4 2.TheMissouriaccountabilityportalshallconsistofaneasy-to-searchdatabaseof
5financialtransactionsrelatedto:
6 (1)Thepurchaseofgoodsandservicesandthedistributionoffundsforstate
7programs;
8 (2)Allbondsissuedbyanypublicinstitutionofhighereducation, publicschool
9district,orpoliticalsubdivisionofthisstateoritsdesignatedauthorityafterAugust28,2013;
10 (3)Allobligationsissuedorincurredpursuanttosection99.820byanypolitical
11subdivisionofthisstateoritsdesignatedauthority;[and]
12 (4)Therevenuestreampledgedtorepaysuchbondsorobligations;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 3.TheMissouriaccountabilityportalshallbeupdatedeachstatebusinessdayand
18maintainedastheprimarysourceofinformationabouttheactivityofMissouri'sgovernment.
19 4.Upontheconductingofawithholdingorareleaseoffunds,thegovernorshall
20submitareportstatingallamountswithheldfromthestate'soperatingbudgetforthecurrent
21fiscalyear,asauthorizedbyArticleIV,Section27oftheMissouriConstitutionwhichshall
22be:
23 (1)Conspicuouslypostedontheaccountabilityportalwebsite;
24 (2)Searchablebytheamountswithheldorreleasedfromeachindividualfund;and
25 (3)Searchablebythetotalamountwithheldorreleasedfromtheoperatingbudget.
26 5.Everypoliticalsubdivisionofthestate,includingpublicinstitutionsofhigher
27education[butexcluding] ,publicschooldistricts,andpubliccharterschoolsshallsupply
28allinformationdescribedinsubsection2ofthissectiontotheofficeofadministrationwithin
29[sevendaysofissuingorincurringsuchcorrespondingbondorobligation.Forallsuchbonds
30orobligationsissuedorincurredpriortoAugust28,2013,everysuchpoliticalsubdivision
31andpublicinstitutionofhighereducationshallhaveninetydaystosupplysuchinformation
32to]thenumberofdaysandinamannertobedeterminedbytheofficeofadministration.
33 6.Everyschooldistrictandpubliccharterschoolshallsupplyallinformation
34describedinsubdivisions(2),(4),(5),and(6)ofsubsection2ofthissectiontothe
35departmentofelementaryandsecondaryeducation[withinsevendaysofissuingsuchbond,
36orincurringsuchdebt]. Thedepartmentofelementaryandsecondaryeducationshallhave
37forty-eighthourstodeliversuchinformationtotheofficeofadministration.[Forallsuch
38bondsissuedordebtincurredpriortoAugust28,2013,everyschooldistrictandpublic
39charterschoolshallhaveninetydaystosupplysuchinformationtothedepartmentof
40elementaryandsecondaryeducation.Thedepartmentofelementaryandsecondaryeducation
41shallhaveforty-eighthourstodeliversuchinformationtotheofficeofadministration.]
161.841.1.Thissectionshallbeknownandmaybecitedasthe"Parents'Billof
2RightsActof2022".
3 2.Asusedinthissection,theterm"parent"meansachild'sparent,guardian,or
4otherpersonhavingcontrolorcustodyofthechild.
5 3.Thissectionshallbeconstruedtoempowerparentstoenforcethefollowing
6rightsagainstschooldistrictsandpublicschoolsinwhichtheirchildrenareenrolled
7thatreceiveanyfederalorstatemoneys:
8 (1)Therighttoknowwhattheirminorchildisbeingtaughtinschoolincluding,
9butnotlimitedto,curricula,books,andotherinstructionalmaterials;
10 (2)Therighttoreceiveinformationaboutwhoisteachingtheirminorchild
11including,butnotlimitedto,guestlecturersandoutsidepresenters;

13receivingschoolcontractsandfunding;
14 (4)Therighttovisittheschoolandcheckinontheirminorchildduringschool
15hours;
16 (5)Therighttoviewand,uponrequest,receiveallschoolrecords,medicalor
17otherwise,concerningtheirminorchild;
18 (6)Therighttoreceiveinformationaboutthecollectionandtransmissionof
19theirminorchild'sdata;
20 (7)Therighttohavesufficientandeffectiveaccountabilityandtransparency
21regardingschoolboards;and
22 (8)Therighttoknowaboutsituationsaffectingtheirminorchild'ssafetyin
23school.
