16 | 16 | | 1.16 (d) "Department" means the Department of Public Safety. |

17 | 17 | | 1.17 (e) "Protest" means any public demonstration, march, rally, or gathering exercising first |

18 | 18 | | 1.18amendment rights. |

19 | 19 | | 1.19 Subd. 3.Eligible expenses.Eligible costs are limited to: |

35 | 35 | | 2.5materials for reimbursement and may update the materials as needed. Application materials |
---|
36 | 36 | | 2.6must include instructions and requirements for assistance under this section. These application |
---|
37 | 37 | | 2.7materials are not subject to the rulemaking requirements under Minnesota Statutes, chapter |
---|
38 | 38 | | 2.814. |
---|
39 | 39 | | 2.9 (b) An applicant has 60 days from the end of the protest to request reimbursement. The |
---|
40 | 40 | | 2.10commissioner may deny a late request. The applicant's request must document: |
---|
41 | 41 | | 2.11 (1) the size, location, and length of the protest; |
---|
42 | 42 | | 2.12 (2) the role the agency played in responding to the protest; and |
---|
43 | 43 | | 2.13 (3) a description of eligible expenses incurred by the agency. |
---|
44 | 44 | | 2.14 (c) An applicant must submit to the commissioner completed claims for payment of |
---|
45 | 45 | | 2.15eligible expenses on the forms provided by the commissioner. All eligible expenses claimed |
---|
46 | 46 | | 2.16for payment must be documented and consistent with the eligibility provisions of this section. |
---|
47 | 47 | | 2.17 (d) An applicant may submit additional supporting documentation for up to 60 days |
---|
48 | 48 | | 2.18after the commissioner's acceptance of the initial request for reimbursement. |
---|
49 | 49 | | 2.19 (e) The commissioner shall review the application and supporting documentation for |
---|
50 | 50 | | 2.20completeness and may return the application with a request for more detailed information |
---|
51 | 51 | | 2.21or correction of deficiencies. The commissioner may consult with appropriate governmental |
---|
52 | 52 | | 2.22officials to ensure the application reflects the extent and magnitude of the protest and to |
---|
53 | 53 | | 2.23reconcile any differences. The application is not complete until the commissioner receives |
---|
54 | 54 | | 2.24all requested information. |
---|
55 | 55 | | 2.25 (f) If the commissioner returns an application with a request for more detailed information |
---|
56 | 56 | | 2.26or for correction of deficiencies, the applicant must resubmit the application with all required |
---|
57 | 57 | | 2.27information within 30 days of the applicant's receipt of the commissioner's request. The |
---|
58 | 58 | | 2.28applicant's failure to provide the requested information in a timely manner without a |
---|
59 | 59 | | 2.29reasonable explanation may be cause for denial of the application. |
---|
60 | 60 | | 2.30 (g) The commissioner must approve or deny an application within 30 days of receipt of |
---|
61 | 61 | | 2.31a complete application or the application is deemed approved. If the commissioner approves |
---|
62 | 62 | | 2.32an application or the application is automatically deemed approved after 60 days, the |
---|

66 | 66 | | 3.3 Subd. 5.Appeal process.If the commissioner denies an applicant's claim for payment, |
---|
67 | 67 | | 3.4the applicant has 30 days from receipt of the commissioner's determination to appeal in |
---|
68 | 68 | | 3.5writing to the commissioner. The appeal must include the applicant's rationale for reversing |
---|
69 | 69 | | 3.6the commissioner's determination. The commissioner has 30 days from receipt of the appeal |
---|
70 | 70 | | 3.7to uphold or modify the commissioner's determination and formally respond to the applicant. |
---|
71 | 71 | | 3.8If no written request for appeal is received, the determination is final. The applicant is |
---|
72 | 72 | | 3.9entitled to judicial review under Minnesota Statutes, sections 14.63 to 14.68, in the same |
---|
73 | 73 | | 3.10manner that a person aggrieved by a final decision in a contested case is entitled to judicial |
---|
74 | 74 | | 3.11review. The commissioner's determination under this section shall be a final decision of the |
---|
75 | 75 | | 3.12department for purposes of Minnesota Statutes, sections 14.63 to 14.68. |
---|
76 | 76 | | 3.13 Subd. 6.Report.Beginning January 15, 2027, the commissioner shall submit an annual |
---|
77 | 77 | | 3.14report to the chairs and ranking minority members of the legislative committees with |
---|
78 | 78 | | 3.15jurisdiction over public safety policy and finance on the extraordinary law enforcement |
---|
79 | 79 | | 3.16expense reimbursement program. The report must detail the reimbursements awarded, |
---|
80 | 80 | | 3.17including the law enforcement agencies that received reimbursement funds and the amount |
---|
81 | 81 | | 3.18of each reimbursement award. |

82 | 82 | | 3.19 Sec. 2. APPROPRIATION; EXTRAORDINAR Y LAW ENFORCEMENT EXPENSE |
