstanding bonds.​
38.7 (b) Proceeds of the appropriation bonds must be credited to a special appropriation state​
38.8response to releases bond proceeds fund in the state treasury. All income from investment​
38.9of the bond proceeds, as estimated by the commissioner, is appropriated to the commissioner​
38.10for the payment of principal and interest on the appropriation bonds.​
38.11 (c) Appropriation bonds may be issued in one or more issues or series on the terms and​
38.12conditions the commissioner determines to be in the best interests of the state, but the term​
38.13on any series of appropriation bonds may not exceed 21 years. The appropriation bonds of​
38.14each issue and series thereof shall be dated and bear interest, and may be includable in or​
38.15excludable from the gross income of the owners for federal income tax purposes.​
38.16 (d) At the time of, or in anticipation of, issuing the appropriation bonds, and at any time​
38.17thereafter, so long as the appropriation bonds are outstanding, the commissioner may enter​
38.18into agreements and ancillary arrangements relating to the appropriation bonds, including​
38.19but not limited to trust indentures, grant agreements, lease or use agreements, operating​
38.20agreements, management agreements, liquidity facilities, remarketing or dealer agreements,​
38.21letter of credit agreements, insurance policies, guaranty agreements, reimbursement​
38.22agreements, indexing agreements, or interest exchange agreements. Any payments made​
38.23or received according to the agreement or ancillary arrangement shall be made from or​
38.24deposited as provided in the agreement or ancillary arrangement. The determination of the​
38.25commissioner included in an interest exchange agreement that the agreement relates to an​
38.26appropriation bond shall be conclusive.​
38.27 (e) The commissioner may enter into written agreements or contracts relating to the​
38.28continuing disclosure of information necessary to comply with or facilitate the issuance of​
38.29appropriation bonds in accordance with federal securities laws, rules, and regulations,​
38.30including Securities and Exchange Commission rules and regulations in Code of Federal​
38.31Regulations, title 17, section 240.15c 2-12. An agreement may be in the form of covenants​
38.32with purchasers and holders of appropriation bonds set forth in the order or resolution​
38.33authorizing the issuance of the appropriation bonds, or a separate document authorized by​
38.34the order or resolution.​

39.7the bond proceeds fund. Money in the accounts is appropriated to the commissioner to make​
39.8grants under this section. Money in the greater Minnesota child care facility capital grant​
39.9accounts is available until encumbered or spent subject to section 16A.642.​
39.10Sec. 3. [116J.4315] GREATER MINNESOTA HOUSING INFRASTRUCTURE​
39.11GRANT PROGRAM.​
39.12 Subdivision 1.Grant program established.The commissioner may make grants to​
39.13counties and cities to provide up to 50 percent of the capital costs of public infrastructure​
39.14necessary for an eligible workforce housing development project. The commissioner may​
39.15make a grant award only after determining that nonstate resources are committed to complete​
39.16the project. The nonstate contribution may be either cash or in kind. In-kind contributions​
39.17may include the value of the site.​
39.18 Subd. 2.Definitions.(a) For purposes of this section, the following terms have the​
39.19meanings given.​
39.20 (b) "City" means a statutory or home rule charter city located outside the metropolitan​
39.21area, as defined in section 473.121, subdivision 2.​
39.22 (c) "County" means a county located outside the metropolitan area, as defined in section​
39.23473.121, subdivision 2.​
39.24 (d) "Public infrastructure" means publicly owned physical infrastructure necessary to​
39.25support housing development projects, including but not limited to sewers, water supply​
39.26systems, utility extensions, streets, wastewater treatment systems, storm water management​
39.27systems, and facilities for pretreatment of wastewater to remove phosphorus.​
39.28 Subd. 3.Eligible projects.Public infrastructure eligible for a grant under this section​
39.29may be single-family or multifamily housing developments, owner-occupied or rental.​
39.30 Subd. 4.Application.(a) The commissioner must develop forms and procedures for​
39.31soliciting and reviewing applications for grants under this section. At a minimum, a county​

