10fingerprints,photograph,andifavailable,anyotheruniquebiometricidentificationcollected, 11charges,appropriatechargecodes,anddescriptionsofallpersonswhoarearrestedforsuch 12offensesonstandardfingerprintformssuppliedorapprovedbythehighwaypatrolor 13electronicallyinaformatandmannerapprovedbythehighwaypatrolandincompliancewith 14thestandardssetbytheFederalBureauofInvestigationinitsAutomatedFingerprint 15IdentificationSystemoritssuccessorprogram.Allsuchagenciesshallalsonotifythecentral 16repositoryofalldecisionsnottorefersucharrestsforprosecution.Anagencymakingsuch 17arrestsmayenterintoarrangementswithotherlawenforcementagenciesforthepurposeof 18furnishingwithoutunduedelaysuchfingerprints,photograph,andifavailable,anyother 19uniquebiometricidentificationcollected,charges,appropriatechargecodes,anddescriptions 20tothecentralrepositoryuponitsbehalf. 21 3.Ininstanceswhereanindividuallessthan[seventeen] eighteenyearsofageand 22notcurrentlycertifiedasanadultistakenintocustodyforanoffensewhichwouldbeafelony 23ifcommittedbyanadult,thearrestingofficershalltakefingerprintsforthecentralrepository. 24Thesefingerprintsshallbetakenonfingerprintcardssuppliedbyorapprovedbythehighway 25patrolortransmittedelectronicallyinaformatandmannerapprovedbythehighwaypatrol 26andincompliancewiththestandardssetbytheFederalBureauofInvestigationinits 27AutomatedFingerprintIdentificationSystemoritssuccessorprogram.Thefingerprintcards 28shallbesoconstructedthatthenameofthejuvenileshouldnotbemadeavailabletothe 29centralrepository.Theindividual'snameandtheuniquenumberassociatedwiththe 30fingerprintsandotherpertinentinformationshallbeprovidedtothecourtofjurisdictionby 31theagencytakingthejuvenileintocustody.Thejuvenile'sfingerprintsandotherinformation 32shallbeforwardedtothecentralrepositoryandthecourtswithoutunduedelay.The 33fingerprintinformationfromthecardshallbecapturedandstoredintheautomated 34fingerprintidentificationsystemoperatedbythecentralrepository.Intheeventthe 35fingerprintsarefoundtomatchothertenprintsorunsolvedlatentprints,thecentralrepository 36shallnotifythesubmittingagencywhoshallnotifythecourtofjurisdictionasperlocal 37agreement.Undersection211.031,ininstanceswhereajuvenileoverfifteenandone-half 38yearsofageisallegedtohaveviolatedastateormunicipaltrafficordinanceorregulation, 39whichdoesnotconstituteafelony,andthejuvenilecourtdoesnothavejurisdiction,the 40juvenileshallnotbefingerprintedunlesscertifiedasanadult. 41 4.Uponcertificationoftheindividualasanadult,thecertifyingcourtshallordera 42lawenforcementagencytoimmediatelyfingerprintandphotographtheindividualand 43certificationpaperswillbeforwardedtotheappropriatelawenforcementagencywiththe 44orderforfingerprinting.Thelawenforcementagencyshallsubmitsuchfingerprints, HCSHB1559 4 45photograph,andcertificationpaperstothecentralrepositorywithinfifteendaysandshall 46furnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecutingattorney 47orthecircuitattorneyofacitynotwithinacountyandtotheclerkofthecourtorderingthe 48subjectfingerprinted.Ifthejuvenileisacquittedofthecrimeandisnolongercertifiedasan 49adult,theprosecutingattorneyshallnotifywithinfifteendaysthecentralrepositoryofthe 50changeofstatusofthejuvenile.Recordsofachildwhohasbeenfingerprintedand 15 (5)Theprograminformseachparentthattheoperationoftheprogramisnot 16regulatedbylicensingrequirements; 17 (6)Theprogramprovidesaprocesstoreceiveandresolveparentalcomplaints;and 18 (7)Theprogramconductsnationalcriminalbackgroundchecksforallemployeesand 19volunteerswhoworkwithchildren,aswellasscreeningunderthefamilycaresafetyregistry 20asprovidedinsections210.900to210.936. 