BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter161,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection161.841,toreadasfollows: 161.841.1.Thissectionshallbeknownandmaybecitedasthe"Parents'Billof 2RightsActof2022". 3 2.Asusedinthissection,theterm"parent"meansachild'sparent,guardian,or 4otherpersonhavingcontrolorcustodyofthechild. 5 3.Thissectionshallbeconstruedtoempowerparentstoenforcethefollowing 6rightsagainstschooldistrictsandpublicschoolsinwhichtheirchildrenareenrolled 7thatreceiveanyfederalorstatemoneys: 8 (1)Therighttoknowwhattheirminorchildisbeingtaughtinschoolincluding, 9butnotlimitedto,curricula,books,andotherinstructionalmaterials; 10 (2)Therighttoreceiveinformationaboutwhoisteachingtheirminorchild 11including,butnotlimitedto,guestlecturersandoutsidepresenters; 12 (3)Therighttoreceiveinformationaboutindividualsandorganizations 13receivingschoolcontractsandfunding; 14 (4)Therighttovisittheschoolandcheckinontheirminorchildduringschool 15hours; 16 (5)Therighttovieworreceiveallschoolrecords,medicalorotherwise, 17concerningtheirminorchild; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (6)Therighttoreceiveinformationaboutthecollectionandtransmissionof 19theirminorchild'sdata; 20 (7)Therighttohavesufficientaccountabilityandtransparencyregardingschool 21boards;and 22 (8)Therighttoknowaboutsituationsaffectingtheirminorchild'ssafetyin 23school. 24 4.Noschooldistrictorpublicschoolshallrequirenondisclosureagreementsor 25similarformsforaparent'sreviewofcurricula.Eachpublicschoolorschooldistrict 26shallallowparentstomakecopiesofcurriculumdocuments. 27 5.Noschooldistrictorpublicschoolshallallowstudentinvolvementinschool 28assemblies,fieldtrips,orotherextracurricularactivitiesunlessthechild'sparents 29providewrittenauthorizationforsuchstudentinvolvement. 30 6.Noschooldistrictorpublicschoolshallcollectanybiometricdataorother 31sensitivepersonalinformationaboutaminorchildwithoutobtainingwrittenparental 32consentbeforecollectingsuchdataorinformation. 33 7.Eachschoolboardmeetingpertainingtocurricula,safety,orotherstudent 34issuesshallbeheldinpublicandallowforpubliccomments. 35 8.Eachschooldistrictandpublicschoolshallnotifyparentsinatimelymanner 36ofallreportedincidentspertainingtostudentsafetyincluding,butnotlimitedto,any 37felonyormisdemeanorcommittedbyteachersorotherschoolemployees. 38 9.Parentsmaybringacivilactionforinjunctivereliefagainsttheschooldistrict 39orpublicschoolinwhichtheirchildisenrolledifsuchschooldistrictorpublicschool 40violatesthissection.Suchactionshallbebroughtinthecountywheretheviolation 41occurred.Ifacourtfindsthattheschooldistrictorpublicschoolhasknowingly 42engagedinmultipleorrepeatedviolationsofthissection,thedepartmentofelementary 43andsecondaryeducationshallwithholdallmoneysprovidedbymonthlydistributionof 44stateformulafundingtosuchschooldistrictorpublicschooluntilsuchschooldistrictor 45publicschoolisincompliancewiththissection.Aftertheschooldistrictorpublicschool 46providesevidencethatsuchschooldistrictorpublicschoolisincompliancewiththis 47section,thedepartmentshallrestorethedistributionofthefundingtoitsoriginal 48amountbeforethedistributionwaswithheld. ✔ HB1858 2
