82 (a)Onaregularlyscheduledrouteforthetransportationoffare-payingpassengers;or
83 (b)Furnishingcharterserviceforthetransportationofpersonsenrolledasstudentson
84fieldtripsorotherspecialtripsorinconnectionwithotherspecialevents;
85 (22)"Schoolbusoperator",anoperatorwhooperatesaschoolbusasdefinedin
86subdivision(21)ofthissectioninthetransportationofanyschoolchildrenandwhoreceives
87compensationforsuchservice.Theterm"schoolbusoperator"shallnotincludeanyperson
88whotransportsschoolchildrenasanincidenttoemploymentwithaschoolorschooldistrict,

90isundercontractwithoremployedbyaschoolorschooldistrictasaschoolbusoperator;
91 (23)"Signature",anymethoddeterminedbythedirectorofrevenueforthesigning,
92subscribingorverifyingofarecord,report,application,driver'slicense,orotherrelated
93documentthatshallhavethesamevalidityandconsequencesastheactualsigningbythe
94personprovidingtherecord,report,application,driver'slicenseorrelateddocument;
95 (24)"Substanceabusetrafficoffenderprogram",aprogramcertifiedbythedivision
96ofalcoholanddrugabuseofthedepartmentofmentalhealthtoprovideeducationor
97rehabilitationservicespursuanttoaprofessionalassessmentscreeningtoidentifythe
98individualneedsofthepersonwhohasbeenreferredtotheprogramastheresultofan
99alcohol-ordrug-relatedtrafficoffense.Successfulcompletionofsuchaprogramincludes
100participationinanyeducationorrehabilitationprogramrequiredtomeettheneedsidentified
101intheassessmentscreening.Theassignmentrecommendationsbaseduponsuchassessment
102shallbesubjecttojudicialreviewasprovidedinsubsection14ofsection302.304and
103subsections1and5ofsection302.540;
104 (25)"Vehicle",anymechanicaldeviceonwheels,designedprimarilyforuse,orused
105onhighways,exceptmotorizedbicycles,electricbicycles,vehiclespropelledordrawnby
106horsesorhumanpower,orvehiclesusedexclusivelyonfixedrailsortracks,orcottontrailers
107ormotorizedwheelchairsoperatedbyhandicappedpersons.
304.060.1.Thestateboardofeducationshalladoptandenforceregulationsnot
2inconsistentwithlawtocoverthedesignandoperationofallschoolbusesusedforthe
3transportationofschoolchildrenwhenownedandoperatedbyanyschooldistrictorprivately
4ownedandoperatedundercontractwithanyschooldistrictinthisstate,andsuchregulations
5shallbyreferencebemadeapartofanysuchcontractwithaschooldistrict.Schooldistricts
6shallhavetheauthoritytousemotorvehiclesotherthanschoolbusesforthepurposeof
7transportingschoolchildren.Thestateboardofeducationmayadoptrulesandregulations
8governingtheuseofothervehiclesownedbyadistrictoroperatedundercontractwithany
9schooldistrictinthisstateandusedforthepurposeoftransportingschoolchildren[. The
10operatorofsuchvehicleshallbelicensedinaccordancewithsection302.272,andsuch
11vehicle], excludingmotorvehiclesoperatingundertheauthorityofthedepartmentof
12revenueundersections387.400to387.440.Motorvehiclesotherthanschoolbusesused
13totransportschoolchildrenshalltransportnomorechildrenthanthemanufacturersuggests
14asappropriateforsuchvehicleandmeetanyadditionalrequirementsoftheschool
15district. Thestateboardofeducationmayalsoadoptrulesandregulationsgoverningtheuse
16ofauthorizedcommoncarriersforthetransportationofstudentsonfieldtripsorotherspecial
17tripsforeducationalpurposes.Everyschooldistrict,itsofficersandemployees,andevery
18personemployedundercontractbyaschooldistrictshallbesubjecttosuchregulations.The
HB1973	4 19stateboardofeducationshallcooperatewiththestatetransportationdepartmentandthestate
20highwaypatrolinplacingsuitablewarningsignsatintervalsonthehighwaysofthestate.
21 2.Notwithstandingtheprovisionsofsubsection1ofthissection,anyschoolboardin
22thestateofMissouriinanurbandistrictcontainingthegreaterpartofthepopulationofacity
23whichhasmorethanthreehundredthousandinhabitantsmaycontractwithanymunicipality,
24bi-stateagency,orothergovernmentalentityforthepurposeoftransportingschoolchildren
25attendingagradeorgradesnotlowerthantheninthnorhigherthanthetwelfthgrade,
26providedthatsuchcontractshallbeforadditionaltransportationservices,andshallnot
27replaceorfulfillanyoftheschooldistrict'sobligationspursuanttosection167.231.The
28schooldistrictmaynotifystudentsoftheoptiontousedistrict-contractedtransportation
29services.
30 3.Anyofficeroremployeeofanyschooldistrictwhoviolatesanyoftheregulations
31orfailstoincludeobligationtocomplywithsuchregulationsinanycontractexecutedbyhim
32onbehalfofaschooldistrictshallbeguiltyofmisconductandsubjecttoremovalfromoffice
33oremployment.Anypersonoperatingaschoolbusundercontractwithaschooldistrictwho
34failstocomplywithanysuchregulationsshallbeguiltyofbreachofcontractandsuch
35contractshallbecancelledafternoticeandhearingbytheresponsibleofficersofsuchschool
36district.
37 4.Anyotherprovisionofthelawtothecontrarynotwithstanding,inanycountyof
38thefirstclasswithacharterformofgovernmentadjoiningacitynotwithinacounty,school
39busesmaybeartheword"special".
