                            1.1	A bill for an act​
1.2 relating to energy; requiring electric utilities to obtain consent from utility customers​
1.3 prior to implementing a time-of-use rate program; proposing coding for new law​
1.4 in Minnesota Statutes, chapter 216B.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. [216B.160] TIME-OF-USE RATE PROGRAMS.​
1.7 Subdivision 1.Definitions.(a) For the purposes of this section, the following terms have​
1.8the meanings given.​
1.9 (b) "Electric utility" has the meaning given in section 216B.38, subdivision 5.​
1.10 (c) "Time-of-use rate" means an electric utility pricing structure where the rate charged​
1.11to utility customers varies depending on the time of day.​
1.12 Subd. 2.Consent required.(a) An electric utility that implements a time-of-use rate​
1.13must require customers to consent to the rate structure.​
1.14 (b) An electric utility must create a form that the person who owns the home or business​
1.15receiving electric service must sign to opt in to the time-of-use rate program and allow the​
1.16electric utility to install the necessary equipment. The form must be in 12-point, boldface​
1.17type, and must:​
1.18 (1) clearly state the opt-in is not required and the person's service is not affected if the​
1.19person does not opt in;​
1.20 (2) provide an explanation of the time-of-use rate program; and​
