1.1 A bill for an act 1.2 relating to public safety; amending the offense of unintentional murder in the 1.3 second degree to include cases involving the violation of protective orders issued 1.4 in certain additional jurisdictions; amending Minnesota Statutes 2024, section 1.5 609.19, subdivision 2. 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2024, section 609.19, subdivision 2, is amended to read: 1.8 Subd. 2.Unintentional murders.Whoever does either of the following is guilty of 1.9unintentional murder in the second degree and may be sentenced to imprisonment for not 1.10more than 40 years: 1.11 (1) causes the death of a human being, without intent to effect the death of any person, 1.12while committing or attempting to commit a felony offense other than criminal sexual 1.13conduct in the first or second degree with force or violence or a drive-by shooting; or 1.14 (2) causes the death of a human being without intent to effect the death of any person, 1.15while intentionally inflicting or attempting to inflict bodily harm upon the victim, when the 1.16perpetrator is restrained under an order for protection and the victim is a person designated 1.17to receive protection under the order. As used in this clause, "order for protection" includes 1.18an order for protection issued under chapter 518B; a harassment restraining order issued 1.19under section 609.748; a court order setting conditions of pretrial release or conditions of 1.20a criminal sentence or juvenile court disposition; a restraining order issued in a marriage 1.21dissolution action; and any order issued by a court of another state or of, the United States, 1.22the District of Columbia, Tribal Lands, United States territories, Canada, or a Canadian 1.23province that is similar to any of these orders. 1Section 1. 25-00630 as introduced11/15/24 REVISOR KLL/VJ SENATE STATE OF MINNESOTA S.F.
