1.2 relating to transportation; expanding application of construction materials special
1.3 permit; amending Minnesota Statutes 2024, section 169.869, subdivisions 1, 2, 3.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2024, section 169.869, subdivision 1, is amended to read:
1.6 Subdivision 1.Definition.For purposes of this section, "road construction materials"
1.7means street or highway construction materials, including but not limited to includes:
1.8 (1) aggregate material as defined in section 298.75, subdivision 1, paragraph (a),;
1.9 (2) hot mix asphalt, plastic concrete, cementitious materials, concrete admixtures, asphalt
1.10cement, and recycled road materials; and
1.11 (3) bulk aggregate materials that are delivered to an aggregate plant or production facility,
1.12or are used in the production of asphalt or concrete, not including those materials that require
1.13the vehicle to be marked or placarded in accordance with section 221.033 and Code of
1.14Federal Regulations, title 49, part 172.
1.15 EFFECTIVE DATE.This section is effective August 1, 2025, for permits issued on
1.16or after that date.
1.17 Sec. 2. Minnesota Statutes 2024, section 169.869, subdivision 2, is amended to read:
1.18 Subd. 2.Six-axle vehicles.(a) A road authority may issue an annual permit authorizing
1.19a vehicle or combination of vehicles with a total of six or more axles to haul road construction
1.20materials and be operated with a gross vehicle weight of up to:

2.4 (b) The fee for a permit issued under this subdivision is $300, or a proportional amount
2.5as provided in section 169.86, subdivision 5.
2.6 EFFECTIVE DATE.This section is effective August 1, 2025, for permits issued on
2.7or after that date.
2.8 Sec. 3. Minnesota Statutes 2024, section 169.869, subdivision 3, is amended to read:
2.9 Subd. 3.Seven-axle vehicles.(a) A road authority may issue an annual permit authorizing
2.10a vehicle or combination of vehicles with a total of seven or more axles to haul road
2.11construction materials and be operated with a gross vehicle weight of up to:
2.12 (1) 97,000 pounds; and
2.13 (2) 99,000 pounds during the period set by the commissioner under section 169.826,

2.15 (b) The fee for a permit issued under this subdivision is $500, or a proportional amount
2.16as provided in section 169.86, subdivision 5.
2.17 EFFECTIVE DATE.This section is effective August 1, 2025, for permits issued on
2.18or after that date.
