1.1 A bill for an act 1.2 relating to public safety; establishing a reimbursement program for law enforcement 1.3 agencies that respond to protests and demonstrations at the Capitol complex and 1.4 the governor's residence; requiring a report; appropriating money. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. EXTRAORDINAR Y LAW ENFORCEMENT EXPENSE 1.7REIMBURSEMENT PROGRAM. 1.8 Subdivision 1.Purpose.This section establishes a reimbursement program for 1.9extraordinary law enforcement expenses incurred while responding to protests at the 1.10Minnesota State Capitol and governor's residence. 1.11 Subd. 2.Definitions.(a) For purposes of this section, the terms in this subdivision have 1.12the meanings given. 1.13 (b) "Applicant" means any municipal or state law enforcement agency providing services 1.14within the jurisdiction of the Minnesota State Capitol and governor's residence. 1.15 (c) "Commissioner" means the commissioner of public safety. 1.16 (d) "Department" means the Department of Public Safety. 1.17 (e) "Protest" means any public demonstration, march, rally, or gathering exercising first 1.18amendment rights. 1.19 Subd. 3.Eligible expenses.Eligible costs are limited to: 1.20 (1) overtime costs; 1.21 (2) logistical needs; 1Section 1. No. 2818 NINETY-FOURTH SESSION Authored by Stier, Hollins, Nadeau, Hussein and Novotny03/26/2025 The bill was read for the first time and referred to the Committee on Public Safety Finance and Policy 2.1 (3) incidental supplies necessary to respond to the protest; 2.2 (4) backfill personnel costs incurred; and 2.3 (5) damaged or destroyed equipment costs. 2.4 Subd. 4.Reimbursement process.(a) The commissioner must develop application 2.5materials for reimbursement and may update the materials as needed. Application materials 2.6must include instructions and requirements for assistance under this section. These application 2.7materials are not subject to the rulemaking requirements under Minnesota Statutes, chapter 2.814. 2.9 (b) An applicant has 60 days from the end of the protest to request reimbursement. The 2.10commissioner may deny a late request. The applicant's request must document: 2.11 (1) the size, location, and length of the protest; 2.12 (2) the role the agency played in responding to the protest; and 2.13 (3) a description of eligible expenses incurred by the agency. 2.14 (c) An applicant must submit to the commissioner completed claims for payment of 2.15eligible expenses on the forms provided by the commissioner. All eligible expenses claimed 2.16for payment must be documented and consistent with the eligibility provisions of this section. 2.17 (d) An applicant may submit additional supporting documentation for up to 60 days 2.18after the commissioner's acceptance of the initial request for reimbursement. 2.19 (e) The commissioner shall review the application and supporting documentation for 2.20completeness and may return the application with a request for more detailed information 2.21or correction of deficiencies. The commissioner may consult with appropriate governmental 2.22officials to ensure the application reflects the extent and magnitude of the protest and to 2.23reconcile any differences. The application is not complete until the commissioner receives 2.24all requested information. 2.25 (f) If the commissioner returns an application with a request for more detailed information 2.26or for correction of deficiencies, the applicant must resubmit the application with all required 2.27information within 30 days of the applicant's receipt of the commissioner's request. The 2.28applicant's failure to provide the requested information in a timely manner without a 2.29reasonable explanation may be cause for denial of the application. 2.30 (g) The commissioner must approve or deny an application within 30 days of receipt of 2.31a complete application or the application is deemed approved. If the commissioner approves 2.32an application or the application is automatically deemed approved after 60 days, the 2Section 1. If the commissioner denies 3.2an application, the commissioner must provide written notice to the applicant of the denial. 3.3 Subd. 5.Appeal process.If the commissioner denies an applicant's claim for payment, 3.4the applicant has 30 days from receipt of the commissioner's determination to appeal in 3.5writing to the commissioner. The appeal must include the applicant's rationale for reversing 3.6the commissioner's determination. The commissioner has 30 days from receipt of the appeal 3.7to uphold or modify the commissioner's determination and formally respond to the applicant. 3.8If no written request for appeal is received, the determination is final. The applicant is 3.9entitled to judicial review under Minnesota Statutes, sections 14.63 to 14.68, in the same 3.10manner that a person aggrieved by a final decision in a contested case is entitled to judicial 3.11review. The commissioner's determination under this section shall be a final decision of the 3.12department for purposes of Minnesota Statutes, sections 14.63 to 14.68. 3.13 Subd. 6.Report.Beginning January 15, 2027, the commissioner shall submit an annual 3.14report to the chairs and ranking minority members of the legislative committees with 3.15jurisdiction over public safety policy and finance on the extraordinary law enforcement 3.16expense reimbursement program. The report must detail the reimbursements awarded, 3.17including the law enforcement agencies that received reimbursement funds and the amount 3.18of each reimbursement award. 3.19 Sec. 2. APPROPRIATION; EXTRAORDINAR Y LAW ENFORCEMENT EXPENSE 3.20REIMBURSEMENT PROGRAM. 3.21 $....... in fiscal year 2026 and $....... in fiscal year 2027 are appropriated from the general 3.22fund to the commissioner of public safety to fund the extraordinary law enforcement expense 3.23reimbursement program. This amount is added to the agency's base. 3.24 Sec. 3. EFFECTIVE DATE. 3.25 This act is effective July 1, 2025. 3Sec. 3. REVISOR KLL/NS 25-0494403/19/25
