                            1.1	A bill for an act​
1.2 relating to public safety; requiring certain facilities to notify local emergency​
1.3 responders of a hazardous chemical release; amending Minnesota Statutes 2024,​
1.4 section 299K.07.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 299K.07, is amended to read:​
1.7 299K.07 NOTIFICATION TO STATE EMERGENCY MANAGEMENT​
1.8OPERATIONS CENTER.​
1.9 (a) The notification of the commission required under the federal act must be made to​
1.10the State Emergency Management Operations Center. The owner or operator of a facility​
1.11shall must immediately notify the State Emergency Management Operations Center of the​
1.12release of a reportable quantity of the following materials:​
1.13 (1) a hazardous substance on the list established under United States Code, title 42,​
1.14section 9602; or​
1.15 (2) an extremely hazardous substance on the list established under United States Code,​
1.16title 42, section 11002.​
1.17 (b) This section does not apply to a release that results in exposure to persons solely​
1.18within the site or sites on which a facility is located or to a release specifically authorized​
1.19by state law.​
1.20 (c) A person who is required to report to or notify a state agency of a discharge, release,​
1.21or incident under section 221.0341, this chapter, chapter 18B, 18C, 18D, 115, 115A, 115B,​
1.22115C, 115D, 116, or 299J, or any other statute, administrative rule, or federal regulation​

2.2Operations Center established in this section. The commissioner of the Department of public​
2.3safety shall must ensure that the center is staffed with adequate personnel to answer all calls​
2.424 hours a day and that those staff are adequately trained to efficiently notify all appropriate​
2.5state and federal agencies with jurisdiction over the discharge or release, and provide​
2.6emergency responder information. No state agency may adopt a rule or guideline that​
2.7requires a person who notifies the State Emergency Management Operations Center to also​
2.8notify that agency. The commissioner of each affected state agency shall must include the​
2.9telephone number of the State Emergency Management Operations Center in all files,​
2.10permits, correspondence, educational publications, and other communications with the​
2.11public and other persons, and shall must designate personnel to coordinate receipt of reports​
2.12or notifications with State Emergency Management Operations Center personnel.​
2.13 (d) Immediately after reporting to or notifying the State Emergency Operations Center​
2.14under paragraph (a) or (c), the owner or operator of a facility whose primary purpose is the​
2.15processing of crude oil into petroleum products, as defined in section 296A.01, subdivision​
2.1642, must also notify the local emergency personnel with responsibility to protect public​
2.17health by responding to a discharge, release, or incident from the facility.​
2.18 EFFECTIVE DATE.This section is effective the day following final enactment and​
2.19applies to a discharge, release, or incident occurring on or after that date.​