210.482.1.Iftheemergencyplacementofachildinaprivatehomeisnecessarydue 2totheunexpectedabsenceofthechild'sparents,legalguardian,orcustodian,thejuvenile 3courtorchildren'sdivision: 4 (1)Mayrequestthatalocalorstatelawenforcementagencyorjuvenileofficer, 5subjecttoanyrequiredfederalauthorization,immediatelyconductaname-basedcriminal 6historyrecordchecktoincludefullordersofprotectionandoutstandingwarrantsofeach 7personovertheageofseventeenresidinginthehomebyusingtheMissouriuniformlaw HCSHB1559 8 8enforcementsystem(MULES)andtheNationalCrimeInformationCentertoaccessthe 9InterstateIdentificationIndexmaintainedbytheFederalBureauofInvestigation;and 10 (2)Shalldetermineor,inthecaseofthejuvenilecourt,shallrequestthedivisionto 11determinewhetheranypersonovertheageofseventeenyearsresidinginthehomeislisted 12onthechildabuseandneglectregistry.Foranychildrenlessthan[seventeen] eighteenyears 13ofageresidinginthehome,thechildren'sdivisionshallinquireofthepersonwithwhoman 14emergencyplacementofachildwillbemadewhetheranychildrenlessthan[seventeen] 15eighteenyearsofageresidinginthehomehaveeverbeencertifiedasanadultandconvicted 16oforpledguiltyornolocontenderetoanycrime. 17 2.Ifaname-basedsearchhasbeenconductedpursuanttosubsection1ofthissection, 18withinfifteencalendardaysaftertheemergencyplacementofthechildintheprivatehome, 19andiftheprivatehomehasnotpreviouslybeenapprovedasafosteroradoptivehome,all 20personsovertheageofseventeenresidinginthehomeandallchildrenlessthan[seventeen] 21eighteenresidinginthehomewhothedivisionhasdeterminedhavebeencertifiedasanadult 22forthecommissionofacrimeshallreporttoalocallawenforcementagencyforthepurpose 23ofprovidingfingerprintsandaccompanyingfees,pursuanttosections43.530and43.540. 24Resultsofthechecksshallbeprovidedtothejuvenilecourtorchildren'sdivisionoffice 25requestingsuchinformation.Anychildplacedinemergencyplacementinaprivatehome 26shallberemovedimmediatelyifanypersonresidinginthehomefailstoprovidefingerprints 27afterbeingrequestedtodoso,unlessthepersonrefusingtoprovidefingerprintsceasesto 28resideintheprivatehome. 29 3.Iftheplacementofachildisdeniedasaresultofaname-basedcriminalhistory 30checkandthedenialiscontested,allpersonsovertheageofseventeenresidinginthehome 31andallchildrenlessthan[seventeen] eighteenyearsofageresidinginthehomewhothe 32divisionhasdeterminedhavebeencertifiedasanadultforthecommissionofacrimeshall, 33withinfifteencalendardays,submittothejuvenilecourtorthechildren'sdivisionfingerprints 34inthesamemannerdescribedinsubsection2ofthissection,accompanyingfees,andwritten 35permissionauthorizingthejuvenilecourtorthechildren'sdivisiontoforwardthefingerprints 36tothestatecriminalrecordrepositoryforsubmissiontotheFederalBureauofInvestigation. 37 4.Nopersonwhosubmitsfingerprintsunderthissectionshallberequiredtosubmit 38additionalfingerprintsunderthissectionorsection210.487unlesstheoriginalfingerprints 39retainedbythedivisionarelostordestroyed. 40 5.Subjecttoappropriation,thetotalcostoffingerprintingrequiredbythissection 41maybepaidbythestate,includingreimbursementofpersonsincurringfingerprintingcosts 42underthissection. 43 6.Forthepurposesofthissection,"emergencyplacement"referstothoselimited 44instanceswhenthejuvenilecourtorchildren'sdivisionisplacingachildinthehomeof HCSHB1559 9 45privateindividuals,includingneighbors,friends,orrelatives,asaresultofasudden 46unavailabilityofthechild'sprimarycaretaker. 210.487.1.Whenconductinginvestigationsofpersonsforthepurposeoffoster 2parentlicensing,thedivisionshall: 3 (1)Conductasearchforallpersonsovertheageofseventeenintheapplicant's 4householdandforanychildlessthan[seventeen] eighteenyearsofageresidinginthe 5applicant'shomewhothedivisionhasdeterminedhasbeencertifiedasanadultforthe 6commissionofacrimeforevidenceoffullordersofprotection.Theofficeofstatecourts 7administratorshallallowaccesstotheautomatedcourtinformationsystembythedivision. 8Theclerkofeachcourtcontactedbythedivisionshallprovidethedivisioninformationwithin 9tendaysofarequest; 10 (2)Obtainfingerprintsforanypersonovertheageofseventeenintheapplicant's 11householdandforanychildlessthan[seventeen] eighteenyearsofageresidinginthe 12applicant'shomewhothedivisionhasdeterminedhasbeencertifiedasanadultforthe 13commissionofacrimeinthesamemannersetforthinsubsection2ofsection210.482.The 14highwaypatrolshallassistthedivisionandprovidethecriminalfingerprintbackground 15information,uponrequest,underandinaccordancewiththeprovisionsofsection43.540;and 16 (3)Determinewhetheranypersonovertheageofseventeenresidinginthehomeand 17anychildlessthan[seventeen] eighteenyearsofageresidingintheapplicant'shomewhothe 18divisionhasdeterminedhasbeencertifiedasanadultforthecommissionofacrimeislisted 19onthechildabuseandneglectregistry.Foranychildrenlessthan[seventeen] eighteenyears 20ofageresidingintheapplicant'shome,thechildren'sdivisionshallinquireoftheapplicant 21whetheranychildrenlessthan[seventeen] eighteenyearsofageresidinginthehomehave 22everbeencertifiedasanadultandbeenconvictedoforpledguiltyornolocontenderetoany 23crime. 