44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. Minnesota Statutes 2024, section 103G.271, subdivision 4a, is amended to read:​
66 1.6 Subd. 4a.Mt. Simon-Hinckley aquifer.(a) The commissioner may not issue a new​
77 1.7water-use permits that will permit to appropriate water for potable water use from the Mt.​
88 1.8Simon-Hinckley aquifer unless the appropriation is for potable water use,:​
99 1.9 (1) the commissioner determines that there are no feasible or practical alternatives to​
1010 1.10this source, and;​
1111 1.11 (2) a water conservation plan that incorporates best available water conservation​
1212 1.12technology and practices is incorporated with in the permit; and​
1313 1.13 (3) the permit is consistent with the requirements of sections 103G.255 to 103G.299 and​
1414 1.14the general permit requirements of sections 103G.301 and 103G.111, as applicable.​
1515 1.15 (b) The commissioner may not issue a new permit to appropriate water for nonpotable​
1616 1.16use from the Mt. Simon-Hinckley aquifer unless the permit satisfies the requirements of​
1717 1.17paragraph (a) and the requested appropriation is outside a metropolitan county, as defined​
1818 1.18in section 473.121, subdivision 4.​
