1.1 A bill for an act 1.2 relating to environment; exempting certain components in textile furnishings and 1.3 upholstered furniture from PFAS prohibitions; amending Minnesota Statutes 2024, 1.4 section 116.943, subdivision 8. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 116.943, subdivision 8, is amended to read: 1.7 Subd. 8.Exemptions.(a) This section does not apply to: 1.8 (1) a product for which federal law governs the presence of PFAS in the product in a 1.9manner that preempts state authority; 1.10 (2) a product regulated under section 325F.072 or 325F.075; or 1.11 (3) the sale or resale of a used product. 1.12 (b) Subdivisions 4 and 5 do not apply to a prosthetic or orthotic device or to any product 1.13that is a medical device or drug or that is otherwise used in a medical setting or in medical 1.14applications regulated by the United States Food and Drug Administration. 1.15 (c) An electrical, electronic, or mechanical part or motor incorporated into upholstered 1.16furniture or textile furnishing is exempt from prohibitions under subdivision 5 until January 1.171, 2032. 1.18 EFFECTIVE DATE.This section is effective the day following final enactment. 1Section 1. 25-04560 as introduced03/03/25 REVISOR CKM/DG SENATE STATE OF MINNESOTA S.F.