24 4.Inadditiontotheparentalrightsundersubsection3ofthissection,this
25sectionshallbeconstruedtoempowerparentswiththerighttoenrolltheparent's
26minorchildinapublicschoolor,asanalternativetopubliceducation,aprivateschool,
27includingareligiousschool,ahomeeducationprogram,orotheravailableoptions,as
28authorizedbylaw.
29 5.Thedepartmentofelementaryandsecondaryeducationshalldeveloppolicies
30andproceduresforschooldistrictsandpublicschoolstofollowtoaccommodateand
31assistparentsintheexerciseoftheparentalrightstoknowandreceiveinformationas
32describedinsubsection3ofthissection.Suchpoliciesandproceduresshalldescribethe
33methodseachschooldistrictandpublicschoolshallusetoprovidesuchinformationand
34shallallowparentstoexercisesuchparentalrightstothefullestextent.Eachschool
35boardshalladoptsuchpoliciesandproceduresforthe2023-24schoolyearandall
36subsequentschoolyears.
37 6.Noschooldistrictorpublicschoolshallrequirenondisclosureagreementsor
38similarformsforaparent'sreviewofcurricula.Eachpublicschoolorschooldistrict
39shallallowparentstomakeacopyofcurriculumdocumentsorreceivesuchcurriculum
40documentsinanelectronicformat,providedthatnorequestwouldcausean
41infringementofcopyrightprotectionsprovidedunderthefederalCopyrightActof
421976(17U.S.C.Section101etseq.),asamended.
43 7.Noschooldistrictorpublicschoolshallrequirenondisclosureagreementsor
44similarformsforaparent'sreviewofindividualizededucationprogrammeetings,
45mediations,dueprocesshearings,orotherdisputeresolutionoptionsasoutlinedin
46accordancewith34CFR300.320to300.324andunder20U.S.C.Section1401,as
47amended.
HCSHB1858	3 48 8.Noschooldistrictorpublicschoolshallallowstudentinvolvementinschool
49assemblies,fieldtrips,orotherextracurricularactivitiesunlessthechild'sparents
50providewrittenauthorizationforsuchstudentinvolvement.
51 9.Noschooldistrictorpublicschoolshallcollectanybiometricdataorother
52sensitivepersonalinformationaboutaminorchildwithoutobtainingwrittenparental
53consentbeforecollectingsuchdataorinformation.
54 10.Noschooldistrictorpublicschoolshallprovideanyschoolrecordsas
55describedinsubdivision(5)ofsubsection3ofthissectioninviolationofanyrelevant
56stateorfederalprivacylaworpoliciesprotectingorlimitingaccesstosuchminorchild's
57schoolrecords.
58 11.Eachschoolboardmeetingpertainingtocurriculaorgeneralsafetyshallbe
59heldinpublicandallowforpubliccomments,subjecttotheauthorizedclosureofany
60portionofsuchmeetingundersection610.021.
61 12.Eachschooldistrictandpublicschoolshallnotifyparentsinatimelymanner
62ofallreportedincidentspertainingtostudentsafetyincluding,butnotlimitedto,any
63felonyormisdemeanorcommittedbyteachersorotherschoolemployeesandanyactor
64instancereportableundersubsections1,2,or3ofsection167.117.
65 13.Eachschooldistrictandpublicschoolmayadoptreasonableproceduresfor
66parentstofollowwhenexercisingtheparentalrighttovisittheschoolandtheirminor
67childduringschoolhours,except:
68 (1)Duringanemergencyinwhichthesafetyofthestudentsrequires:
69 (a)Alockdowntolimitexposureofbuildingoccupantstoanimminenthazard
70orthreat;or
71 (b)Alockouttopreventanoutsidehazardorthreatfromenteringthebuilding;
72and
73 (2)Noschooldistrictorpublicschoolshallallowanindividualtohaveany
74interactionwithaminorchildinviolationofanyorderenteredunderanyprovisionof
75stateorfederallawrestrictingorprohibitingsuchindividualfrominteractingwithsuch
76minorchild.
77 14.Noemployeeofanypublicschoolorschooldistrictshallencourage,coerce,
78orattempttocoerceaminorchildtowithholdinformationfromsuchminorchild's
79parents;provided,however,thatanysuchpersonrequiredtoreportsuspectedabuseor
80neglectundersections210.109to210.183mayencourageaminorchildtowithhold
81informationwheredisclosurecouldreasonablyresultinabuseorneglect.
