1.1 A bill for an act 1.2 proposing an amendment to the Minnesota Constitution, article VII, section 1; 1.3 allowing owners of agricultural land, real property that is both nonhomesteaded 1.4 and noncommercial, or small business property to vote on property tax questions 1.5 where the property is located; providing implementing language; proposing coding 1.6 for new law in Minnesota Statutes, chapter 204B. 1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. CONSTITUTIONAL AMENDMENT PROPOSED. 1.9 An amendment to the Minnesota Constitution is proposed to the people. If the amendment 1.10is adopted, article VII, section 1, will read: 1.11 Section 1. Every person 18 years of age or more who has been a citizen of the United 1.12States for three months and who has resided in the precinct for 30 days next preceding an 1.13election shall be entitled to vote in that precinct. In addition, every person 18 years of age 1.14or more who has been a citizen of the United States and resident of this state for three months 1.15and who is the owner of agricultural land, real property that is both nonhomesteaded and 1.16noncommercial, or real property that is commercial or industrial on which the owner conducts 1.17a small business as defined by law may vote in the precinct where the real property is located 1.18on any question concerning a local levy or referendum. The place of voting by one otherwise 1.19qualified who has changed his residence within 30 days preceding the election shall be 1.20prescribed by law. The following persons shall not be entitled or permitted to vote at any 1.21election in this state: A person not meeting the above requirements; a person who has been 1.22convicted of treason or felony, unless restored to civil rights; a person under guardianship, 1.23or a person who is insane or not mentally competent. 1Section 1. SUBMISSION TO VOTERS. 2.2 The proposed amendment must be submitted to the people at the 2026 general election. 2.3The question submitted must be: 2.4 "Shall the Minnesota Constitution be amended to allow the owner of agricultural land, 2.5real property that is both nonhomesteaded and noncommercial, or real property that is 2.6commercial or industrial on which the owner conducts a small business as defined by law 2.7to vote on a local levy or bond referendum where the real property is located? 2.8 Yes ................... 2.9 No .................." 2.10 Sec. 3. [204B.50] CERTAIN PROPERTY TAX AND BOND QUESTIONS; 2.11SECRETARY OF STATE RULES. 2.12 The owner of agricultural land, real property that is both nonhomesteaded and 2.13noncommercial, or real property that is commercial or industrial on which the owner conducts 2.14a small business as defined by law may vote in the precinct where the real property is located 2.15on any question concerning a local levy or bond referendum. Owners may register to vote 2.16in the precinct where the real property is located, for purposes of this section only, under 2.17procedures developed by the secretary of state by rule. Owners may vote by absentee ballot 2.18in the manner provided by chapter 203B or may vote in a mail election as provided in section 2.19204B.45. 2.20 Sec. 4.
