55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. [604.50] ACTIONS BY GOVERNMENT ENTITIES; AWARD OF COSTS.​
77 1.7 Subdivision 1.Title.This section may be cited as the "Anti-Lawfare Law."​
88 1.8 Subd. 2.Definitions.(a) For the purposes of this section, the following terms have the​
99 1.9meanings given.​
1010 1.10 (b) "Government entity" means:​
1111 1.11 (1) a state agency as defined in section 13.02, subdivision 17; or​
1212 1.12 (2) a municipality, as defined in section 466.01, subdivision 1.​
1313 1.13 (c) "Person" does not include a government entity.​
1414 1.14 Subd. 3.Award of costs.A government entity that commenced an action against a​
1515 1.15person and did not prevail is liable to the person for all costs, disbursements, and fees,​
1616 1.16including attorney fees, that the person incurred related to their defense.​
1717 1.17 Subd. 4.Other remedies.This section does not limit any other available remedies.​
1818 1.18 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to actions​
1919 1.19commenced on or after that date.​
