                            1.1	A bill for an act​
1.2 relating to human services; establishing a consumer-directed community supports​
1.3 budget exception for persons with certain diagnoses; amending Minnesota Statutes​
1.4 2024, section 256B.4911, by adding a subdivision.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 256B.4911, is amended by adding a subdivision​
1.7to read:​
1.8 Subd. 4a.Budget exception for persons with developmental disabilities and type 1​
1.9diabetes.(a) The commissioner must establish a consumer-directed community supports​
1.10budget exception process for persons with both developmental disabilities and type 1 diabetes​
1.11in the home and community-based services waivers under sections 256B.092 and 256B.49.​
1.12This budget exception process must be available for any person who has both of the following​
1.13diagnoses documented in the person's assessment under section 256B.0911:​
1.14 (1) a developmental disability; and​
1.15 (2) type 1 diabetes.​
1.16 (b) The amount of the exception must be an annualized amount equal to nine hours per​
1.17day at the current rate for home care nursing provided by a registered nurse under the​
1.18identified waiver program at the time of application for the budget exception under this​
1.19subdivision.​
1.20 EFFECTIVE DATE.This section is effective January 1, 2026, or upon federal approval,​
1.21whichever is later. The commissioner of human services shall notify the revisor of statutes​
1.22when federal approval is obtained.​
