55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. [340A.920] LICENSE REQUIRED FOR THIRD-PARTY DELIVERY OF​
77 1.7ALCOHOLIC BEVERAGES.​
88 1.8 Subdivision 1.License required.Delivery of alcoholic beverages is prohibited unless​
99 1.9the delivery is made from a licensed premises and:​
1010 1.10 (1) by a licensed or authorized off-sale liquor retailer; or​
1111 1.11 (2) a third-party delivery service that holds a license to deliver alcoholic beverages.​
1212 1.12 Subd. 2.License issuance.The commissioner must issue a third-party delivery license​
1313 1.13to a third-party delivery service who pays the fee and meets the requirements.​
1414 1.14 Subd. 3.Fee.The commissioner shall charge an annual fee of $500 for a third-party​
1515 1.15delivery off-sale liquor license.​
1616 1.16 Subd. 4.Employees.A third-party delivery licensee must use the delivery service's​
1717 1.17employees or independent contractors who are at least 21 years of age to deliver alcoholic​
1818 1.18beverages and facilitate orders for the sale and delivery of alcoholic beverages.​
1919 1.19 Subd. 5.Age requirement.An individual who purchases alcoholic beverages for delivery​
2020 1.20through a third-party delivery service must be at least 21 years of age. Delivery service​
2121 1.21employees or independent contractors must verify the individual's age at the point of delivery.​
