1.1 A bill for an act 1.2 relating to public safety; establishing a crime for transferring bodily fluids at or 1.3 onto certain individuals; expanding the offense of fourth-degree assault to include 1.4 all people providing health care services; amending Minnesota Statutes 2024, 1.5 section 609.2231, subdivision 2. 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2024, section 609.2231, subdivision 2, is amended to read: 1.8 Subd. 2.Firefighters and emergency medical personnel.Whoever assaults any commits 1.9either of the following persons and inflicts demonstrable bodily harm acts against a member 1.10of a municipal or volunteer fire department or emergency medical services personnel unit 1.11in the performance of the member's duties or against a physician, nurse, or other person 1.12providing health care services is guilty of a felony and may be sentenced to imprisonment 1.13for not more than two years or to payment of a fine of not more than $4,000, or both: 1.14 (1) a member of a municipal or volunteer fire department or emergency medical services 1.15personnel unit in the performance of the member's duties assaults the person and inflicts 1.16demonstrable bodily harm; or 1.17 (2) a physician, nurse, or other person providing health care services in a hospital 1.18emergency department intentionally throws or otherwise transfers bodily fluids or feces at 1.19or onto the person. 1.20 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes 1.21committed on or after that date. 1Section 1.
