6 | 6 | | 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

7 | 7 | | 1.7 Section 1. Minnesota Statutes 2024, section 126C.05, subdivision 8, is amended to read: |

8 | 8 | | 1.8 Subd. 8.Average daily membership.(a) Membership for pupils in grades kindergarten |
---|
9 | 9 | | 1.9through 12 and for prekindergarten pupils with disabilities shall mean the number of pupils |
---|
10 | 10 | | 1.10on the current roll of the school, counted from the date of entry until withdrawal. The date |
---|
11 | 11 | | 1.11of withdrawal shall mean the day the pupil permanently leaves the school or the date it is |
---|
12 | 12 | | 1.12officially known that the pupil has left or has been legally excused. However, a pupil, |
---|
13 | 13 | | 1.13regardless of age, who has been absent from school for 15 consecutive school days during |
---|
14 | 14 | | 1.14the regular school year or for five consecutive school days during summer school or |

15 | 15 | | 1.15intersession classes of flexible school year programs without receiving instruction in the |

16 | 16 | | 1.16home or hospital shall be dropped from the roll and classified as withdrawn. Nothing in this |
---|
17 | 17 | | 1.17section shall be construed as waiving the compulsory attendance provisions cited in section |
---|
18 | 18 | | 1.18120A.22. Average daily membership equals the sum for all pupils of the number of days |
---|
19 | 19 | | 1.19of the school year each pupil is enrolled in the district's schools divided by the number of |
---|
20 | 20 | | 1.20days the schools are in session or are providing e-learning days due to inclement weather. |
---|
21 | 21 | | 1.21Days of summer school or intersession classes of flexible school year programs are only |
---|
22 | 22 | | 1.22included in the computation of membership for pupils with a disability not appropriately |

45 | 45 | | 2.12 Sec. 2. Minnesota Statutes 2024, section 126C.05, is amended by adding a subdivision to |

47 | 47 | | 2.14 Subd. 21.Department of Education to encourage reenrollment.Notwithstanding any |
---|
48 | 48 | | 2.15law to the contrary, once a school district has notified the Department of Education that a |
---|
49 | 49 | | 2.16child has been removed from the attendance roll under subdivision 8, the department becomes |
---|
50 | 50 | | 2.17responsible for reenrolling the child. The department must notify the family of a child who |
---|
51 | 51 | | 2.18has been unenrolled from school under subdivision 8, paragraph (c), of county and |
---|
52 | 52 | | 2.19community resources to support the student's reenrollment in school. The department must |
---|
53 | 53 | | 2.20also notify the family of the child's right to reenroll in the child's school and of other |
---|
54 | 54 | | 2.21accessible educational opportunities that may be available to the child. The department may |
---|
55 | 55 | | 2.22work with county attorneys and other parties under chapter 260A to reenroll the child in |
---|
56 | 56 | | 2.23school. |
