BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section287.067,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection287.067,toreadasfollows: 287.067.1.Inthischaptertheterm"occupationaldisease"isherebydefinedtomean, 2unlessadifferentmeaningisclearlyindicatedbythecontext,anidentifiablediseasearising 3withorwithouthumanfaultoutofandinthecourseoftheemployment.Ordinarydiseasesof 4lifetowhichthegeneralpublicisexposedoutsideoftheemploymentshallnotbe 5compensable,exceptwherethediseasesfollowasanincidentofanoccupationaldiseaseas 6definedinthissection.Thediseaseneednottohavebeenforeseenorexpectedbutafterits 7contractionitmustappeartohavehaditsorigininariskconnectedwiththeemploymentand 8tohaveflowedfromthatsourceasarationalconsequence. 9 2.Aninjuryordeathbyoccupationaldiseaseiscompensableonlyiftheoccupational 10exposurewastheprevailingfactorincausingboththeresultingmedicalconditionand 11disability.The"prevailingfactor"isdefinedtobetheprimaryfactor,inrelationtoanyother 12factor,causingboththeresultingmedicalconditionanddisability.Ordinary,gradual 13deterioration,orprogressivedegenerationofthebodycausedbyagingorbythenormal 14activitiesofday-to-daylivingshallnotbecompensable. 15 3.Aninjuryduetorepetitivemotionisrecognizedasanoccupationaldiseasefor 16purposesofthischapter.Anoccupationaldiseaseduetorepetitivemotioniscompensable 17onlyiftheoccupationalexposurewastheprevailingfactorincausingboththeresulting EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18medicalconditionanddisability.The"prevailingfactor"isdefinedtobetheprimaryfactor, 19inrelationtoanyotherfactor,causingboththeresultingmedicalconditionanddisability. 20Ordinary,gradualdeterioration,orprogressivedegenerationofthebodycausedbyagingor 21bythenormalactivitiesofday-to-daylivingshallnotbecompensable. 22 4."Lossofhearingduetoindustrialnoise"isrecognizedasanoccupationaldisease 23forpurposesofthischapterandisherebydefinedtobealossofhearinginoneorbothears 24duetoprolongedexposuretoharmfulnoiseinemployment."Harmfulnoise"meanssound 25capableofproducingoccupationaldeafness. 26 5."Radiationdisability"isrecognizedasanoccupationaldiseaseforpurposesofthis 27chapterandisherebydefinedtobethatdisabilityduetoradioactivepropertiesorsubstances 28ortoRoentgenrays(X-rays)orexposuretoionizingradiationcausedbyanyprocess 29involvingtheuseofordirectcontactwithradiumorradioactivepropertiesorsubstancesor 30theuseofordirectexposuretoRoentgenrays(X-rays)orionizingradiation. 31 6.Diseaseofthelungsorrespiratorytract,hypotension,hypertension,ordiseaseof 32theheartorcardiovascularsystem,includingcarcinoma,mayberecognizedasoccupational 33diseasesforthepurposesofthischapterandaredefinedtobedisabilityduetoexposureto 34smoke,gases,carcinogens,inadequateoxygen,ofpaidfirefightersofapaidfiredepartment 35orpaidpoliceofficersofapaidpolicedepartmentcertifiedunderchapter590ifadirect 36causalrelationshipisestablished,orpsychologicalstressoffirefightersofapaidfire 37departmentorpaidpeaceofficersofapolicedepartmentwhoarecertifiedunderchapter590 38ifadirectcausalrelationshipisestablished. 39 7.Anyemployeewhoisexposedtoandcontractsanycontagiousorcommunicable 40diseasearisingoutofandinthecourseofhisorheremploymentshallbeeligibleforbenefits 41underthischapterasanoccupationaldisease. 42 8.Withregardtooccupationaldiseaseduetorepetitivemotion,iftheexposuretothe 43repetitivemotionwhichisfoundtobethecauseoftheinjuryisforaperiodoflessthanthree 44monthsandtheevidencedemonstratesthattheexposuretotherepetitivemotionwiththe 45immediateprioremployerwastheprevailingfactorincausingtheinjury,theprioremployer 46shallbeliableforsuchoccupationaldisease. 47 9.Posttraumaticstressdisorder(PTSD)isrecognizedasanoccupationaldisease 48forpurposesofthischapterwhendiagnosedinafirstresponder,asthattermisdefined 49undersection67.145. ✔ HB1640 2
