1.1 A bill for an act 1.2 relating to transportation; modifying requirements for the exception to window 1.3 glazing requirements; amending Minnesota Statutes 2024, section 169.71, 1.4 subdivision 4a. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 169.71, subdivision 4a, is amended to read: 1.7 Subd. 4a.Glazing material; exceptions.(a) Subdivision 4 does not apply to glazing 1.8materials that: 1.9 (1) have not been modified since the original installation, nor to original replacement 1.10windows and windshields, that were originally installed or replaced in conformity with 1.11Federal Motor Vehicle Safety Standard 205; 1.12 (2) are required to satisfy prescription or medical needs, provided: 1.13 (i) the vehicle's driver or a passenger possesses a prescription or a physician's statement 1.14of medical need; 1.15 (ii) the prescription specifically states whether the medical need is a temporary or 1.16permanent condition; 1.17 (iii) the prescription or statement specifically states the minimum percentage that light 1.18transmittance may be reduced to satisfy the prescription or medical needs of the patient; 1.19and 1.20 (iii) (iv) the prescription or statement contains an expiration date provided by the 1.21physician, which must be no more than two years after the date the prescription or statement 1Section 1. 25-02690 as introduced01/23/25 REVISOR KRB/AC SENATE STATE OF MINNESOTA S.F. No. 1075NINETY-FOURTH SESSION (SENATE AUTHORS: HOWE) OFFICIAL STATUSD-PGDATE Introduction and first reading02/06/2025 Referred to Transportation 2.1was issued, unless an indication is made by the physician that the driver's condition is 2.2permanent and no expiration date is appropriate; or 2.3 (3) are applied to: 2.4 (i) the rear windows of a pickup truck as defined in section 168.002, subdivision 26; 2.5 (ii) the rear windows or the side windows on either side behind the driver's seat of a van 2.6as defined in section 168.002, subdivision 40; 2.7 (iii) the side and rear windows of a vehicle used to transport human remains by a funeral 2.8establishment holding a license under section 149A.50; 2.9 (iv) the side and rear windows of a limousine as defined in section 168.002, subdivision 2.1015; or 2.11 (v) the rear and side windows of a police vehicle. 2.12 (b) For the purposes of paragraph (a), clause (2), a driver of a vehicle may rely on a 2.13prescription or physician's statement of medical need issued to a person not present in the 2.14vehicle if: 2.15 (1) the prescription or physician's statement of medical need is issued to (i) the driver's 2.16parent, child, grandparent, grandchild, sibling, or spouse, or (ii) a person for whom the 2.17driver is a personal care attendant; 2.18 (2) the prescription or physician's statement of medical need specifies the make, model, 2.19and license plate of one or two vehicles that will have tinted windows; and 2.20 (3) the driver is in possession of the prescription or physician's statement of medical 2.21need. 2.22 EFFECTIVE DATE.This section is effective July 1, 2025, and applies to prescriptions 2.23issued on or after that date. 2Section 1. 25-02690 as introduced01/23/25 REVISOR KRB/AC