24 2.Aftertheinitialinvestigationiscompletedundersubsection1ofthissection: 25 (1)Nopersonwhosubmitsfingerprintsundersubsection1ofthissectionorsection 26210.482shallberequiredtosubmitadditionalfingerprintsunderthissectionorsection 27210.482unlesstheoriginalfingerprintsretainedbythedivisionarelostordestroyed; 28 (2)Thehighwaypatrolshallprovideongoingelectronicupdatestocriminalhistory 29backgroundchecksofthosepersonspreviouslysubmittedaspartofthelicensingorapproval 30processundersubsection1ofthissection.Ongoingelectronicupdatesforsuchpersonsand 31forthoseintheirhouseholdsshallterminatewhensuchpersonsceasetobeapplicantor 32licensedfosterparents;and 33 (3)Thechildren'sdivisionandthedepartmentofhealthandseniorservicesmay 34waivetherequirementforafingerprintbackgroundcheckforanysubsequentrecertification. HCSHB1559 10 35 3.Subjecttoappropriation,thetotalcostoffingerprintingrequiredbythissection 36maybepaidbythestate,includingreimbursementofpersonsincurringfingerprintingcosts 37underthissection. 38 4.Thedivisionmaymakearrangementswithotherexecutivebranchagenciesto 39obtainanyinvestigativebackgroundinformation. 40 5.Thedivisionmaypromulgaterulesthatarenecessarytoimplementtheprovisions 41ofthissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 42createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 43withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 44Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 45generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 46disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 47rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2004,shallbeinvalid 48andvoid. 210.762.1.(1)Whenachildistakenintocustodybyajuvenileofficerorlaw 2enforcementofficialundersubdivision(1)ofsubsection1ofsection211.031andinitially 3placedwiththedivision,thedivisionmaymakeatemporaryplacementandshallarrangefor 4afamilysupportteammeetingpriortoorwithintwenty-fourhoursfollowingtheprotective 5custodyhearingheldundersection211.032.Afterachildisinthedivision'scustodyanda 6temporaryplacementhasbeenmade,thedivisionshallarrangeanadditionalfamilysupport 7teammeetingpriortotakinganyactionrelatingtotheplacementofsuchchild;exceptthat, 8whenthewelfareofachildinthecustodyofthedivisionrequiresanimmediateoremergency 9changeofplacement,thedivisionmaymakeatemporaryplacementandshallschedulea 10familysupportteammeetingwithinseventy-twohours.Therequirementforafamilysupport 11teammeetingshallnotapplywhentheparenthasconsentedinwritingtotheterminationof 12hisorherparentalrightsinconjunctionwithaplacementinalicensedchild-placingagency 13undersubsection6ofsection453.010. 14 (2)Anagencyorplacementproviderwithlegalcustodyofachildshallensurea 15missingchildreportisfiledoncetheagencyorplacementproviderdeterminesthata 16childintheagency'sorplacementprovider'scustodyismissing.Withinseventy-two 17hoursofamissingchildreportbeingfiledforachildplacedinanauthorizedagencyor 18fostercareorwithinseventy-twohoursofanauthorizedagencyorfostercarebeing 19notifiedthatachildunderitscustodyismissing,whichevereventfirstoccurs,afamily 20supportteammeetingshallbeheldtodiscussthewhereaboutsofthemissingchildand 21todiscusstheinitialdecisionregardingthecustodyandplacementofthemissingchild 22oncethechildisfound.Ifthemissingchildisbroughtbackintocustody,anotherfamily 23supportteammeetingshallbeheldasprovidedunderthissection.Anyagencyor HCSHB1559 11 24placementproviderwithlegalcustodyofachildwhogoesmissingthatfailstocomply 25withtheprovisionsunderthissubdivisionshallbeliabletotheinjuredparty,which 26includesthemissingchild,parent,fosterparent,orlegalguardianofthemissingchild, 27andthestateofMissouri,inanactionatlawandsubjecttoacivilpenaltyoffifty 28thousanddollarsperoccurrence. 