| 5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

| 6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 414.031, subdivision 1, is amended to read: |

| 7 | 7 | | 1.7 Subdivision 1.Initiating the proceeding.(a) A proceeding for the annexation of |
|---|
| 8 | 8 | | 1.8unincorporated property abutting a municipality may be initiated by submitting to the chief |
|---|
| 9 | 9 | | 1.9administrative law judge and the affected township one of the following: |
|---|
| 10 | 10 | | 1.10 (1) a resolution of the annexing municipality; |
|---|
| 11 | 11 | | 1.11 (2) a resolution of the township containing the area proposed for annexation; |
|---|
| 12 | 12 | | 1.12 (3) a petition of 20 percent of the property owners or 100 property owners, whichever |
|---|
| 13 | 13 | | 1.13is less, in the area to be annexed; |
|---|
| 14 | 14 | | 1.14 (4) a resolution of the municipal council together with a resolution of the township board |
|---|
| 15 | 15 | | 1.15stating their desire to have the entire township annexed to the municipality. |

| 16 | 16 | | 1.16 (b) The petition, or resolution shall set forth the boundaries of the territory proposed for |
|---|
| 17 | 17 | | 1.17annexation, the names of all parties entitled to notice under section 414.09, and the reasons |
|---|
| 18 | 18 | | 1.18for requesting annexation. |

| 19 | 19 | | 1.19 (c) If the proceeding is initiated by a petition of property owners, the petition shall be |
|---|
| 20 | 20 | | 1.20accompanied by a resolution of the annexing municipality supporting the petition. |