82 15.Eachschoolboardshallaffirmtheboard'scommitmenttoensuring
83sufficientandeffectiveaccountabilityandtransparencytoparentsintheschooldistrict
84byadoptingpoliciesthatrequiremembersoftheboardtocollectivelyandindividually:

86theirminorchild;
87 (2)Assistparentsintheexerciseofparentalrightstothefullestextent;
88 (3)Encouragecommunicationbetweenparentsandschoolboardmembers
89relatingtoparentalrightsandparentalconcernsabouttheirminorchild'seducation
90andeducationalexperience;
91 (4)Collaboratewithparentstoidentifywaysinwhichparentscanexercise
92parentalrightsandcommunicatesuchwaystoparentsinaclear,consistentmannerthat
93canbeeasilyunderstoodbyallparentsintheschooldistrict;and
94 (5)Conductschoolboardmeetingsinamannerthatinformsparentsofschool
95boarddecisionsandactionswhileencouragingandremainingresponsivetoparental

97 16.Theattorneygeneralofthisstateoranyparentofaminorchildenrolledina
98publicschoolinthedistrictmaybringacivilactionforinjunctivereliefagainstthe
99schooldistrictorpublicschoolinwhichtheirchildisenrolledifsuchschooldistrictor
100publicschoolviolatesthissection.Suchactionshallbebroughtinthecountywherethe
101violationoccurred.Ifacourtfindsthattheschooldistrictorpublicschoolhas
102knowinglyengagedinmultipleorrepeatedviolationsofthissection,thedepartmentof
103elementaryandsecondaryeducationshallwithholdallmoneysprovidedbymonthly
104distributionofstateformulafundingtosuchschooldistrictorpublicschooluntilsuch
105schooldistrictorpublicschoolisincompliancewiththissection.Aftertheschool
106districtorpublicschoolprovidesevidencethatsuchschooldistrictorpublicschoolisin
107compliancewiththissection,thedepartmentshallrestorethedistributionofthefunding
108toitsoriginalamountbeforethedistributionwaswithheld.Anymoneysthatwere
109withheldunderthissubsectionshallbereleasedtosuchschooldistrictorpublicschool
110onlyifsuchschooldistrictorpublicschoolestablishescompliancewiththissectionin
111thesameschoolyearinwhichthedepartmentwithheldsuchmoneys.
112 17.Thissectionshallnotbeconstruedtolimittheinalienablerightsofaparent
113ortaxpayer,regardlessofwhethersuchrightsareenumeratedintheprovisionsofthis
114section.
161.852.1.Thedepartmentofelementaryandsecondaryeducationshall
2developatoolwithinthedepartment'scomprehensivedatasystemthatprovidesaccess
3toeveryschooldistrict'scurriculumandprofessionaldevelopmentmaterials.
4 2.Thetoolshallconsistofaneasy-to-searchdatabaseincluding,butnotlimited
5to,thefollowing:
6 (1)Allcurriculumtaughtbytheschooldistrict;

8district'sfacultyandstaffincluding,butnotlimitedto,administrators,teachers,
9counselors,andclassroomsupportstaff;
10 (3)Thenamesofallspeakersandguestsusedbyaschooldistrictintheschool
11district'sprofessionaldevelopmentactivities;and
12 (4)Thecostsassociatedwithspeakersandguestsusedbyaschooldistrictinthe
13schooldistrict'sprofessionaldevelopmentactivities.
14 3.Thedepartmentofelementaryandsecondaryeducationshallestablishan
15onlineformthateachschooldistrictinthisstateshallcompletewithinformation
16requiredundersubsection2ofthissection.
17 4.Aschooldistrictshallsubmitanyupdatestotheinformationoutlinedin
18subsection2ofthissectioneverysixmonths.Apublicschoolorschooldistrictmay
19makegood-faithmodificationstocurriculaduringeachsix-monthperiodbetween
20updatesbutshallnotberequiredtosubmitanupdateofsuchmodificationsuntilthe
21nextsix-monthupdate.
22 5.Notlessthanmonthly,thedepartmentofelementaryandsecondaryeducation
23shallupdatethetoolwiththeinformationrequiredbythissectiontobesubmittedby
24eachschooldistrictandshallensurethatthetoolismaintainedastheprimary
25centralizedsourceofinformationaboutthecurriculumandinstructionalmaterialsused
26bypublicschooldistricts.
27 6.Thedepartmentofelementaryandsecondaryeducationmaypromulgate
28rulestoimplementthissection.Anyruleorportionofarule,asthattermisdefinedin
29section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
30becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
31536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable,
32andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
33review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
34heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
35adoptedafterAugust28,2022,shallbeinvalidandvoid.