29 2.Theparents,thelegalcounselfortheparents,thefosterparents,thelegalguardian 30orcustodianofthechild,theguardianadlitemforthechild,andthevolunteeradvocate,and 31anydesigneeoftheparentthathaswrittenauthorizationshallbenotifiedandinvitedto 32participateinallfamilysupportteammeetings.Thefamilysupportteammeetingmay 33includesuchotherpersonswhoseattendanceatthemeetingmayassisttheteaminmaking 34appropriatedecisionsinthebestinterestsofthechild.Ifthedivisionfindsthatitisnotinthe 35bestinterestofachildtobeplacedwithrelatives,thedivisionshallmakespecificfindingsin 36thedivision'sreportdetailingthereasonswhythebestinterestsofthechildnecessitate 37placementofthechildwithpersonsotherthanrelatives. 38 3.Thedivisionshallusetheformcreatedinsubsection2ofsection210.147tobe 39signedupontheconclusionofthemeetingpursuanttosubsection1ofthissectionconfirming 40thatallinvolvedpartiesareawareoftheteam'sdecisionregardingthecustodyandplacement 41ofthechild.Anydissentingviewsmustberecordedandattestedtoonsuchform. 42 4.Thecasemanagershallberesponsibleforincludingsuchformwiththecase 43recordsofthechild. 44 5.Asusedinthissection,"familysupportteam"meansateamwhomayconsist 45ofayouthiftheyouthistwelveyearsofageorolder,parents,legalcounselforthe 46parents,resourceproviders,thelegalguardianforthechild,thejuvenileofficer,the 47guardianadlitem,thecourtappointedspecialadvocate,uptotwoyouth-chosen 48advocatesforayouthtwelveyearsofageorolder,andindividualsinvitedbythe 49parents.Theteammeetsforthepurposeofdeterminingthefollowing: 50 (1)Thesafetyofthechild; 51 (2)Acomprehensivevisitationplanforparents,siblings,andfamilymembers; 52 (3)Serviceandtreatmentneeds; 53 (4)Theneedforplacementanddevelopingaplanforreunificationorother 54permanencyoptions,includingaprojecteddateforpermanency; 55 (5)Theappropriateplacementofthechild; 56 (6)Thechild'saccessandopportunitiesfornormalcyactivitiesbasedonthe 57reasonableandprudentparentingstandard; 58 (7)Aneducationalplanforthechild; 59 (8)Thecaseplan,whichincludesestablishingandrevisingthecaseplan;and HCSHB1559 12 60 (9)Compliancewiththecaseplanandprogresstowardalleviatingormitigating 61thecausesnecessitatingplacementinfostercare. 210.795.Acaseworkershallnotifyajuvenileofficerifachildgoesmissingoris 2suspectedofbeingontherun.Oncethejuvenileofficerisnotified,theofficershallfile 3withthecourtanoticeinthechild'scasefilethatstatesthechildismissingandinclude 4anyotherrelevantinformation,whichshallincludethemissingchildreport.Ifthe 5missingchildisfound,thejuvenileofficershallfilewiththecourtanoticeinthechild's 6casefilethatthechildhasbeenfoundandincludeanyotherrelevantinformation. 217.343.Offenderswhoareyoungerthan[seventeen] eighteenyearsofageandhave 2beenadjudicatedasanadultshallbeemancipatedforthepurposeofdecisionmakingand 3participationinalldepartmentprogramsandservices,includingbutnotlimitedtomedical 4care,mentalhealthcare,treatmentprograms,educationalprograms,workassignments,and 5rehabilitativeprograms. 217.690.1.Allreleasesorparolesshallissueuponorderoftheparoleboard,duly 2adopted. 3 2.Beforeorderingtheparoleofanyoffender,theparoleboardshallconducta 4validatedriskandneedsassessmentandevaluatethecaseundertherulesgoverningparole 5thatarepromulgatedbytheparoleboard.Theparoleboardshallthenhavetheoffender 6appearbeforeahearingpanelandshallconductapersonalinterviewwithhimorher,unless 7waivedbytheoffender,oriftheguidelinesindicatetheoffendermaybeparoledwithoutneed 8foraninterview.Theguidelinesandrulesshallnotallowforthewaiverofahearingifa 9victimrequestsahearing.Theappearanceorpresencemayoccurbymeansofa 10videoconferenceatthediscretionoftheparoleboard.Aparolemaybeorderedforthebest 11interestofsocietywhenthereisareasonableprobability,basedontheriskassessmentand 12indicatorsofreleasereadiness,thatthepersoncanbesupervisedunderparolesupervisionand 13successfullyreintegratedintothecommunity,notasanawardofclemency;itshallnotbe 14consideredareductionofsentenceorapardon.Everyoffenderwhileonparoleshallremain 15inthelegalcustodyofthedepartmentbutshallbesubjecttotheordersoftheparoleboard. 