6 | 6 | | 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

7 | 7 | | 1.7 Section 1. Minnesota Statutes 2024, section 609.19, subdivision 2, is amended to read: |
---|
8 | 8 | | 1.8 Subd. 2.Unintentional murders.Whoever does either of the following is guilty of |
---|
9 | 9 | | 1.9unintentional murder in the second degree and may be sentenced to imprisonment for not |
---|
10 | 10 | | 1.10more than 40 years: |
---|
11 | 11 | | 1.11 (1) causes the death of a human being, without intent to effect the death of any person, |
---|
12 | 12 | | 1.12while committing or attempting to commit a felony offense other than criminal sexual |
---|
13 | 13 | | 1.13conduct in the first or second degree with force or violence or a drive-by shooting; or |
---|
14 | 14 | | 1.14 (2) causes the death of a human being without intent to effect the death of any person, |
---|
15 | 15 | | 1.15while intentionally inflicting or attempting to inflict bodily harm upon the victim, when the |
---|
16 | 16 | | 1.16perpetrator is restrained under an order for protection and the victim is a person designated |
---|
17 | 17 | | 1.17to receive protection under the order. As used in this clause, "order for protection" includes |
---|
18 | 18 | | 1.18an order for protection issued under chapter 518B; a harassment restraining order issued |
---|
19 | 19 | | 1.19under section 609.748; a court order setting conditions of pretrial release or conditions of |
---|
20 | 20 | | 1.20a criminal sentence or juvenile court disposition; a restraining order issued in a marriage |
---|
21 | 21 | | 1.21dissolution action; and any order issued by a court of another state or of, the United States, |
---|
22 | 22 | | 1.22the District of Columbia, Tribal Lands, United States territories, Canada, or a Canadian |
---|
23 | 23 | | 1.23province that is similar to any of these orders. |
