| 9 | 9 | | 1.9diabetes.(a) The commissioner must establish a consumer-directed community supports |
|---|
| 10 | 10 | | 1.10budget exception process for persons with both developmental disabilities and type 1 diabetes |
|---|
| 11 | 11 | | 1.11in the home and community-based services waivers under sections 256B.092 and 256B.49. |
|---|
| 12 | 12 | | 1.12This budget exception process must be available for any person who has both of the following |
|---|
| 13 | 13 | | 1.13diagnoses documented in the person's assessment under section 256B.0911: |
|---|
| 14 | 14 | | 1.14 (1) a developmental disability; and |
|---|
| 15 | 15 | | 1.15 (2) type 1 diabetes. |
|---|
| 16 | 16 | | 1.16 (b) The amount of the exception must be an annualized amount equal to nine hours per |
|---|
| 17 | 17 | | 1.17day at the current rate for home care nursing provided by a registered nurse under the |
|---|
| 18 | 18 | | 1.18identified waiver program at the time of application for the budget exception under this |
|---|
| 19 | 19 | | 1.19subdivision. |
|---|
| 20 | 20 | | 1.20 EFFECTIVE DATE.This section is effective January 1, 2026, or upon federal approval, |
|---|
| 21 | 21 | | 1.21whichever is later. The commissioner of human services shall notify the revisor of statutes |
|---|
| 22 | 22 | | 1.22when federal approval is obtained. |