16 3.Thedivisionofprobationandparolehasdiscretionaryauthoritytorequirethe 17paymentofafee,nottoexceedsixtydollarspermonth,fromeveryoffenderplacedunder 18divisionsupervisiononprobation,parole,orconditionalrelease,towaiveallorpartofany 19fee,tosanctionoffendersforwillfulnonpaymentoffees,andtocontractwithaprivateentity 20forfeecollectionsservices.Allfeescollectedshallbedepositedintheinmatefund 21establishedinsection217.430.Feescollectedmaybeusedtopaythecostsofcontracted 22collectionsservices.Thefeescollectedmayotherwisebeusedtoprovidecommunity 23correctionsandinterventionservicesforoffenders.Suchservicesincludesubstanceabuse 24assessmentandtreatment,mentalhealthassessmentandtreatment,electronicmonitoring HCSHB1559 13 25services,residentialfacilitiesservices,employmentplacementservices,andotheroffender 26communitycorrectionsorinterventionservicesdesignatedbythedivisionofprobationand 27paroletoassistoffenderstosuccessfullycompleteprobation,parole,orconditionalrelease. 28Thedivisionofprobationandparoleshalladoptrulesnotinconsistentwithlaw,inaccordance 29withsection217.040,withrespecttosanctioningoffendersandwithrespecttoestablishing, 30waiving,collecting,andusingfees. 31 4.Theparoleboardshalladoptrulesnotinconsistentwithlaw,inaccordancewith 32section217.040,withrespecttotheeligibilityofoffendersforparole,theconductofparole 33hearingsorconditionstobeimposeduponparoledoffenders.Wheneveranorderforparole 34isissueditshallrecitetheconditionsofsuchparole. 35 5.Whenconsideringparoleforanoffenderwithconsecutivesentences,theminimum 36termforeligibilityforparoleshallbecalculatedbyaddingtheminimumtermsforparole 37eligibilityforeachoftheconsecutivesentences,excepttheminimumtermforparole 38eligibilityshallnotexceedtheminimumtermforparoleeligibilityforanordinarylife 39sentence. 40 6.Anyoffendersentencedtoatermofimprisonmentamountingtofifteenyearsor 41moreormultipletermsofimprisonmentthat,takentogether,amounttofifteenormoreyears 42whowasundereighteenyearsofageatthetimeofthecommissionoftheoffenseoroffenses 43maybeeligibleforparoleafterservingfifteenyearsofincarceration,regardlessofwhether 44thecaseisfinalforthepurposesofappeal,andmaybeeligibleforreconsiderationhearingsin 45accordancewithregulationspromulgatedbytheparoleboard. 46 7.Theprovisionsofsubsection6ofthissectionshallnotapplytoanoffenderfound 47guiltyofmurderinthefirstdegreeorcapitalmurderwhowasundereighteenyearsofage 48whentheoffendercommittedtheoffenseoroffenseswhomaybefoundineligibleforparole 49orwhoseparoleeligibilitymaybecontrolledbysection558.047or565.033. 50 8.Anyoffenderunderasentenceforfirstdegreemurderwhohasbeendeniedrelease 51onparoleafteraparolehearingshallnotbeeligibleforanotherparolehearinguntilatleast 52threeyearsfromthemonthoftheparoledenial;however,thissubsectionshallnotpreventa 53releasepursuanttosubsection4ofsection558.011. 54 9.Avictimwhohasrequestedanopportunitytobeheardshallreceivenoticethatthe 55paroleboardisconductinganassessmentoftheoffender'sriskandreadinessforreleaseand 56thatthevictim'sinputwillbeparticularlyhelpfulwhenitpertainstosafetyconcernsand 57specificprotectivemeasuresthatmaybebeneficialtothevictimshouldtheoffenderbe 58grantedrelease. 59 10.Parolehearingsshall,ataminimum,containthefollowingprocedures: 60 (1)Thevictimorpersonrepresentingthevictimwhoattendsahearingmaybe 61accompaniedbyoneotherperson; HCSHB1559 14 62 (2)Thevictimorpersonrepresentingthevictimwhoattendsahearingshallhavethe 63optionofgivingtestimonyinthepresenceoftheinmateortothehearingpanelwithoutthe 64inmatebeingpresent; 65 (3)Thevictimorpersonrepresentingthevictimmaycallorwritetheparoleboard 66ratherthanattendthehearing; 67 (4)Thevictimorpersonrepresentingthevictimmayhaveapersonalmeetingwitha 68paroleboardmemberattheparoleboard'scentraloffice; 69 (5)Thejudge,prosecutingattorneyorcircuitattorneyandarepresentativeofthe 70locallawenforcementagencyinvestigatingthecrimeshallbeallowedtoattendthehearingor 71provideinformationtothehearingpanelinregardtotheparoleconsideration;and 72 (6)Theparoleboardshallevaluateinformationlistedinthejuvenilesexoffender 73registrypursuanttosection211.425,providedtheoffenderisbetweentheagesof[seventeen] 74eighteenandtwenty-one,asitimpactsthesafetyofthecommunity. 75 11.Theparoleboardshallnotifyanypersonoftheresultsofaparoleeligibility 76hearingifthepersonindicatestotheparoleboardadesiretobenotified. 77 12.Theparoleboardmay,atitsdiscretion,requireanyoffenderseekingparoleto 78meetcertainconditionsduringthetermofthatparolesolongassaidconditionsarenotillegal 79orimpossiblefortheoffendertoperform.Theseconditionsmayincludeanamountof 80restitutiontothestateforthecostofthatoffender'sincarceration. 