1.1 A bill for an act
1.2 relating to local government; modifying provisions for annexing unincorporated
1.3 property; clarifying property owners eligible to petition for annexation; amending
1.4 Minnesota Statutes 2024, section 414.031, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 414.031, subdivision 1, is amended to read:
1.7 Subdivision 1.Initiating the proceeding.(a) A proceeding for the annexation of
1.8unincorporated property abutting a municipality may be initiated by submitting to the chief
1.9administrative law judge and the affected township one of the following:
1.10 (1) a resolution of the annexing municipality;
1.11 (2) a resolution of the township containing the area proposed for annexation;
1.12 (3) a petition of 20 percent of the property owners or 100 property owners, whichever
1.13is less, in the area to be annexed;
1.14 (4) a resolution of the municipal council together with a resolution of the township board
1.15stating their desire to have the entire township annexed to the municipality.
1.16 (b) The petition, or resolution shall set forth the boundaries of the territory proposed for
1.17annexation, the names of all parties entitled to notice under section 414.09, and the reasons
1.18for requesting annexation.
1.19 (c) If the proceeding is initiated by a petition of property owners, the petition shall be
1.20accompanied by a resolution of the annexing municipality supporting the petition.