162.005.1.Asusedinthissection,"schoolboard"meansaspecial
2administrativeboardoranyotherformofgovernanceappointedundersection
3162.081;aboardofdirectorsestablishedundersection162.471;aboardofeducation
4establishedundersection162.261,162.571,or162.855;thegoverningboardofacharter
5schoolestablishedundersection160.400;andanyotherformofgovernanceovera
6schooldistrictestablishedunderstatelaw.
HCSHB1858	6 7 2.BeforeJuly1,2023,eachschoolboardshalladoptaschoolboardmeeting
8speakerpolicytoensurethattherequirementslistedinthissubsectionarefollowedat
9eachschoolboardmeeting:
10 (1)Eachschoolboardshalldesignateatimeforpubliccommentatthebeginning
11ofeachregularpublicmeetingoftheschoolboard.Suchpubliccommentperiodshall
12beavailabletoresidentsofthedistrictandshallbesubjecttoreasonablerulesrequiring
13decorumandcivilityinthemeetingspace;
14 (2)Aschoolboardmaysetatimelimitonanyindividualwhodesirestospeakat
15aschoolboardmeeting.Eachsuchtimelimitshalldesignatenotlessthanthreeminutes
16perspeaker.Theschoolboardmaylimitthepubliccommentperiodtoonehourof
17actualtestimonyortwentyspeakers,whicheverislessbasedonthenumberofminutes
18designatedperspeaker.Ifthetimedesignatedforthepubliccommentperiodexpires
19andadditionalspeakerswerenotaffordedthetimetospeak,suchadditionalspeakers
20shallhavethefirstopportunitytospeakatthepubliccommentperiodofthenext
21regularpublicmeetingoftheschoolboardandtheschoolboardshallprovidean
22alternatemethodofcommunicatingsuchadditionalspeakers'concernstotheschool
23board;
24 (3)Eachschoolboardshalldeterminespecificidentifyinginformationeach
25individualdesiringtospeakshallprovidetotheschoolboardbeforespeaking;
26 (4)Eachschoolboardmaydeterminethatparticularissuesareinappropriate
27forindividualstospeakaboutduringsuchpubliccommentperiodincluding,butnot
28limitedto,personnelissuesandlitigationissues.Anyguidelineprohibitingparticular
29issuesfrombeingaddressedduringsuchpubliccommentperiodshallbemadeavailable
30tothepublicinwritingbeforeeachpubliccommentperiodbegins;
31 (5)Noschoolboardshallbananindividualfromattendingorremovean
32individualfromparticipatinginaschoolboardmeetingunlesssuchindividualisbanned
33orremovedbecausesuchindividualcommitstheoffenseofpeacedisturbanceas
34providedinsection574.010,haspreviouslybeenremovedfromaschoolboardmeeting
35andissuedasummonsfortheoffenseofpeacedisturbanceundersection574.010,oris
36prohibitedfrombeingonschoolpropertyunderstatelaw;and
37 (6)Eachschoolboardshallprovideamethodforanindividualwhoisunableto
38attendthepubliccommentperiodofaschoolboardmeetingtosubmitawritten
39statement.Anysuchwrittenstatementsubmittedbeforethebeginningoftheschool
40boardmeetingshallbeprovidedtotheschoolboardandmadeavailabletoall
41individualsattendingsuchmeetingandtothepublicuponrequestunlesssuchwritten
42statementviolatesthepoliciesorrulesestablishedforthepubliccommentperiod.

44commentperiod,theschoolboardmaysuggestthatthespeakersselectoneindividualto
45presentcommentsonbehalfofallsuchspeakers.
46 4.Parentsmaybringacivilactionforinjunctivereliefagainsttheschooldistrict
47orpublicschoolinwhichtheirchildisenrolledifsuchschooldistrictorpublicschool
48violatesthissection.Suchactionshallbebroughtinthecountywheretheviolation
49occurred.Ifacourtfindsthattheschooldistrictorpublicschoolhasknowingly
50engagedinmultipleorrepeatedviolationsofthissection,thedepartmentofelementary
51andsecondaryeducationshallwithholdallmoneysprovidedbymonthlydistributionof
52stateformulafundingtosuchschooldistrictorpublicschooluntilsuchschooldistrictor
53publicschoolisincompliancewiththissection.Aftertheschooldistrictorpublicschool
54providesevidencethatsuchschooldistrictorpublicschoolisincompliancewiththis
55section,thedepartmentshallrestorethedistributionofthefundingtoitsoriginal
56amountbeforethedistributionwaswithheld.Anymoneysthatwerewithheldunder
57thissubsectionshallbereleasedtosuchschooldistrictorpublicschoolonlyifsuch
58schooldistrictorpublicschoolestablishescompliancewiththissectioninthesame
59schoolyearinwhichthedepartmentwithheldsuchmoneys.