81 13.Specialparoleconditionsshallberesponsivetotheassessedriskandneedsofthe 82offenderortheneedforextraordinarysupervision,suchaselectronicmonitoring.Theparole 83boardshalladoptrulestominimizetheconditionsplacedonlow-riskcases,tofrontload 84conditionsuponrelease,andtorequirethemodificationandreductionofconditionsbasedon 85theperson'scontinuingstabilityinthecommunity.Paroleboardrulesshallpermitparole 86conditionstobemodifiedbyparoleofficerswithreviewandapprovalbysupervisors. 87 14.Nothingcontainedinthissectionshallbeconstruedtorequirethereleaseofan 88offenderonparolenortoreducethesentenceofanoffenderheretoforecommitted. 89 15.BeginningJanuary1,2001,theparoleboardshallnotorderaparoleunlessthe 90offenderhasobtainedahighschooldiplomaoritsequivalent,orunlesstheparoleboardis 91satisfiedthattheoffender,whilecommittedtothecustodyofthedepartment,hasmadean 92honestgood-faithefforttoobtainahighschooldiplomaoritsequivalent;providedthatthe 93directormaywaivethisrequirementbycertifyinginwritingtotheparoleboardthatthe 94offenderhasactivelyparticipatedinmandatoryeducationprogramsorisacademicallyunable 95toobtainahighschooldiplomaoritsequivalent. 96 16.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 97createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 98withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. HCSHB1559 15 99Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 100generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 101disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 102rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2005,shallbeinvalid 103andvoid. 311.320.1.Anypersonoftheageof[seventeen] eighteenyearsandundertheageof 2twenty-oneyearswhoshallrepresentthathehasattainedtheageoftwenty-oneyearsforthe 3purposeofpurchasing,askingfororinanywayreceivinganyintoxicatingliquor,exceptin 4casesauthorizedbylaw,shalluponconvictionbedeemedguiltyofamisdemeanor.Any 5personundertheageof[seventeen] eighteenyearswhoshallrepresentthathehasattained 6theageoftwenty-oneyearsforthepurposeofpurchasing,askingfororinanywayreceiving 7anyintoxicatingliquor,exceptincasesauthorizedbylaw,maybeconsideredadelinquent 8childandmaybedealtwithinaccordancewiththeprovisionsofchapter211. 9 2.Inadditiontoanyotherpenaltiesestablishedinsubsection1ofthissectionand 10establishedinsections302.400to302.426,anypersonwhoislessthantwenty-oneyearsof 11agewhousesareproduced,modifiedoralteredchauffeur'slicense,motorvehicleoperator's 12license,identificationcardissuedbyanyuniformedserviceoftheUnitedStates,passportor 13identificationcardestablishedinsection302.181forthepurposeofpurchasing,askingforor 14inanywayreceivinganyintoxicatingliquor,shallbeguiltyofamisdemeanorandshallbe 15subjecttoafineoffivehundreddollarsforeachseparateoffense. 328.075.1.Anypersondesiringtopracticeasanapprenticeforbarberinginthis 2stateshallapplytotheboard,shallberegisteredasanapprenticewiththeboard,andshallpay 3theappropriatefeespriortobeginningtheirapprenticeship.Barberapprenticesshallbeat 4least[seventeen] eighteenyearsofage. 5 2.Anypersondesiringtoactasanapprenticesupervisorforbarberinginthisstate 6shallfirstpossessalicensetopracticetheoccupationofbarbering,applytotheboard,paythe 7appropriatefees,completeaneight-hourapprenticesupervisioninstructioncoursecertified 8bytheboard,andbeissuedalicenseasabarberapprenticesupervisorpriortosupervising 9barberapprentices. 10 3.Theboardmaypromulgaterulesestablishingthecriteriaforthesupervisionand 11trainingofbarberapprentices. 12 4.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 13createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 14withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 15Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 16generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 17disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof HCSHB1559 16 18rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2004,shallbeinvalid 19andvoid. 328.080.1.Anypersondesiringtopracticebarberinginthisstateshallmake 2applicationforalicensetotheboardandshallpaytherequiredbarberexaminationfee. 