88 1.8 Section 1. [144.4205] ESSENTIAL PUBLIC HEALTH FUNCTIONS CONTINGENCY​
99 1.9ACCOUNT.​
1010 1.10 Subdivision 1.Essential public health function.For purposes of this section, the​
1111 1.11following activities are essential public health functions:​
1212 1.12 (1) activities to prevent or control health threats, including investigating diseases,​
1313 1.13identifying sources of disease outbreaks, conducting laboratory testing, alerting the public​
1414 1.14and health systems about health threats, and developing activities and guidelines to prevent​
1515 1.15the spread of disease and curb disease outbreaks; and​
1616 1.16 (2) the prevention of and response to waterborne disease outbreaks, including support​
1717 1.17for public water supplies to stop waterborne disease outbreaks.​
1818 1.18 Subd. 2.Essential public health functions contingency account.An essential public​
1919 1.19health functions contingency account is created in the special revenue fund in the state​
2020 1.20treasury. Money in the essential public health functions contingency account does not cancel​
2121 1.21and is appropriated to the commissioner of health for the purposes specified in subdivision​
2222 1.224 when the determination criteria in subdivision 3 and the notice and expenditure review​
2323 1.23requirements in subdivision 5 are satisfied.​

3333 The bill was read for the first time and referred to the Committee on Health Finance and Policy​ 2.1 Subd. 3.Determination criteria.The commissioner may make expenditures from the​
3434 2.2essential public health functions contingency account only if the commissioner determines:​
3535 2.3 (1) on or after March 1, 2025, there was an unexpected, significant reduction in federal​
3636 2.4funding or the unexpected elimination of federal funding for one or more essential public​
3737 2.5health functions performed by the commissioner of health or funded in whole or in part​
3838 2.6with federal funds distributed by the commissioner; and​
3939 2.7 (2) additional funding is necessary for these essential public health functions to continue​
4040 2.8to be performed.​
4141 2.9 Subd. 4.Uses of funds.When the determination criteria in subdivision 3 and the notice​
4242 2.10and expenditure review requirements in subdivision 5 are satisfied, the commissioner may​
4343 2.11make expenditures from the essential public health functions contingency account for the​
4444 2.12essential public health functions for which federal funding was reduced or eliminated.​
4545 2.13 Subd. 5.Notice and expenditure review.Prior to making an expenditure from the​
4646 2.14essential public health functions contingency account, the commissioner must:​
4747 2.15 (1) provide written notice to the chairs and ranking minority members of the legislative​
4848 2.16committees with jurisdiction over health and human services finance and policy regarding​
4949 2.17the circumstances that necessitate making an expenditure from the account; and​
5050 2.18 (2) after providing notice under clause (1), seek review and recommendation from the​
5151 2.19Legislative Advisory Commission according to the procedure in section 3.3005, subdivision​
5252 2.205, that would otherwise apply if the funds were federal funds. The commissioner is prohibited​
5353 2.21from seeking review and recommendation for an expenditure for essential public health​
5454 2.22functions that was made before the commissioner provided the notice required under clause​
5555 2.23(1).​
5656 2.24 Subd. 6.Report.By January 15 of each year following a year in which the commissioner​
5757 2.25made one or more expenditures from the essential public health functions contingency​
5858 2.26account, the commissioner must submit a report on the expenditures to the chairs and ranking​
5959 2.27minority members of the legislative committees with jurisdiction over health and human​
6060 2.28services finance and policy. The report must include the following information for the​
6161 2.29preceding year: the amount of federal funding for one or more essential public health​
6262 2.30functions that was reduced or eliminated; the amount of each expenditure from the essential​
6363 2.31public health functions contingency account; the purpose for which each expenditure was​
6464 2.32used; and any additional information the commissioner determines is necessary to properly​
6565 2.33document each expenditure. This report is exempt under section 144.05, subdivision 7.​