170.231.1.Theschoolboardofeachschooldistrictandthegoverningboardof
2eachcharterschoolshallprovidethatallpublicschoolinstructionalmaterialintendedfor
3useinconnectionwithanypublicschoolclassroominstruction,oranypublicschoolresearch
4orexperimentationprogramorproject,shallbeavailableforinspectionbyanyperson.For
5thepurposeofthissection,"classroominstruction"shallmeananypublicschoolinstruction
6involvingteachersandstudentsorpeersandstudents;"researchorexperimentationprogram
7orproject"shallmeananypublicschoolresearchorexperimentationprogramorproject
8designedtoexploreordevelopnewandunproventeachingmethodsandtechniques.
9 2.(1)Theschoolboardofeachschooldistrictandthegoverningboardofeach
10charterschoolshallprominentlypostonthehomepageoftheschoolboard'sorcharter
11school'swebsite,insuchamannerthattheinformationisavailabletothepublic,the
12curriculaintendedforusebysuchschooldistrictorcharterschoolinconnectionwith
13schoolinstructioninmath,socialstudies,science,English,foreignlanguage,finearts,
14health,physicaleducation,andvocationaleducation.Ifsuchschoolboardorgoverning
15boardadoptsachangeofanycurriculumusedbysuchschooldistrictorcharterschool,
16suchschoolboard'sorcharterschool'swebsiteshallbeupdatedwithinthirtydaysafter
17suchchangeisadopted.
18 (2)Theschoolboardofeachschooldistrictandthegoverningboardofeach
19charterschoolshallnotifyparentsandguardiansthatthecurriculalistonthewebsite
20hasbeenupdatedbypostinganoticeonsuchschoolboard'sorcharterschool'swebsite
HCSHB1858	8 21andprovidingnoticeinanewsletterorotherwrittencommunicationthatisregularly
22distributedtoparentsandguardians.
23 (3)Wherethecurricularmaterialsbeingmadeavailabletoparentsforreview
24aresubjecttocopyright,trademark,orotherintellectualpropertyprotection,the
25reviewprocessshallincludetechnicalandproceduralsafeguardstoensurethatthe
26materialsarenotabletobewidelydisseminatedtothegeneralpublicinviolationofthe
27intellectualpropertyrightsofthepublisherandcontentvalidityisnotundermined.
28 (4)Aresidentofaschooldistrictmaybringanactionforinjunctivereliefora
29writofmandamusinthecircuitcourtwithjurisdictionovertheschooldistricttocompel
30theschoolboardofsuchschooldistrictorthegoverningboardofacharterschool
31withintheboundariesofsuchschooldistricttocomplywiththissubsection.Ifthe
32residentprevails,thecourtshallawardtosuchresidentreasonableattorney'sfeesnotto
33exceedfifteenthousanddollars.
34 (5)Thissubsectionshallapplyinthe2023-24schoolyearandallsubsequent
35schoolyears.

11 (1)Thatindividualsofanyrace,ethnicity,color,ornationaloriginareinherently
12superiororinferior;
13 (2)Thatindividualsshouldbeadverselyoradvantageouslytreatedonthebasis
14ofindividualrace,ethnicity,color,ornationalorigin;or
15 (3)Thatindividuals,byvirtueoftheirrace,ethnicity,color,ornationalorigin,
16bearcollectiveguiltandareinherentlyresponsibleforactionscommittedinthepastby
17othermembersofthesamerace,ethnicity,color,ornationalorigin.
18 4.Nocourseofinstructionorunitofstudyofferedbyanyschoolshalldirector
19otherwisecompelstudentstopersonallyaffirm,adopt,oradheretoanyoftheideas
20listedinsubsection3ofthissection.

22programshalldirectorotherwisecompelteacherstopersonallyaffirm,adopt,or

24 6.(1)Noschoolemployee,whenactinginthecourseofsuchemployee'sofficial
25duties,shallorganize,participatein,orcarryoutanyactorcommunicationthatwould
26violatesubsection3ofthissection.