3 2.Theboardshallexamineeachqualifiedapplicantand,uponsuccessfulcompletion 4oftheexaminationandpaymentoftherequiredlicensefee,shallissuetheapplicantalicense 5authorizinghimorhertopracticetheoccupationofbarberinthisstate.Theboardshalladmit 6anapplicanttotheexamination,ifitfindsthatheorshe: 7 (1)Is[seventeen] eighteenyearsofageorolder; HCSHB1559 17 13 (3)Iftheapplicantsarestudents,theyshallhavehadtherequiredtimeinalicensed 14schoolofnolessthanonethousandfivehundredhourstrainingorthecredithoursdetermined 15bytheformulainSubpartAofPart668ofSection668.8ofTitle34oftheCodeofFederal 16Regulations,asamended,fortheclassificationofcosmetologist,withtheexceptionofpublic 17vocationaltechnicalschoolsinwhichastudentshallcompletenolessthanonethousandtwo 18hundredtwentyhourstraining.Allstudentsshallcompletenolessthanfourhundredhoursor 19thecredithoursdeterminedbytheformulainSubpartAofPart668ofSection668.8ofTitle 2034oftheCodeofFederalRegulations,asamended,fortheclassificationofmanicurist.All 21studentsshallcompletenolessthansevenhundredfiftyhoursorthecredithoursdetermined 22bytheformulainSubpartAofPart668ofSection668.8ofTitle34oftheCodeofFederal 23Regulations,asamended,fortheclassificationofesthetician.However,whentheclassified 24occupationofmanicurististakeninconjunctionwiththeclassifiedoccupationof 25cosmetologist,thestudentshallnotberequiredtoservetheextrafourhundredhoursor 26thecredithoursdeterminedbytheformulainSubpartAofPart668ofSection668.8ofTitle 2734oftheCodeofFederalRegulations,asamended,otherwiserequiredtoincludemanicuring 28ofnails;and 29 (4)Theyshallhavepassedanexaminationtothesatisfactionoftheboard. 30 2.Apersonmayapplytotaketheexaminationrequiredbysubsection1ofthis 31sectionifthepersonisagraduateofaschoolofcosmetologyorapprenticeprogramin 32anotherstateorterritoryoftheUnitedStateswhichhassubstantiallythesamerequirements 33asaneducationalestablishmentlicensedpursuanttothischapter.Apersonmayapplytotake 34theexaminationrequiredbysubsection1ofthissectionifthepersonisagraduateofan 35educationalestablishmentinaforeigncountrythatprovidestrainingforaclassified 36occupationofcosmetology,asdefinedbysection329.010,andhaseducationalrequirements 37thataresubstantiallythesamerequirementsasaneducationalestablishmentlicensedunder 38thischapter.Theboardhassolediscretiontodeterminethesubstantialequivalencyofsuch 39educationalrequirements.Theboardmayrequirethattranscriptsfromforeignschoolsbe 40submittedforitsreview,andtheboardmayrequirethattheapplicantprovideanapproved 41Englishtranslationofsuchtranscripts. 42 3.Eachapplicationshallcontainastatementthat,subjecttothepenaltiesofmakinga 43falseaffidavitordeclaration,theapplicationismadeunderoathoraffirmationandthatits 44representationsaretrueandcorrecttothebestknowledgeandbeliefofthepersonsigningthe 45application. 46 4.Thesufficiencyofthequalificationsofapplicantsshallbedeterminedbytheboard, 47buttheboardmaydelegatethisauthoritytoitsexecutivedirectorsubjecttosuchprovisionsas 48theboardmayadopt. 5 (2)"Characterizedby",describingtheessentialcharacterordominantthemeofan 6item; 7 (3)"Child",anypersonundertheageoffourteen; 8 (4)"Childpornography": 9 (a)Anyobscenematerialorperformancedepictingsexualconduct,sexualcontactas 10definedinsection566.010,orasexualperformanceandwhichhasasoneofitsparticipantsor 11portraysasanobserverofsuchconduct,contact,orperformanceaminor;or 12 (b)Anyvisualdepiction,includinganyphotograph,film,video,picture,orcomputer 13orcomputer-generatedimageorpicture,whethermadeorproducedbyelectronic, 14mechanical,orothermeans,ofsexuallyexplicitconductwhere: 15 a.Theproductionofsuchvisualdepictioninvolvestheuseofaminorengagingin 16sexuallyexplicitconduct; 66 (4)TheindividualwhoseDNAsamplehasbeencollected,orhisorherattorney;or 67 (5)Associatecircuitjudges,circuitjudges,judgesofthecourtsofappeals,supreme 68courtjudges,andtheiremployeeswhoneedtoobtainsuchrecordstoperformtheirpublic 69duties. 70 8.Anypersonwhoobtainsrecordspursuanttotheprovisionsofthissectionshalluse 71suchrecordsonlyforinvestigativeandprosecutorialpurposes,includingbutnotlimitedto 72useatanycriminaltrial,hearing,orproceeding;orforlawenforcementidentification 73purposes,includingidentificationofhumanremains.Suchrecordsshallbeconsidered 74strictlyconfidentialandshallonlybereleasedasauthorizedbythissection. 