newsectionsrelatingtoalcoholicbeverages.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections311.280,311.300,and311.332,RSMo,arerepealedandthree
2newsectionsenactedinlieuthereof,tobeknownassections311.280,311.300,and311.332,
3toreadasfollows:
311.280.1.Itshallbeunlawfulforanypersoninthisstateholdingaretailliquor
2licensetopurchaseanyintoxicatingliquorexceptfrom,byorthroughadulylicensed
3wholesaleliquordealerinthisstate.Itshallbeunlawfulforsuchretailliquordealertosellor
4offerforsaleanyintoxicatingliquorpurchasedinviolationoftheprovisionsofthissection.
5Anypersonviolatinganyprovisionofthissectionshallbedeemedguiltyofamisdemeanor.
6 2.Anyretailerlicensedpursuanttothischaptershallnot:
7 (1)Sellintoxicatingliquorwithanalcoholcontentoflessthanfivepercentbyweight
8totheconsumerinanoriginalcartonreceivedfromthewholesalerthathasbeenmutilated,
9tornapart,orcutapart;[or]
10 (2)Repackageintoxicatingliquorwithanalcoholcontentoflessthanfivepercentby
11weightinamannermisleadingtotheconsumerorthatresultsinrequiredlabelingbeing
12omittedorobscured; or
13 (3)Requireanysealthathasbeenaffixedtoabottleorpackageofintoxicating
14liquortobebrokenortornbeforeaconsumerwhopurchasestheintoxicatingliquoris
15permittedtocarryouttheintoxicatingliquorfromthepremisesoftheretailer.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 311.300.1.Exceptasprovidedinthissection,nopersonundertheageoftwenty-one
2yearsshallsellorassistinthesaleordispensingofintoxicatingliquor.
3 2.Inanyplaceofbusinesslicensedinaccordancewithsection311.200,personsat
4leasteighteenyearsofagemaystock,arrangedisplays,operatethecashregisterorscanner
5connectedtoacashregisterandacceptpaymentfor,andsackforcarryout,intoxicatingliquor.
6Personsatleasteighteenyearsofagemaycarryoutintoxicatingliquortoapurchaser's
7vehicleinaparkinglotadjacenttothelicensedpremises,solongasthesalewasmade
8insidethelicensedbusinesspremisesincompliancewiththischaptertoensurethe
9purchaserisatleasttheageoftwenty-oneyearsorolder.Deliveryofintoxicatingliquor
10awayfromthelicensedbusinesspremisescannotbeperformedbyanyoneundertheageof
11twenty-oneyears.Anylicenseewhoemploysanypersonundertheageoftwenty-oneyears,
12asauthorizedbythissubsection,shall,whenatleastfiftypercentofthelicensee'sgrosssales
13doesnotconsistofnonalcoholicsales,haveanemployeetwenty-oneyearsofageorolderon
14thelicensedpremisesduringallhoursofoperation.
15 3.Inanydistillery,warehouse,wholesaledistributorship,orsimilarplaceofbusiness
16whichstoresordistributesintoxicatingliquorbutwhichdoesnotsellintoxicatingliquorat
17retail,personsatleasteighteenyearsofagemaybeemployedandtheirdutiesmayinclude
18thehandlingofintoxicatingliquorforallpurposesexceptconsumption,saleatretail,or
19dispensingforconsumptionorsaleatretail.
20 4.Anywholesalerlicensedpursuanttothischaptermayemploypersonsofatleast
21eighteenyearsofageto:
22 (1)Rotate,stockandarrangedisplaysatretailestablishmentslicensedtosell
23intoxicatingliquor;and
24 (2)Unloaddeliveryvehiclesandtransferintoxicatingliquorintoretaillicensed
25premisesifsuchpersonsaresupervisedbyadeliveryvehicledriverwhoistwenty-oneyears
26ofageorolder.
27 5.Personseighteenyearsofageoroldermay,whenactinginthecapacityofawaiter
28orwaitress,acceptpaymentfororserveintoxicatingliquorinplacesofbusinesswhichsell
29foodforconsumptiononthepremisesifatleastfiftypercentofallsalesinthoseplaces
30consistsoffood;providedthatnothinginthissectionshallauthorizepersonsundertwenty-
31oneyearsofagetomixorserveacrossthebarintoxicatingbeverages.
311.332.1.Itshallbeunlawfulforanywholesalerlicensedtosellintoxicatingliquor
2andwinecontainingalcoholinexcessoffivepercentbyweighttopersonsdulylicensedto
3sellsuchintoxicatingliquorandwineatretail,todiscriminatebetweenretailersorinfavorof
4oragainstanyretailerorgroupofretailers,directlyorindirectly,inprice,indiscountsfor
5timeofpayment,orindiscountsonquantityofmerchandisesold,ortograntdirectlyor
6indirectlyanydiscount,rebate,freegoods,allowanceorotherinducement,exceptinga
HCSHB1489	2 7discountnotinexcessofonepercentforquantityofliquorandwine,andadiscountnotin
8excessofonepercentforpaymentonorbeforeacertaindate.Thedeliveryofmanufacturer
9rebatecouponsbywholesalerstoretailersshallnotbeaviolationofthissubsection.
10 2.Manufacturersorwholesalersshallbepermittedtodonateordeliverorcausetobe
11deliveredbeer,wine,distilledspirits,orbrandyfornonresalepurposestoanyunlicensed
12personoranylicensedretaildealerwhoisacharitableorreligiousorganizationasdefinedin
13section313.005oreducationalinstitution,atanylocationorlicensedpremises,provided,
14suchbeer,wine,distilledspirits,orbrandyisunrelatedtotheorganization'sorinstitution's
15licensedretailoperation.Achargeforadmissiontoaneventoractivityatwhichbeer,wine,
16distilledspirits,orbrandyisavailablewithoutseparatechargeshallnotconstituteresalefor
17thepurposesofthissubsection.Wineusedinreligiousceremoniesmaybesoldby
18wholesalerstoareligiousorganizationasdefinedinsection313.005.Anymanufactureror
19wholesalerprovidingnonresaleitemsshallkeeparecordofanydeliveriesmadepursuantto
20thissubsection.
21 3.Manufacturers,wholesalers,retailersandunlicensedpersonsmaydonatebeer,
22wine, distilledspirits,orbrandyintheoriginalpackagetoacharitableorreligious
23organizationasdefinedinsection313.005oreducationalinstitutionforthesolepurposeof
24beingauctionedbytheorganizationorinstitutionforfund-raisingpurposes,providedthe
25[auctiontakesplaceonaretail-licensedpremisesandall]proceedsfromthesalegointoa
26fundofanorganizationorinstitutionthatisunrelatedtoanylicensedretailoperation.
