104 (25)"Vehicle",anymechanicaldeviceonwheels,designedprimarilyforuse,orused 105onhighways,exceptmotorizedbicycles,electricbicycles,vehiclespropelledordrawnby 106horsesorhumanpower,orvehiclesusedexclusivelyonfixedrailsortracks,orcottontrailers 107ormotorizedwheelchairsoperatedbyhandicappedpersons. 304.060.1.Thestateboardofeducationshalladoptandenforceregulationsnot 2inconsistentwithlawtocoverthedesignandoperationofallschoolbusesusedforthe 3transportationofschoolchildrenwhenownedandoperatedbyanyschooldistrictorprivately 4ownedandoperatedundercontractwithanyschooldistrictinthisstate,andsuchregulations 5shallbyreferencebemadeapartofanysuchcontractwithaschooldistrict.Schooldistricts 6shallhavetheauthoritytousemotorvehiclesotherthanschoolbusesforthepurposeof 7transportingschoolchildrentoandfromschool,toschoolactivities,ortotransport 8pupilsproperlychaperonedtoandfromanyplacewithinthestateforeducational 9purposes.Thestateboardofeducationmayadoptrulesandregulationsgoverningtheuseof 10othervehiclesownedbyadistrictoroperatedundercontractwithanyschooldistrictinthis 11stateandusedforthepurposeoftransportingschoolchildren[. Theoperatorofsuchvehicle 12shallbelicensedinaccordancewithsection302.272,andsuchvehicle], excludingmotor HB1973 4 13vehiclesoperatingundertheauthorityofthedepartmentofrevenueundersections 14387.400to387.440.Motorvehiclesotherthanschoolbusesusedtotransportschool 15childrenshalltransportnomorechildrenthanthemanufacturersuggestsasappropriatefor 16suchvehicleandmeetanyadditionalrequirementsoftheschooldistrict. Thestateboard 17ofeducationmayalsoadoptrulesandregulationsgoverningtheuseofauthorizedcommon 18carriersforthetransportationofstudentsonfieldtripsorotherspecialtripsforeducational 19purposes.Everyschooldistrict,itsofficersandemployees,andeverypersonemployedunder 20contractbyaschooldistrictshallbesubjecttosuchregulations.Thestateboardofeducation 21shallcooperatewiththestatetransportationdepartmentandthestatehighwaypatrolin 22placingsuitablewarningsignsatintervalsonthehighwaysofthestate. 23 2.Notwithstandingtheprovisionsofsubsection1ofthissection,anyschoolboardin 24thestateofMissouriinanurbandistrictcontainingthegreaterpartofthepopulationofacity 25whichhasmorethanthreehundredthousandinhabitantsmaycontractwithanymunicipality, 26bi-stateagency,orothergovernmentalentityforthepurposeoftransportingschoolchildren 27attendingagradeorgradesnotlowerthantheninthnorhigherthanthetwelfthgrade, 28providedthatsuchcontractshallbeforadditionaltransportationservices,andshallnot 29replaceorfulfillanyoftheschooldistrict'sobligationspursuanttosection167.231.The 30schooldistrictmaynotifystudentsoftheoptiontousedistrict-contractedtransportation 31services. 32 3.Anyofficeroremployeeofanyschooldistrictwhoviolatesanyoftheregulations 33orfailstoincludeobligationtocomplywithsuchregulationsinanycontractexecutedbyhim 34onbehalfofaschooldistrictshallbeguiltyofmisconductandsubjecttoremovalfromoffice 35oremployment.Anypersonoperatingaschoolbusundercontractwithaschooldistrictwho 36failstocomplywithanysuchregulationsshallbeguiltyofbreachofcontractandsuch 37contractshallbecancelledafternoticeandhearingbytheresponsibleofficersofsuchschool 38district. 39 4.Anyotherprovisionofthelawtothecontrarynotwithstanding,inanycountyof 40thefirstclasswithacharterformofgovernmentadjoiningacitynotwithinacounty,school 41busesmaybeartheword"special". ✔ HB1973 5
