4 | 4 | | 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

5 | 5 | | 1.5 Section 1. Minnesota Statutes 2024, section 103G.271, subdivision 4a, is amended to read: |

6 | 6 | | 1.6 Subd. 4a.Mt. Simon-Hinckley aquifer.(a) The commissioner may not issue a new |

7 | 7 | | 1.7water-use permits that will permit to appropriate water for potable water use from the Mt. |
---|
8 | 8 | | 1.8Simon-Hinckley aquifer unless the appropriation is for potable water use,: |

9 | 9 | | 1.9 (1) the commissioner determines that there are no feasible or practical alternatives to |
---|
10 | 10 | | 1.10this source, and; |
---|
11 | 11 | | 1.11 (2) a water conservation plan that incorporates best available water conservation |
---|
12 | 12 | | 1.12technology and practices is incorporated with in the permit; and |
---|
13 | 13 | | 1.13 (3) the permit is consistent with the requirements of sections 103G.255 to 103G.299 and |
---|
14 | 14 | | 1.14the general permit requirements of sections 103G.301 and 103G.111, as applicable. |

15 | 15 | | 1.15 (b) The commissioner may not issue a new permit to appropriate water for nonpotable |
