1.1 A bill for an act
1.2 relating to commerce; requiring third-party delivery services to obtain a license
1.3 to deliver alcoholic beverages; proposing coding for new law in Minnesota Statutes,
1.4 chapter 340A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [340A.920] LICENSE REQUIRED FOR THIRD-PARTY DELIVERY OF
1.7ALCOHOLIC BEVERAGES.
1.8 Subdivision 1.License required.Delivery of alcoholic beverages is prohibited unless
1.9the delivery is made from a licensed premises and:
1.10 (1) by a licensed or authorized off-sale liquor retailer; or
1.11 (2) a third-party delivery service that holds a license to deliver alcoholic beverages.
1.12 Subd. 2.License issuance.The commissioner must issue a third-party delivery license
1.13to a third-party delivery service who pays the fee and meets the requirements.
1.14 Subd. 3.Fee.The commissioner shall charge an annual fee of $500 for a third-party
1.15delivery off-sale liquor license.
1.16 Subd. 4.Employees.A third-party delivery licensee must use the delivery service's
1.17employees or independent contractors who are at least 21 years of age to deliver alcoholic
1.18beverages and facilitate orders for the sale and delivery of alcoholic beverages.
1.19 Subd. 5.Age requirement.An individual who purchases alcoholic beverages for delivery
1.20through a third-party delivery service must be at least 21 years of age. Delivery service
1.21employees or independent contractors must verify the individual's age at the point of delivery.

2.2third-party delivery license must complete alcoholic beverages awareness training prior to
2.3delivering alcoholic beverages on behalf of the third-party delivery service. Proof of
2.4completion must be submitted to the third-party delivery service. The third-party delivery
2.5service must provide proof of completion to the commissioner upon request.
2.6 Subd. 7.Insurance requirement.A third-party delivery licensee must obtain liquor
2.7liability insurance under section 340A.409.
