1.1 A bill for an act 1.2 relating to public health; establishing an essential public health functions 1.3 contingency account; requiring a report; transferring money to the essential public 1.4 health functions contingency account; appropriating money in the account to the 1.5 commissioner of health in certain circumstances; proposing coding for new law 1.6 in Minnesota Statutes, chapter 144. 1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. [144.4205] ESSENTIAL PUBLIC HEALTH FUNCTIONS CONTINGENCY 1.9ACCOUNT. 1.10 Subdivision 1.Essential public health function.For purposes of this section, the 1.11following activities are essential public health functions: 1.12 (1) activities to prevent or control health threats, including investigating diseases, 1.13identifying sources of disease outbreaks, conducting laboratory testing, alerting the public 1.14and health systems about health threats, and developing activities and guidelines to prevent 1.15the spread of disease and curb disease outbreaks; and 1.16 (2) the prevention of and response to waterborne disease outbreaks, including support 1.17for public water supplies to stop waterborne disease outbreaks. 1.18 Subd. 2.Essential public health functions contingency account.An essential public 1.19health functions contingency account is created in the special revenue fund in the state 1.20treasury. Money in the essential public health functions contingency account does not cancel 1.21and is appropriated to the commissioner of health for the purposes specified in subdivision 1.224 when the determination criteria in subdivision 3 and the notice and expenditure review 1.23requirements in subdivision 5 are satisfied. 1Section 1. No. 3180 NINETY-FOURTH SESSION Authored by Liebling, Huot, Hemmingsen-Jaeger, Pursell, Keeler and others04/10/2025 The bill was read for the first time and referred to the Committee on Health Finance and Policy 2.1 Subd. 3.Determination criteria.The commissioner may make expenditures from the 2.2essential public health functions contingency account only if the commissioner determines: 2.3 (1) on or after March 1, 2025, there was an unexpected, significant reduction in federal 2.4funding or the unexpected elimination of federal funding for one or more essential public 2.5health functions performed by the commissioner of health or funded in whole or in part 2.6with federal funds distributed by the commissioner; and 2.7 (2) additional funding is necessary for these essential public health functions to continue 2.8to be performed. 2.9 Subd. 4.Uses of funds.When the determination criteria in subdivision 3 and the notice 2.10and expenditure review requirements in subdivision 5 are satisfied, the commissioner may 2.11make expenditures from the essential public health functions contingency account for the 2.12essential public health functions for which federal funding was reduced or eliminated. 2.13 Subd. 5.Notice and expenditure review.Prior to making an expenditure from the 2.14essential public health functions contingency account, the commissioner must: 2.15 (1) provide written notice to the chairs and ranking minority members of the legislative 2.16committees with jurisdiction over health and human services finance and policy regarding 2.17the circumstances that necessitate making an expenditure from the account; and 2.18 (2) after providing notice under clause (1), seek review and recommendation from the 2.19Legislative Advisory Commission according to the procedure in section 3.3005, subdivision 2.205, that would otherwise apply if the funds were federal funds. The commissioner is prohibited 2.21from seeking review and recommendation for an expenditure for essential public health 2.22functions that was made before the commissioner provided the notice required under clause 2.23(1). 2.24 Subd. 6.Report.By January 15 of each year following a year in which the commissioner 2.25made one or more expenditures from the essential public health functions contingency 2.26account, the commissioner must submit a report on the expenditures to the chairs and ranking 2.27minority members of the legislative committees with jurisdiction over health and human 2.28services finance and policy. The report must include the following information for the 2.29preceding year: the amount of federal funding for one or more essential public health 2.30functions that was reduced or eliminated; the amount of each expenditure from the essential 2.31public health functions contingency account; the purpose for which each expenditure was 2.32used; and any additional information the commissioner determines is necessary to properly 2.33document each expenditure.
