1.1 A bill for an act 1.2 relating to public safety; ensuring that certain publicly funded state and local 1.3 institutions provide notice to United States Immigration and Customs Enforcement 1.4 when a suspected undocumented person is being housed in a facility under the 1.5 institution's control; amending Minnesota Statutes 2024, section 631.50. 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2024, section 631.50, is amended to read: 1.8 631.50 ALIEN INMATES OR MENTALLY ILL PERSONS; NOTICE TO UNITED 1.9STATES IMMIGRATION OFFICERS. 1.10 (a) When a person who is convicted of a felony or is found to be a person who is mentally 1.11ill is committed to the Minnesota Correctional Facility-Stillwater, the Minnesota Correctional 1.12Facility-St. Cloud custody of the commissioner of corrections, the a county jail, or any other 1.13state or county institution which is supported, wholly or in part, by public funds, the chief 1.14executive officer, sheriff, or other officer in charge of the state or county institution shall 1.15at once inquire into the nationality of the person. If it appears that the person is an 1.16undocumented alien, the officer shall immediately notify the United States immigration 1.17officer in charge of the district in which the correctional facility, jail, or other institution is 1.18located of (1) the date of the conviction and the reasons for crime for which the alien 1.19commitment was convicted, (2) the length of time for which committed, (3) the country of 1.20which the alien is a citizen, and (4) the date on which and the port at which the alien last 1.21entered the United States. 1.22 (b) When a person who is found to be either a person who has a mental illness and is 1.23dangerous to the public, as defined in section 253B.02, subdivision 17, or a person who 1Section 1. 25-01465 as introduced12/31/24 REVISOR KLL/BM SENATE STATE OF MINNESOTA S.F. INMATE IMMIGRATION STATUS REVIEW. 2.11 By September 1, 2025, the commissioner of corrections, chief executive officer, sheriff, 2.12or other officer in charge of a state or county institution which is supported, wholly or in 2.13part, by public funds that houses persons serving a felony sentence shall inquire into the 2.14nationality of each person in their custody who is serving a felony sentence. If it appears 2.15that the person is an undocumented alien, the officer shall immediately notify the United 2.16States immigration officer in charge of the district in which the correctional facility, jail, or 2.17other institution is located of (1) the date of the conviction and the crime for which the alien 2.18was convicted, (2) the length of time for which the alien is committed, (3) the country of 2.19which the alien is a citizen, and (4) the date on which and the port at which the alien last 2.20entered the United States. 2Sec. 2. 25-01465 as introduced12/31/24 REVISOR KLL/BM
