1.2 relating to civil actions; making government entities liable for defense costs for
1.3 actions brought by the government entity; proposing coding for new law in
1.4 Minnesota Statutes, chapter 604.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [604.50] ACTIONS BY GOVERNMENT ENTITIES; AWARD OF COSTS.
1.7 Subdivision 1.Title.This section may be cited as the "Anti-Lawfare Law."
1.8 Subd. 2.Definitions.(a) For the purposes of this section, the following terms have the
1.9meanings given.
1.10 (b) "Government entity" means:
1.11 (1) a state agency as defined in section 13.02, subdivision 17; or
1.12 (2) a municipality, as defined in section 466.01, subdivision 1.
1.13 (c) "Person" does not include a government entity.
1.14 Subd. 3.Award of costs.A government entity that commenced an action against a
1.15person and did not prevail is liable to the person for all costs, disbursements, and fees,
1.16including attorney fees, that the person incurred related to their defense.
1.17 Subd. 4.Other remedies.This section does not limit any other available remedies.
1.18 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to actions
1.19commenced on or after that date.
