1.1 A bill for an act
1.2 relating to commerce; modifying prohibition of lead and cadmium in certain
1.3 consumer products; amending Minnesota Statutes 2024, section 325E.3892,
1.4 subdivision 1, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 325E.3892, subdivision 1, is amended to read:
1.7 Subdivision 1.Definitions.(a) For purposes of this section, the following terms have
1.8the meanings given.
1.9 (b) "Covered product" means any of the following products or product components:
1.10 (1) jewelry;
1.11 (2) toys;
1.12 (3) cosmetics and personal care products;
1.13 (4) puzzles, board games, card games, and similar games;
1.14 (5) play sets and play structures;
1.15 (6) outdoor games;
1.16 (7) school supplies, except ink pens and mechanical pencils;
1.17 (8) pots and pans;
1.18 (9) cups, bowls, and other food containers;
1.19 (10) craft supplies and jewelry-making supplies;

2.2materials, which include but are not limited to oil-based paints, water-based paints, acrylic
2.3paints, pastels, pigments, ceramic glazes, markers, and encaustics;
2.4 (12) fidget spinners;
2.5 (13) costumes, costume accessories, and children's and seasonal party supplies;
2.6 (14) keys, key chains, and key rings; and
2.7 (15) clothing, footwear, headwear, and accessories.
2.8 (c) "Pastels" means a crayon composed of powdered pigments bonded with gum or resin.
2.9 EFFECTIVE DATE.This section is effective the day following final enactment.
2.10 Sec. 2. Minnesota Statutes 2024, section 325E.3892, is amended by adding a subdivision
2.11to read:
2.12 Subd. 2a.Age restriction.A retailer must only sell paint or pastels containing cadmium
2.13that are not prohibited under subdivision 2 if the purchaser presents valid evidence that the
2.14purchaser is at least 18 years of age.