75 9.(1)AnindividualmayrequestexpungementofhisorherDNAsampleandDNA 76profilethroughthecourtissuingthereversalordismissal,orthroughthecourtgrantingan 77expungementofallofficialrecordsundersection568.040.Acertifiedcopyofthecourtorder 78establishingthatsuchconvictionhasbeenreversed,guiltypleahasbeensetaside,or 79expungementhasbeengrantedundersection568.040shallbesenttotheMissouristate 80highwaypatrolcrimelaboratory.Uponreceiptofthecourtorder,thelaboratorywill 81determinethattherequestingindividualhasnootherqualifyingoffenseasaresultofany 82separatepleaorconvictionandnootherqualifyingarrestpriortoexpungement. 83 (2)ApersonwhoseDNArecordorDNAprofilehasbeenincludedinthestateDNA 84databaseinaccordancewiththissectionandsections650.050,650.052,and650.100may 85requestexpungementonthegroundsthattheconvictionhasbeenreversed,theguiltypleaon HCSHB1559 41 86whichtheauthorityforincludingthatperson'sDNArecordorDNAprofilewasbasedhas 87beensetaside,oranexpungementofallofficialrecordshasbeengrantedbythecourtunder 88section568.040. 89 (3)Uponreceiptofawrittenrequestforexpungement,acertifiedcopyofthefinal 90courtorderreversingtheconviction,settingasidetheplea,orgrantinganexpungementofall 91officialrecordsundersection568.040,andanyotherinformationnecessarytoascertainthe 92validityoftherequest,theMissouristatehighwaypatrolcrimelaboratoryshallexpungeall 93DNArecordsandidentifiableinformationinthestateDNAdatabasepertainingtotheperson 94anddestroytheDNAsampleoftheperson,unlesstheMissouristatehighwaypatrol 95determinesthatthepersonisotherwiseobligatedtosubmitaDNAsample.Withinthirtydays 96afterthereceiptofthecourtorder,theMissouristatehighwaypatrolshallnotifythe 97individualthatithasexpungedhisorherDNAsampleandDNAprofile,orthebasisforits 98determinationthatthepersonisotherwiseobligatedtosubmitaDNAsample. 99 (4)TheMissouristatehighwaypatrolisnotrequiredtodestroyanyitemofphysical 100evidenceobtainedfromaDNAsampleifevidencerelatingtoanotherpersonwouldthereby 101bedestroyed. 102 (5)Anyidentification,warrant,arrest,orevidentiaryuseofaDNAmatchderived 103fromthedatabaseshallnotbeexcludedorsuppressedfromevidence,norshallanyconviction 104beinvalidatedorreversedorpleasetasideduetothefailuretoexpungeoradelayin 105expungingDNArecords. 106 10.WhenaDNAsampleistakenfromanindividualpursuanttosubdivision(2)of 107subsection1ofthissectionandtheprosecutordeclinesprosecutionandnotifiesthearresting 108agencyofthatdecision,thearrestingagencyshallnotifytheMissouristatehighwaypatrol 109crimelaboratorywithinninetydaysofreceivingsuchnotification.Withinthirtydaysof 110beingnotifiedbythearrestingagencythattheprosecutorhasdeclinedprosecution,the 111Missouristatehighwaypatrolcrimelaboratoryshalldeterminewhethertheindividualhas 112anyotherqualifyingoffensesorarreststhatwouldrequireaDNAsampletobetakenand 113retained.Iftheindividualhasnootherqualifyingoffensesorarrests,thecrimelaboratory 114shallexpungeallDNArecordsinthedatabasetakenatthearrestforwhichtheprosecution 115wasdeclinedpertainingtothepersonanddestroytheDNAsampleofsuchperson. 116 11.WhenaDNAsampleistakenofanarresteeforanyoffenselistedunder 117subsection1ofthissectionandchargesarefiled: 118 (1)Ifthechargesarelaterwithdrawn,theprosecutorshallnotifythestatehighway 119patrolcrimelaboratorythatsuchchargeshavebeenwithdrawn; 120 (2)Ifthecaseisdismissed,thecourtshallnotifythestatehighwaypatrolcrime 121laboratoryofsuchdismissal; HCSHB1559 42 122 (3)Ifthecourtfindsatthepreliminaryhearingthatthereisnoprobablecausethatthe 123defendantcommittedtheoffense,thecourtshallnotifythestatehighwaypatrolcrime 124laboratoryofsuchfinding; 125 (4)Ifthedefendantisfoundnotguilty,thecourtshallnotifythestatehighwaypatrol 126crimelaboratoryofsuchverdict. 127 128Ifthestatehighwaypatrolcrimelaboratoryreceivesnoticeunderthissubsection,suchcrime 129laboratoryshalldetermine,withinthirtydays,whethertheindividualhasanyotherqualifying 130offensesorarreststhatwouldrequireaDNAsampletobetaken.Iftheindividualhasno 131otherqualifyingarrestsoroffenses,thecrimelaboratoryshallexpungeallDNArecordsinthe 132databasepertainingtosuchpersonanddestroytheperson'sDNAsample. ✔ HCSHB1559 43
