1.1 A bill for an act 1.2 relating to agriculture; defining cell-cultured meat and cell-cultured poultry; 1.3 requiring food labels to identify a product containing cell-cultured meat or 1.4 cell-cultured poultry; amending the definition of meat food product and poultry 1.5 food product to include cell-cultured meat and cell-cultured poultry; amending 1.6 Minnesota Statutes 2024, sections 31.01, by adding subdivisions; 31.12; 31.633; 1.7 31A.02, subdivision 10. 1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2024, section 31.01, is amended by adding a subdivision 1.10to read: 1.11 Subd. 33.Cell-cultured meat."Cell-cultured meat" means a meat food product grown 1.12using animal cell technology that extracts a small number of cells from a living animal and 1.13grows the cells in a controlled environment. 1.14 Sec. 2. Minnesota Statutes 2024, section 31.01, is amended by adding a subdivision to 1.15read: 1.16 Subd. 34.Cell-cultured poultry."Cell-cultured poultry" means a poultry food product 1.17grown using animal cell technology that extracts a small number of cells from a living 1.18animal and grows the cells in a controlled environment. 1.19 Sec. 3. No. 239NINETY-FOURTH SESSION (SENATE AUTHORS: DRAHEIM) OFFICIAL STATUSD-PGDATE Introduction and first reading01/16/2025 Referred to Agriculture, Veterans, Broadband and Rural Development 2.1shall be the duty of the commissioner, by rulings rules not inconsistent with law, to require 2.2that any article of food, or the package, receptacle, or container thereof, before it be sold, 2.3transported, used, offered for sale or transportation, or had in possession with intent to use, 2.4sell or transport within this state, shall be labeled, stamped, stenciled, marked, or branded 2.5in such manner as to plainly exhibit to the purchaser any or all of the following data or 2.6information: 2.7 (1) the percentages and true composition of such food article,; 2.8 (2) its quality, strength, and quantity,; 2.9 (3) the source of its manufacture or production or the person by or for whom the same 2.10is manufactured, produced, packed, or shipped; and 2.11 (4) if the product contains cell-cultured meat or cell-cultured poultry, then a statement 2.12that the food is cell-cultured meat or cell-cultured poultry. 2.13The commissioner shall also have authority to prescribe by such rulings rules the date on 2.14which the same shall take effect and be in force, and also the form, size, style, and wording 2.15of, and the place, time, method, means and manner of use of all such labels, stamps, stencils, 2.16brands, and markings, which rulings rules shall be made in the manner provided by law. 2.17Until such rulings are made and in effect the rulings heretofore made by the commissioner 2.18shall remain in full force and effect, except as otherwise prescribed by law. Any person 2.19who shall fail to comply with such ruling or rulings rules shall be guilty of a misdemeanor. 2.20 Sec. 4. Minnesota Statutes 2024, section 31.633, is amended to read: 2.21 31.633 MEAT OR POULTRY SUBSTITUTES; INDICATION ON MENU; 2.22PENALTIES. 2.23 Subdivision 1.Menu requirement Meat or poultry substitutes.Any restaurant, eating 2.24place, or other establishment serving meat or poultry in any form to the public that has any 2.25filler or meat or poultry substitute added to it or incorporated in it, shall clearly and 2.26prominently indicate on its menu or bill of fare the meat entrees that contain filler or meat 2.27or poultry substitutes. 2.28 Subd. 3.Cell-cultured meat or cell-cultured poultry.Any restaurant, eating place, or 2.29other establishment serving cell-cultured meat or cell-cultured poultry to the public must 2.30clearly and prominently indicate on its menu or bill of fare the menu items that contain 2.31cell-cultured meat or cell-cultured poultry. 2Sec. 4. 25-01893 as introduced01/06/25 REVISOR BD/HL 3.1 Sec. 5. Minnesota Statutes 2024, section 31A.02, subdivision 10, is amended to read: 3.2 Subd. 10.Meat food product; poultry food product."Meat food product" or "poultry 3.3food product" means a product usable as human food and made wholly or in part from meat 3.4or poultry or a portion of the carcass of cattle, sheep, swine, poultry, wild game or fowl, 3.5farmed Cervidae, as defined in section 35.153, subdivision 3, llamas, as defined in section 3.617.455, subdivision 2, Ratitae, as defined in section 17.453, subdivision 3, or goats. Meat 3.7food product includes cell-cultured meat as defined in section 31.01, subdivision 33, and 3.8poultry food product includes cell-cultured poultry as defined in section 31.01, subdivision 3.934. "Meat food product" or "poultry food product" does not include products which contain 3.10meat, poultry, or other portions of the carcasses of cattle, sheep, swine, wild game or fowl, 3.11farmed Cervidae, llamas, Ratitae, or goats only in a relatively small proportion or that 3.12historically have not been considered by consumers as products of the meat food industry, 3.13and which are exempted from definition as a meat food product or poultry food product by 3.14the commissioner under the conditions the commissioner prescribes to assure that the meat 3.15or other portions of carcasses contained in the products are not adulterated and that the 3.16products are not represented as meat food products or poultry food products. 3.17 "Meat food product," as applied to products of equines, has a meaning comparable to 3.18that for cattle, sheep, swine, wild game or fowl, farmed Cervidae, llamas, Ratitae, and goats. 3Sec. 5. 25-01893 as introduced01/06/25 REVISOR BD/HL
