1.1 A bill for an act 1.2 relating to water; authorizing certain water appropriations from Mt. Simon-Hinckley 1.3 aquifer; amending Minnesota Statutes 2024, section 103G.271, subdivision 4a. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. Minnesota Statutes 2024, section 103G.271, subdivision 4a, is amended to read: 1.6 Subd. 4a.Mt. Simon-Hinckley aquifer.(a) The commissioner may not issue a new 1.7water-use permits that will permit to appropriate water for potable water use from the Mt. 1.8Simon-Hinckley aquifer unless the appropriation is for potable water use,: 1.9 (1) the commissioner determines that there are no feasible or practical alternatives to 1.10this source, and; 1.11 (2) a water conservation plan that incorporates best available water conservation 1.12technology and practices is incorporated with in the permit; and 1.13 (3) the permit is consistent with the requirements of sections 103G.255 to 103G.299 and 1.14the general permit requirements of sections 103G.301 and 103G.111, as applicable. 1.15 (b) The commissioner may not issue a new permit to appropriate water for nonpotable 1.16use from the Mt. Simon-Hinckley aquifer unless the permit satisfies the requirements of 1.17paragraph (a) and the requested appropriation is outside a metropolitan county, as defined 1.18in section 473.121, subdivision 4. 1Section 1.
