1.1 A bill for an act 1.2 relating to state government; allowing legislative auditor to bring a civil or criminal 1.3 complaint; establishing authority for county attorneys to prosecute certain claims; 1.4 amending Minnesota Statutes 2024, section 3.971, by adding subdivisions. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 3.971, is amended by adding a subdivision 1.7to read: 1.8 Subd. 10.Civil or criminal complaint.For occurrences of fraud or maladministration 1.9of taxpayer-funded programs, the legislative auditor is authorized to bring a civil action or 1.10criminal complaint under Minnesota law in the office's name as the legislative auditor. The 1.11standing of any state department to sue or be sued under applicable law must not be affected 1.12by any civil action or criminal complaint under this subdivision. 1.13 Sec. 2. Minnesota Statutes 2024, section 3.971, is amended by adding a subdivision to 1.14read: 1.15 Subd. 11.County attorneys may pursue fraud allegations.County attorneys may 1.16prosecute claims of fraud or maladministration in taxpayer-funded programs under Minnesota 1.17law. 1Sec. 2.