40.2that the required nonstate match is available. The commissioner must evaluate complete​
40.3applications for funding for eligible projects to determine that:​
40.4 (1) the project is necessary to increase sites available for housing development that will​
40.5provide adequate housing stock for the current or future workforce; and​
40.6 (2) the increase in workforce housing will result in substantial public and private capital​
40.7investment in the county or city in which the project would be located.​
40.8 (b) The determination of whether to make a grant for a site is within the discretion of​
40.9the commissioner, subject to this section. The commissioner's decisions and application of​
40.10the criteria are not subject to judicial review, except for abuse of discretion.​
40.11 Subd. 5.Maximum grant amount.A county or city may receive no more than $20,000​
40.12per lot for single-family, duplex, triplex, or four-plex housing developed, and no more than​
40.13$50,000 per lot for multifamily housing with more than four units per building. A county​
40.14or city may receive no more than $500,000 in two years for one or more housing​
40.15developments.​
40.16Sec. 4. Minnesota Statutes 2022, section 134.45, subdivision 5, is amended to read:​
40.17 Subd. 5.Qualification; accessibility grants.A public library jurisdiction may apply​
40.18for a grant in an amount up to $300,000 $450,000 or 50 percent of the approved costs of​
40.19removing architectural barriers from a building or site, whichever is less. Grants may be​
40.20made only for projects in existing buildings used as a library, or to prepare another existing​
40.21building for use as a library. Renovation of an existing building may include an addition to​
40.22the building if the additional space is necessary to provide accessibility or if relocating​
40.23public spaces to the ground level provides improved overall accessibility. Grants must not​
40.24be used to pay part of the cost of meeting accessibility requirements in a new building.​
40.25Sec. 5. Minnesota Statutes 2022, section 174.38, subdivision 1, is amended to read:​
40.26 Subdivision 1.Definitions.(a) For purposes of this section, the following terms have​
40.27the meanings given them.​
40.28 (b) "Active transportation" means bicycling, pedestrian activities, and other forms of​
40.29nonmotorized transportation.​
40.30 (c) "Bond-eligible costs" means expenditures under subdivision 6, clause (1), for publicly​
40.31owned infrastructure in this state with a useful life of at least ten years.​
40​Article 2 Sec. 5.​

41.2 Sec. 6. Minnesota Statutes 2022, section 174.38, subdivision 3, is amended to read:​
41.3 Subd. 3.Active transportation account.(a) An active transportation account is​
41.4established in the special revenue fund. The account consists of funds provided by law and​
41.5any other money donated, allotted, transferred, or otherwise provided to the account. Money​
41.6in the account must be expended only on a project that receives financial assistance under​
41.7this section.​
41.8 (b) An active transportation account is established in the bond proceeds fund. The account​
41.9consists of state bond proceeds appropriated to the commissioner. Money in the account​
41.10may only be expended on bond-eligible costs of a project receiving financial assistance as​
41.11provided under this section. Money in the account may only be expended on a project that​
41.12is publicly owned.​
41.13 (c) An active transportation account is established in the general fund. The account​
41.14consists of money as provided by law and any other money donated, allotted, transferred,​
41.15or otherwise provided to the account. Money in the account may only be expended on a​
41.16project receiving financial assistance as provided under this section.​
41.17Sec. 7. [446A.077] LEAD SERVICE LINE REPLACEMENT GRANT PROGRAM.​
41.18 Subdivision 1.Establishment.The authority must establish a program to provide grants​
41.19to eligible recipients for lead service line replacement, subject to the limitations in this​
41.20section.​
41.21 Subd. 2.Eligible recipients.(a) The following are eligible recipients of funds in the​
41.22program:​
41.23 (1) community public water suppliers of a community water system as defined in Code​
41.24of Federal Regulations, title 40, section 141.2, as amended;​
41.25 (2) municipalities;​
41.26 (3) suppliers of other residential drinking water systems; and​
41.27 (4) any applicant eligible for loans and grants under the federal Safe Drinking Water​
41.28Act.​
41.29 (b) An eligible recipient of a grant provided under this program funded with money​
41.30appropriated from the bond proceeds fund must be a political subdivision of the state.​
41​Article 2 Sec. 7.​

42.6 (b) A grant provided under this program funded with money appropriated from the bond​
42.7proceeds fund must only be used for publicly owned property.​

42.9At least 70 percent of the funds made available under a grant must be used for the purposes​
42.10of removing privately owned portions of lead drinking water service lines or installing​
42.11privately owned portions of drinking water service lines.​
42.12 (b) A grant under the program funded with money appropriated from the bond proceeds​
42.13fund is not subject to the limitations under paragraph (a).​
42.14 Subd. 5.Grant priorities.In prioritizing the expenditure of grant money received under​
42.15this section, the authority must give priority to applications that utilize the funds as part of​
42.16a plan to remove all lead service lines within a municipality or residential drinking water​
42.17system.​
42.18 Subd. 6.Report.By March 30, 2024, the authority shall submit a report on this grant​
42.19program to the chairs and ranking minority members of the legislative committees with​
42.20jurisdiction over capital investment, health, and environment. The report must include, at​
42.21a minimum, details about awards made, applications submitted, and lead service lines​
