55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 116.943, subdivision 8, is amended to read:​
77 1.7 Subd. 8.Exemptions.(a) This section does not apply to:​
88 1.8 (1) a product for which federal law governs the presence of PFAS in the product in a​
99 1.9manner that preempts state authority;​
1010 1.10 (2) a product regulated under section 325F.072 or 325F.075; or​
1111 1.11 (3) the sale or resale of a used product.​
1212 1.12 (b) Subdivisions 4 and 5 do not apply to a prosthetic or orthotic device or to any product​
1313 1.13that is a medical device or drug or that is otherwise used in a medical setting or in medical​
1414 1.14applications regulated by the United States Food and Drug Administration.​
1515 1.15 (c) An electrical, electronic, or mechanical part or motor incorporated into upholstered​
1616 1.16furniture or textile furnishing is exempt from prohibitions under subdivision 5 until January​
1717 1.171, 2032.​
1818 1.18 EFFECTIVE DATE.This section is effective the day following final enactment.​
