1.1 A bill for an act 1.2 relating to energy; requiring electric utilities to obtain consent from utility customers 1.3 prior to implementing a time-of-use rate program; proposing coding for new law 1.4 in Minnesota Statutes, chapter 216B. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [216B.160] TIME-OF-USE RATE PROGRAMS. 1.7 Subdivision 1.Definitions.(a) For the purposes of this section, the following terms have 1.8the meanings given. 1.9 (b) "Electric utility" has the meaning given in section 216B.38, subdivision 5. 1.10 (c) "Time-of-use rate" means an electric utility pricing structure where the rate charged 1.11to utility customers varies depending on the time of day. 1.12 Subd. 2.Consent required.(a) An electric utility that implements a time-of-use rate 1.13must require customers to consent to the rate structure. 1.14 (b) An electric utility must create a form that the person who owns the home or business 1.15receiving electric service must sign to opt in to the time-of-use rate program and allow the 1.16electric utility to install the necessary equipment.
