                            1.1	A bill for an act​
1.2 relating to public safety; modifying crime of fleeing peace officer in motor vehicle​
1.3 to add heightened penalty for fleeing in culpably negligent manner; establishing​
1.4 crime of fleeing in motor vehicle and failing to obey certain traffic laws; amending​
1.5 Minnesota Statutes 2024, sections 171.174; 609.487, subdivision 5, by adding​
1.6 subdivisions.​
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.8 Section 1. Minnesota Statutes 2024, section 171.174, is amended to read:​
1.9 171.174 REVOCATION; FLEEING PEACE OFFICER OFFENSE.​
1.10 The commissioner of public safety shall revoke the license of a person upon receipt of​
1.11a certificate of conviction showing that the person has in a motor vehicle violated section​
1.12609.487, subdivision 3, 3a, 3b, or 4, or an ordinance in conformity with those subdivisions.​
1.13The commissioner shall revoke the license as follows:​
1.14 (1) for the first offense under section 609.487, subdivision 3, for not less than one year;​
1.15 (2) for the second offense or subsequent offenses under section 609.487, subdivision 3,​
1.16for not less than three years;​
1.17 (3) for an offense under section 609.487, subdivision 3a or 3b, for not less than four​
1.18years;​
1.19 (4) for an offense under section 609.487, subdivision 4, clause (a), for not less than ten​
1.20years;​
1.21 (4) (5) for an offense under section 609.487, subdivision 4, clause (b), for not less than​
1.22seven years; and​

Adoption of Report: Amended and re-referred to the Committee on Transportation Finance and Policy​02/24/2025​ 2.1 (5) (6) for an offense under section 609.487, subdivision 4, clause (c), for not less than​
2.2five years.​
2.3A limited license under section 171.30 may not be issued for one-half of the revocation​
2.4period specified in clauses (1) to (5) (6) and after that period is over only upon and as​
2.5recommended by the adjudicating court.​
2.6 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes​
2.7committed on or after that date.​
2.8 Sec. 2. Minnesota Statutes 2024, section 609.487, is amended by adding a subdivision to​
2.9read:​
2.10 Subd. 3a.Fleeing an officer; motor vehicle; culpable negligence.Whoever, by means​
2.11of a motor vehicle, flees or attempts to flee a peace officer who is acting in the lawful​
2.12discharge of an official duty, and the perpetrator knows or should reasonably know the same​
2.13to be a peace officer, and who in the course of fleeing operates the vehicle in a culpably​
2.14negligent manner whereby the perpetrator creates an unreasonable risk and consciously​
2.15takes chances of causing death or great bodily harm to another, is guilty of a felony and​
2.16may be sentenced to imprisonment for not more than five years or to payment of a fine of​
2.17not more than $10,000, or both.​
2.18 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes​
2.19committed on or after that date.​
2.20 Sec. 3. Minnesota Statutes 2024, section 609.487, is amended by adding a subdivision to​
2.21read:​
2.22 Subd. 3b.Fleeing officer; failure to obey signs.Whoever flees or attempts to flee by​
2.23means of a motor vehicle a peace officer who is acting in the lawful discharge of an official​
2.24duty, and the perpetrator knows or should reasonably know the same to be a peace officer,​
2.25and who in the course of fleeing in a motor vehicle does any of the following is guilty of a​
2.26felony and may be sentenced to imprisonment for not more than four years or to payment​
2.27of a fine of not more than $8,000 or both:​
2.28 (1) fails to obey signs, signals, or markings in violation of section 169.06, subdivision​
2.294, 4a, 4b, 5, 6, 7, or 8; or​
2.30 (2) fails to keep on the proper side of the road in violation of section 169.18.​
2.31 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes​
2.32committed on or after that date.​

3.2 Subd. 5.Revocation; fleeing peace officer offense.When a person is convicted of​
3.3operating a motor vehicle in violation of subdivision 3, 3a, 3b, or 4, or an ordinance in​
3.4conformity with those subdivisions, the court shall notify the commissioner of public safety​
3.5and order the commissioner to revoke the driver's license of the person.​
3.6 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes​
3.7committed on or after that date.​
